An ordinance amending Ordinance No. 5840, entitled:
"An ordinance for the purpose of promoting
the public health, safety, order convenience,
prosperity and general welfare by providing
for the classification, regulation and
restriction of the location of trades and
industries, and of buildings used for human
habiation and for specified purposes , and the
height and bulk of buildings hereafter erected
or altered; and regulating and determining the
minimum size of lot line courts and other open
spaces, and establishing the boundaries of
districts for said purposes" ,
approved July 7, 1922, as amended. This is an emergency ordi-
nance rendered necessary for the preservation of the public
peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance No. 5040, approved July 7, 1922,
as amended, be and the same is hereby further amended so as to
rezone Lots 2, 3, 4, Block 2, Lots 2, 3, 4, Block 3, Ames &
Kiefer 's Rearrangement of Lots 10, 11 , 12, 15, 16 and 17,
Oak Park, said property being located adjacent to the south
side of the Chicago, St. Paul, Milwaukee and Omaha Railroad
tracks, on Herbert and Germain, from "A" Residence District
to Heavy Industry District.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage,

Dear Sir:
This is in the matter of the petition of Earl Bauerfeld to rezone from "A"
residence to "Heavy Industry", the property located adjacent to the south
side of the Chicago, St.. Paul, Milwaukee and Omaha Railroad tracks, bisected
by, Germain street. This property is described as lots 2, 3, 4, —block 2:
Lots 2, 3, 4 - block 3 Ames & Kiefer's Re-arrangement of lots 10, 11, 12,
15, 16 and 17 - Oak Park Addition.
The property under consideration actually consists of two parcels: it has a
frontage of 120' along Germain and extends 103' to the east and 103' to the
west of Germain street. The parcels have a total area of approximately 24,720
sq. ft.
The land is presently vacant and low. The surrounding area is a mixture of
vacant and single-family homes to the west and to the south: to the east is
the Hazel Park Lumber Company which is zoned "Heavy Industry." This proposed
re-classification actually constitutes a westerly extension of the existing
heavy industrial zone.
The applicants contemplate filling the land and utilizing the space for the
outdoor preparation of coal-mixed asphalt which is primarily used for resi-
dential driveway purposes. The specific nature of this use has been outlined
in detail in the applicant's letter dated October 15, 1956 signed by Mr.
Christenson, his attorney.
The Zoning Board has reviewed this proposal from the standpoint of the appropri-
ateness of this activity in relationship to the surrounding area and finds no
objection to this activity from the standpoint of its effect on adjacent land
use. In coming to this conclusion the Zoning Board takes note of the fact
that the applicant has expressed a willingness to take all steps that are
appropriate and necessary to insulate the view of this premises from Case St.
which lies a few hundred feet to the south of the property under consider-
ation.
The Zoning Board also feels that a limited expansion of the heavy industrial
zone in this area is permissable in view of its proximity to the ra lamed
tracks and the lack of utility of the land for fiesidential purpos The

Zoning Board is of the mind that the :toning Ordinance provides suitable
protection to the surrounding area from the standpoint of the control of
the uses permitted under a heavy industry classification.
In consideration of these factors, the Zoning Board recommends the petition
be granted.
