No. 475 was invalid and void under Sec. 129 because the there petition was not made by "the majority of the owners of the property on the line of such *** alley ### resident in the said city." II The Council, under Sec. 233 — (1) (a) — may acquire and accept an alley for public purposes, but if it does so it must "be inaugurated and carried out in the following manner:" (See Sees. 239 — 240 — 241 — 242 — 243.) No. 475, and so far as the east and west alley is concerned, no assessment whatsoever should be imposed upon the Bisbees, because: 1. The there applicant, by the there vacation of the there north and south alley, consolidated its two parcels: 2. The there applicant, by the there vacation, acquired nearly one-third more than the dedicated alleys 3. The there applicant was enabled to build a church ever the vacated alley: 4. The there applicant, it appears, will use the alley for parking pur- poses, With the known damage to the Bisbee property: 5. The former north-and-south alley to Lincoln avenue, which Was vacated by Council. File No. 475, Was, prior to the vacation, the means by whist. the Bisbees gained access to their property from the street, first by carriage and later by automobile. At no time did they use either of the two alleys that ran West to Cambridge street, nor the one that ran south to Princeton avenue, since these were roundabout routes. 6. By the vacation of the two alleys that ran west to Cambridge street, and the alley that ran north to Lincoln avenue, and the substitution of the present alley running east to Macalester street, all alley traffic was channelled to the present single route, within ten feet of the Bisbee house: 7. Each of those people who sought to, and did, vacate the three alleys involved herein inurred to substantial benefit, whereas these vacations and dedication imposed upon the Bisbees an additional alley frontage of about 140 feet, with a consequent potential liability for excessive assessments, as in the present instance: 8. Particularly the north—and—south alley to Lincoln avenue, vacated by C. F. No. 475, inurred to immeasurable benefits to the college or its successors, and at this moment the church is erected almost midway upon this earlier vacated north-end—south alley: 9. The Bisbees insist that no part of any alley inures to their benefit; they go to and from their garage on their own property, and from Macalester street. / - ' / it( w. E. A. While the remaining petitions do not com- ply with the requirements as to form, the total number of sig- natures on the combined petitions is insufficient for a Pe- tition of Remonstrance. On the basis of the increased cost the assessment will be $5.33 per assessable foot, as compared with the original estimate of $4.49, per assessable foot, which represents an increase of 18.7%. In accordance with the suggestion contained in the Engineer's letter, and informal hearing has been scheduled before the City Council at 10:00 a.m. on August 6, 1958, in the City Hall and Court House Building in St. Paul, at which the property owners will have an opportunity to be heard relative to the advisability of awarding the contract at the increased cost. If unable to attend. this hearing will you kindly notify this office prior to August 6 as to whether you favor or oppose the award of contract at the increased cost. However, when we advertised for bids June 24, 1958, the low bid was $8,750.00 to which we must add the $583.00 for Engineering & Inspection cost making the total $9,333.00. As it is the policy of the Public Works Department not to award contracts over l0X, above the Engineer's estimate it is thought advisable to call a hearing on the increased cost of this job.
