THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance No. 5840, agroved July 7,
1922, as amended, be and the same is hereby further amended
(moo as to rezone Lot 6, Block 30, Beaver Lake Heights, situated
on the north side of East Minnehaha , some 50 feet east of Hazel,
from "A" Residence District to Commercial District.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

Dear Sir:
This is in the matter of the petition of Harry E. Dahlgren to rezone from
"A" residence to "commercial," one 50' lot located on the north side of
east Minnehaha some 50' east of Hazel. The property under consideration
is described as lot 6, block 30, Beaver Lake Heights Addition. This property
has been zoned "A" residence since the adoption of the Zoning Ordinance.
It has a frontage of 50' on Minnehaha and extends northerly to a depth of
100' . It is presently occupied by a single-family home.
As outlined in detail in the applicant's letter dated February 0, 1957,
signed. by A. 0. Jacobson of the Cherokee Real Estate Company, this re-
zoning is being proposed to permit the establishment of a beauty parlor
in this residential structure.
The adjacent land uses are as follows: the lot immediately to the west
whtbh is adjacent to the northeast corner of Hazel and Minnehaha is vacant.
The remainder of the surrounding area is developed with single-family homes.
In view of the residential character of the surrounding area and the small
size of the tract of land involved, the Zoning Board does not feel that the
property under consideration should properly be zoned for commercial pur-
poses. In coming to this conclusion, the Zoning Board notes that the site
under consideration does not afford enough space for off-street parking nor
is it related in any way to any other commercial development in the area.
This petition is apparently presented for the convenience of the prospective
purchaser of the property who desires to use the residential structure
located thereon for a purpose which is not permitted in the present zone. The
Zoning Board is mindful that a beauty parlor could conceivably be established
in this residence without materially affecting abutting property.
The changing of the classification of the zoning, however, is a substantially
more serious matter in that all of the uses allowed in commercial zones
presumably could be established at this point without any further review by
the City Council. The Zoning Board has noted that in similar cases in the
past many of the adjoining property owners who signed petitions of this
type think, primarily, in terms of the proposed use and not the long-term
effect of the proposed zoning classification.

The Zoning Board feels that the interests of the surrounding community will
be best served if the present zoning classification is maintained so as to
prohibit the establishment of activities at this point of a commercial
character. In this connection it may be noted that the Zoning Board's con-
clusion that this is not a commercial area is borne out by the fact that the
vacant lot immediately to the west was rezoned in 1946 on speculation to a
commercial classification. The fact that it has remained vacant during eleven
of the most intensive building years which our city has known tends to verify
the general proposition that this is not a proper location for commercial
activities.
In consideration of these factors the Zoning Board recommends that this
petition be denied.

This letter is t o acquaint you with the prepared re—zoning appli-
cation that has been filed with the city Clerk's office, for re-
zoning of Lot 6, Block 30, Beaver Lake Heights, St. Paul, under
the address cf 1905 E. Minnehaha, from residential to commercial.
The present owners, Mr. and Mrs. A. F. Pagel, are selling the
p roperty to Allrina E. Novotny, a single lady. She plans to use
the home principally as a dwelling, and to install and operate a
beauty parlor in the living room of the house. She will have no
employees, and her business consists mainly of neighborhood women
who use her services as beauty operator, and walk to the shop so
there will be no parking problem. She does not plan any major
changes on the outward appearance _of the property.
The vacant lot on the corner next to the property, has already
been zoned commercial. He have obtained 9 petitioners out of
the 11 effected property owners, that have agreed to permit t' is
change in the use of the dwelling.
We will appreciate your approval of this matter when it is sub-
mitted to the Council, and thank you for your consideration.
