This property is legally described as follows, to wit: WEST ST PAUL BLKS 100 THRU 171 ETC LOT 10 BLK 106 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before December 28, 2008, the following are the now known interested or responsible parties far the Subject Property: Lasalle Bank Na As Trustee/Co Wilshire Credit Corp, 14523 SW Millikan Way, #200, Beaverton, OR 97008; Terry Daniels, Counselor Realty, 3580 Linden Ave, White Bear Lake, MN 55110; Reiter & Schiller, PA, 25 N Dale Street, 2 Floor, St Paul, MN 55102; West Side Citizens Organization. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul I,egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated March 25, 2009; and WHEREAS, this order infornned the then known interested or responsible parties that the shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by Apri124, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subj ect to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, July 14, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested i , ;.. 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 54 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its bIighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, August 5, 2009 and the testimony and evidence including the action taken by tl�e Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 20 STEVENS STREET EAST. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). G� � That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. The demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. If the above corrective action is not completed within this period of tune Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Froperty pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. According to our files, it has been a vacant building since March 14, 2008. The cuirent property owner is Lasalle Bank Na As Trustee/Co Wilshire, per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been nine (9) SUMMARY ABATEMENT NOTICES since 2008. There have been five (5) WORK ORDERS issued for: - Boarding - Removal of snow and ice On March 4, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photogaphs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on March 25, 2009 with a compliance date of April 24, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Support beam adjacent to basement door with column and secure column to floor/plinth and beam. 3. Secure existing metal column to beam and provide plinth block. 4. Provide squash blocks at post at kitchen area to beam in basement. 5. Remove shed attached to house on southwest corner of fire rate. 6. Secure posts at car port and provide one hour constructions between carport and house. 7. Provide access cover to crawl space on exterior of house. 8. Insure basement cellar floor is even, is cleanable, and all holes are filled. 9. Install handrails and guardrails at all stairways, including basement stairways, per attachment. Provide thumb type dead bolts for all entry doors. Remove any surface bolts. � � �.. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as necessary. 14. Provide complete storms and screens, in good repair, for all door and window openings. 15. Repair walls, ceilings and floors throughout, as necessary. 16. Provide fire block construction as necessary. 17. Where wall and ceiling covering is removed install full-thickness or code-specified insulation. 18. Prepare and paint interior and exterior as necessary. Observe necessary abatement procedure if lead base paint is present (See St. Paul Legislarive Code, Chap. 34 for addirional information). 19. Provide smoke detectors per the Minnesota Building Code and carbon monoxide detectors per State law. 20. Repair siding, soffit, fascia, trim, etc. as necessary. 21. Provide weather-sealed, air-sealed, and vermin-sealed exterior. 22. Provide proper drainage around house to direct water away from foundation. 23. Maintain 6 inches minimum clearance between wood and soil, sloped to drain away from foundation. 24. Install downspouts and a complete gutter system. 25. Install rain leaders to direct drainage away from the foundation. ELECTRICAL 1. Ground the electrical service to the water service within 5'of the entrance point of the water service. 2. Provide a complete circuit directory at service panel. 3. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen appliance circuit. 4. Verify that fuse/circuit breaker amperage matches wire size. 5. Properly strap cables and conduits in basement or service conduit on the exterior of the � 9. 10. house. Install globe-type enclosed light fixture on all closet lights. Remove all cord wiring. Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers and plates. Check a113-wire outlets for proper polarity and verify ground. Remove any 3-wire ungrounded outlets, and replace with 2-wire, or ground 3-wire to code. 11. Throughout building install outlets and light fixtures, as specified in Bulletin 80-1. 12. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and other smoke detectors as required by the IRC. 13. Properly wire exterior lights at fronUside/back door. 14. Remove and/or rewire all illegal, improper or hazardous wiring in basemendgarage. 15. All electrical work must be done by a licensed electrical contractor under an electrical permit. Panel blocked by exhaust, remove ductwork for Art 110.26 clearance. 18. Meter tag removed and un-insulated service drop splices, wire entire service to code. 19. All areas rock removed wire to current code. 20. Wire entire house and garage to Bulletin 80-1. PLUMBING All plusnbing work requires permit(s) and must be done by a plumbing contractor licensed in Saint Paul. Basement 1. The water heater piping is incorrect. 2. The water heater is not fired or in service. 3. The water meter is removed and not in service. 4. Repair or replace all corroded, broken or leaking water piping. 5. Run 1" water line from meter to first major take off. 6. The dryer gas shutoff, connector or gas piping is incorrect. 7. The soil and waste piping has unplugged, open or back pitched piping. 8. The soil and waste piping has improper pipe supports and improper connections, transitions, fitting or pipe usage. First Floor 9. The lavatory is inconectly vented. 10. The toilet waste is incorrect. 11. The bathtub is un-vented. Replace waste and overflow also, provide anti-siphon/anti- scald valve. 12. The kitchen sink is un-vented and the waste is inconect. 13. The range gas shutoff, connector or gas piping is incorrect. Exterior 14. The lawn hydrant(s) requires backflow assembly or device. HEATING 1. Install approved lever handle manual gas shutoff valve on boiler and remove unapproved valves. 2. Clean and Orsat test boiler burner. Check all controls for proper operation. Check furnace heat exchanger for leaks; provide documentation from a licensed contractor that the heating unit is safe. 3. Vent clothes dryer to code. 4. Provide adequate combustion air and support duct to code. 5. Provide support for gas lines to code. 6. Plug, cap and/or remove all disconnected gas lines. 7. Provide adequate heat in every habitable room and bathrooms including rooms with electric heat. 8. Support supply and return piping for hearing system according to code. 9. Conduct witnessed pressure test on hot water heating system and check for leaks. Mazch 25, 2009 09-844 20 STEVENS ST E page 5 10. Install back flow preventer on city water fill line to hot water heating system and pipe vent as required. 11. Gas and hydonic mechanical permits are required for the above work. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by April 24, 2009 the Deparhnent of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including admuustrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. If this building is located in a historic district or site (noted above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review application and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner ar responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement acrion is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolurion stating what acrion if any, it deems appropriate. Ordering the owner to remove or repair the building(s) at 20 Stevens Street East wifhin fifteen (15) days from adoption of resolution. The property owner of record, LaSalle Bank NA c/o Wilshire, did not appeaz. Dennis Winge, a neighbor, appeared and stated that he was interested in rehabilitating the properry. Mr. Mangez responded that this was a category 3 vacant building and only LaSalle Bank could complete the rehabilitation before they could market the property for sale. Ms. Moermond asked for a report from Mr. Magner. Mr: Magner stated the building was a one- story, wood frame, single-family dwelling with a masonry shed on a lot of 7,405 square feet and had been vacant since March 14, 2008. A code compliance inspection had been done on Decexnber 18, 2008, the vacant building registration fees in the amount of $1,000 went to assessment on August 21, 2008, and the $5,000 performance bond had not been posted. On March 4, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on March 25, 2009 with a compliance date of Apri124, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $43,900 and the building to be $83,000. Real estate taxes for the first half of 2009 were delinquent in the amount of $1,247.40, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $9,000 to $10,000. There had also been nine suinmary abatements issued to this property since 2008, five of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, boazding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report &om Ms. Spong. Ms. Spong stated that this building was built in 1900 and was a worker's cottage-style building. The exterior had been altered, there was no historic significance to the property, and it was not located in any potential historic district. She did not believe demolition would have an adverse effect on the neighborhood. Ms. Moermond stated that under the ordinance, a category 3 vacant building could not be sold until it was completely brought up to code compliance. Since no one representing the bank appeazed, she recommended the building be removed in 15 days with no option far repair.
