Whereas,
In the matter of the con-
struction of a Sanitary Sewer on
EAGLE STREET between Shepard
WHEREAS, In the Matter of the construction of a Sanitary Sewer on EAGLE
STREET between Shepard Road and Spring Street and a Sewer Connection
across EAGLE STREET, approximately 150 feet north of Shepard Road,
AVOLES CONTRACTING COMPANY, Contractor, Comptroller's Contract L-5459-28,
for the contract thereof, the specified dare of completion was January
19, 1957, and
WHEREAS, Said Contractor has prosecuted the work diligently, but due to the
extensive work being done on Shepard Road, Contractor experienced delays
beyond his control, resulting in his not being able to com2lete his
work by said completion date, now therefore be it
RESOLVED, That the proper City Officers be and they are hereby authorized and
directed to execute an amendment to said contract extending the time of
completion to MAY 1, 1957, provided however, that this Resolution shall
have no force or effect unless the sureties on the Contractor's Bond
consent thereto and file such consent in writing with the City Comptroller,
and be it
FURTHER RESOLVED, That the City of St. Paul hereby waives all claims for
liquidated damages and that no engineering and inspection costs on this
project will be charged by the City on account of such extended period.
