letter of Allen H. Aaron, attorney for Raymond L. Novicki and others
requesting a refund of the $35 fee paid in connection with filing a
petition to rezone Lots 1, 2, 3 and 4, Block 2, Birmingham Park, for
the reasons set out in the letter.

St. Paul, Minnesota
Gentlemen:
On behalf of the petitioner, Raymond L. Nowicki and others, I hereby
request a refund of the $35.00 fee paid in connection with a petition
for the rezoning of Lots 1, 2, 3 and 4, Block 2, Birmingham Park, for
the reason that said petition was found to be insufficient and a petition
for rezoning the same property to Commercial District had heretofore been
found to be insufficient as to signatures necessary.
The second petition src lared to be insufficient on the face thereof
for the reason that signatures of spouses were not affixed. Petitioner
and his attorney were unaware that said signatures of said spouses were
required.
In view of the insufficiency of the second petition on the very face
thereof and in view of the fact that filing fee was paid on the prior
petition to rezone to Commercial, petitioner feels equitably entitled
to a refund of the $35.00 fee paid in accompaniment of his second
petition.
