WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an°Order to Abate Nuisance Building(s)" dated March 25, 2009; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuanf to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by Apri124, 2009; and WfIEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WIIEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, July 14, 2009 to hear testimony and evidence, and after receiving testnnony and evidence, made the recommendation to approve the request to order the interested 09-841 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 $4 85 or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating trus siructure in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (1� days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, August 5, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 831 JESSAMINE AVENUE EAST. 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. � That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buiidings. :� That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ••� ' The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not deh to the public peace, health, safety and welfare and remove its 1. ti9-2�41 86 87 88 89 90 91 92 93 2. 94 95 96 97 98 99 100 101 102 103 104 105 106 blighting influence on the community by rehabilitating this sriucture and conecting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolirion and removal of the structure must be completed within "=�a `�� sixtv 60 days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Deparhnent of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. According to our files, it has been a vacant building since July 18, 2008. The current property owner is Mortgage Elec Reg Systems Inc/Co Gmac Mortgage LLC, per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been eight (8) SUMMARY ABATEMENT NOTICES since 2008. There have been three (3) WORK ORDERS issued far: - Boarding - Removal of snow and ice On February 1'1, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on March 25, 2009 with a compliance date of April 24, 2009. This is a two story, wood frame duplex. Interior 1. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is impervious to water and easily cleanable throughout the batl�room and seal around the edges and fixtures. Lack of Electricity. Immediately restore electrical service. Failure to provide proper electrical service will result in these premises being declared Unfit for Human Habitarion and ordexed vacated for lack of this basic facility. Iise of candles, fuel operated lighting or extension cord wiring is not permitted while the power is off. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perform a CIO test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 4. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. ouflet. Permit May Be Required. 5. Lack of Natural Gas Service. Immediately restore natural gas service. Failure to provide nahual gas service will resuk in these premises being declared Unfit far Human Habitation and ordered vacated for lack of this basic facility. 6. The stairs have missing or defective handrails. Provide all inCerior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 7. 'I`he interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 8. The interior walls are defective. Repair all wall defects and finish in a professional manner. There is evidence of a rodent infestation. Immediately exterminate and eliminate all rodents from the entire building. Remove rodent harborages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestation. Immediately remove any dead rodents from the premises. The Saint Paul Legslative Code requires all exterior property areas to be maintained in a clean and sanitary condition. Usable materials must be stored in an approved manner, so as not to constitute a nuisance. 11. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. 12. Lack of Water Service. Immediately restore water service. Faihue to provide water service will result in these pxemises being declared Unfit far Human Habitation and ordered vacated for lack of this basic facility. Exterior 13. The chimney is defecUve, deteriorated or in a state of disrepair. Replace a1] missing or defecfive bricks, tuckpoint as needed to restore the chimney to a professional state of maintenance and repair. Permit may be required. 14. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. 15. The exterior walls andlor trim of the house and/or garage has defecfive, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 16. The roof is deteriorated, defective, ar in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. 17. The exterior wa11s of the house and/or garage are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. 18. The window andlor door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to tt�e frames. 19. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by Apri124, 2009 the Department of Safety and March 25, 2009 831 JESSAMINE AVE E page 4 (� :' Inspections, Division of Code Enforcement, wi11 begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolirion costs will be assessed against the property tases as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This inspecrion will identify specific defects, necessary repairs and legal requirements to conect this nuisance condition. If this building is located in a histaric district or site (noted above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review applicarion and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequerit owners. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is requued by law to post a placard on this property which declares it to be a"nuisance condirion", subject to demolition and removal by the City. This placard sha11 not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enfarcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this arder, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate, If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paui Legislative Code and provide that if corrective action is not taken within the specified time, the City sha11 abate this nuisance. The costs of this action, including administrative costs will be assessed against the property as a special assessment in accordance with law. Ordering the owner to remove or repair the building(s) at 831 Jessamiiie Avenue East within fifteen (15) days from adoprion of resolurion. The property owner of record, MERS c/o GMAC Mortgage LLC, did not appeaz. No other parties of interest appeared. Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 4,792 squue feet and had been vacant since July 18, 2008. A code compliance inspection had been done on April 16, 2009, the vacant building registration fees in the amount of $1,000 went to assessment on October 1, 2008, and the $5,000 performance bond had not been postc�c3. On February 17, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on March 25, 2009 with a compliance date of Apri124, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the market value of the land to be approximately $20,000 and the building to be $80,000. Real estate taaces for were current. Code Enforcement estimates the cost to repair the building to be approximately $4Q000 to $60,000. The cost for demolition was estimated Yo be approximately $8,000 to $10,000. There had also been eight suminary abatements issued to this property since 2008, three of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, boarding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1889 and was a late Queen Anne-style building. She noted that the exterior had been altered with the removal of the porch and it had been stuccoed. She said demolition would not have an adverse effect on the neighborhood. Ms. Moermond stated that it was her understanding that the property was possibly being conveyed to the HRA. Mr. Magner expressed concern that if the building were going to be demolished anyway, it was DSI's position that they could order the demolirion which funding would come out of the ISP demolition funds. Ms. Moermond recommended referring the matter back to the August 11 Legislative Hearing and August 19 Councii Public Hearing to obtain a report from the I�RA. Ms. Moermond stated that since no one from the I�RA was present at the hearin� and no one from the HRA had communicated as to the intention of the property, she recommended ihe buiiding be removed within 15 days with no option for repair.
