This property is legally described as follows, to wit: STINSON'S SUBDNISION OF BLOCK 36 OF ARLINGTON HILLS ADD. TO ST. PAUL LOT 9 BLK 36 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Deparhnent of Safety and Inspections on or before December 8, 2008, the following are the now lmown interested or responsible parties for the Subject Property: Matthew Medick/Kristine Medick, 9479 Rosewood Lane N, Maple Grove, MN 55369; Derick I Lance, 6601 Limmerick Ave, Minneapolis, MN 55429; Wilford and Geske, 7650 Currell Blvd, #300, Woodbury, MN 55439; Wilford & Geske, 7650 Currell Blvd, #300, Woodbury, MN 55125; Payne Phalen District 5 Planning Council. WHBREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated March 25, 2009; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the shucture located on the Subject Property by Apri124, 2009; and VJHEREAS, the enfarcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condirion; subj ect to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearitigs; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, July 14 and July 28, 2QU9 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested ar responsible parties to make the Subject Property safe and not detrimental to the CII' : � � 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 54 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 public peace, health, safety and weIfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with a11 applicable codes and ordinances. The rehabilitation or demolition of the shucture to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, August 5, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 604 WELLS STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollazs ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then laiown responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition haue not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance eondition subject to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. 8. That the Irnown interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. • '7� • The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this shucture and conecting all deficiencies as prescribed in the above referenced Ordex to Abate Nuisance Building(s) in i � •- &9 90 91 92 93 94 95 96 97 98 99 accordance with a11 applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. 2. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Sub}ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 100 4. 101 102 103 104 105 106 107 1Q& 109 110 111 112 113 114 115 116 117 118 5. 119 Prior to demolition of the building(s) and(or removal of any unique building or architectural features, the Department of Safety and Inspection shall ensure that a qualified consultant be hired to evaluate the property for National Register or local historic designation and if determined eligible, would continue to work to protect the site from demolition. If demolition is considered the only reasonable alternative, then the following level of documentation for the historic resourae at 604 Wells Street is recommended by HPC staff: A. The building exterior and its immediate context shall be documented with digital photography. The images shall be at least 2400 x 1800 pixels and the images shall be submitted to HPC staff on a gold CD. B. An architectural description of the property be written that addresses remaining unique historic fabric and the properties existing condition. C. A brief history (context) of the development of the immediate neighborhood be written (2 to 3 paragraphs). It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since June 5, 2008. The current property owner is Matthew MedicklKristine Medick, per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been two (2) SUMMARY ABATEMENT NOTICES since 2008. There have been five (5) WORK ORDERS issued for: - Boarding - Removal of snow and ice - Improperly stored refuse, garbage and misc debris On February 17, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on March 25, 2009 with a compliance date of Apri124, 2Q�9. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (2008 went to assessment on 8-21-08; 2009 due on 6-5-09). Taxation has placed an estimated market value of $19,400 on the land and $66,800 on the building. This building(s) is subject to the resriictions of Saint Paul Ordinance Chapter 33.03 and shall not again be used for occupancy until such tune as a Certificate of Compliance or a Certificate of Occupancy has been issued. This is a two story, wood frame, single family dwelling and its detached two car garage. 1. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. 2. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Pexmit may be required. � 3. The window and/or door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitring and securely fastened to the frames. 4. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. 5. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. 6. There is a lack of Electricity. 7. There is a lack of Water Service. 8. FURNACE: Have a licensed heating contractor service and clean the fumace or boiler and make any necessary repairs. Perform a C/O test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a perxnit. 9. There are missing/damaged plumbing fixtures. Have a licensed electrical contractor make all necessary repairs and certify system. Prove documentation. 10. There are missing/damaged electrical fixtures. Repair all ceiling defects and finish in a professional manner. 12. The interior walls are defective. Repair all wall defects and finish in a professional manner. 13. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is impervious to water and easily cleanable throughout the bathroom and seal around the edges and fixtures. 14. Smoke Detector: Lack of properly installed and operable smoke detector. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by April 24, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demofition costs will be assessed against the property tases as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (b51)26b-9090. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. If this building is located in a historic district or site (noted above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review application and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staf£ No permits will be issued without HPC review and approval. As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is furthex required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement acrion is necessary. Ordering the owner to remove or repair the building(s) at 604 Wells Street within fifteen (15) days from adoption of resolution. The property owner of recard, Matthew and Kristine Medick, did not appear. No other parties of interest appeared. Mr. Magner stated the building was a two-story, wood frame, single-family dwelling with a detached gazage on a lot of 4,792 square feet and had been vacant since 7un 5, 2008. A code compliance inspection had not been done on, the vacant building registration fees in the amount of $1,000 went to assessment on August 21, 2008, and the $5,000 performance bond had not been posted. On February 17, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on March 25, 2009 with a compliance date of Apri124, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land to be approximately $19,400 and the building to be $66,800. Real estate taaces for the first half of 2009 were delinquent in the amount of $1,685.14, plus penalty and interest. Code Enforcement estimates tYae cost to repair the building to be approximately $70,000 to $80,000. The cost for demolition was estimated to be approximately $10,000 to $12,Q00. There had also been two summary abatements issued to this property since 2008, five of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Ivlr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1885 and was an East Lake-style building, built during the Victorian era. The property had been inventoried and was located in the Payne Avenue eligible historic district. She recommended this property be forwarded to the HPC for review and noted that SHPO had returned the form indicating that a funding source had not been identified on the form. Ms. Moermond reviewed the notification list and said that Wilford & Geske were listed as the attorneys, although it was unclear whether this was a foreclosure situation. She said she would contact someone at Wilford & Geske to see if they would be able to gain access to the building, although she was not optimistic about being able to do so. (Laid over from July 14 Ms. Boulwaze asked Ms. Moermond whether she able to make contact to be able get into the building. Ms. Moermond responded that she had talked to Christina Weber, Wilford & Geske, to see if there would be any possible way to gain access to the building to review the historic value of the property. Ms. Weber indicated to her that she had represented the bank in the foreclosure and they had since charged off the loan. She said she would make the request; however, she did not believe her client would have any interest in making an accommodation to get into the building. Ms. Moermond stated that the only way she believed they would be able to gain access would be through an administrative search warrant which she did not believe would be successful. She asked Ms. Boulware whether she had communicated with SHPO regarding the funding source for the demolition. Ms. Boulware responded that she was still waiting to heaz back from SHPO; however, even though the property had been surveyed, she did not believe they would recommend this property be considered for national historic registration as it was across from the potential Payne Avenue Historic District. Ms. Moermond noted that Ms. Spong had indicated at the previous hearing that this was located in the potential historic district which was now not the case. Mr. Magner stated that the form had been amended to include the funding source as CDBG funding and was sent back to SHPO. He said the likely source of the funding for this demolition; however, would likely come from ISP funds due to the fact it was in an ISP area. The detexmination of the funding source was generally not determined until payment to the contractor. Ms. Boulware suggested this be referred to the HPC for review and that the next meeting was scheduled for August 13. She believed the property should be documented given the historic character of the building and that it had been surveyed. Ms. Moermond responded that she did not want to hold up the process for review by the HPC. She recommended the building be removed or repaired within 15 days and that the resolution be amended to include documenting the property for historic archival purposes prior to demolition.
