This is an emer- gency ordinance rendered necessary for preservation of the public peawa health and safoty An administrative ordinance fixing a schedule of charges for the use of the Saint Paul Municipal Stadium and determining to what uses the Stadium shall be devoted in addition to professional baseball, and repealing all other ordinances and parts of ordinances inconsistent herewith. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. Under the direction of the Council, ;.- � Commissioner of Libraries, Auditorium, Museums and Stadia shall have the control and administration of the Saint Paul Municipal Stadium, and all property appertaining thereto. He shall enter into contracts for the leasing of any of said premises and such other contracts as are necessary in the management of the Stadium and the property connected therewith. Anyone desiring the use of the Saint Paul Municipal Stadium, other than the professional baseball team to whom use of the Stadium is permitted under separate agreement with the City, shall pay for such use the following enumerated charges, said charges to be determined and based in consideration of the type of activity to be carried out in said use of the aforementioned Stadium: 1. For use of the Stadium for baseball events : a) For an American Legion Baseball Tournament: $100.00 per day, plus 5 per cent of the gross receipts , said daily rate to include )/ use of the Stadium at night when the playing field lights are to be in operation. The user of the Stadium for such event shall, in addition thereto, pay for the public address announcer and the scoreboard operator. The City shall pay for such additional attendant help as may be necessary out of its share of the receipts. b) For high schools and secondary schools , $100.00 per day, plus 5 per cent of the gross receipts , said daily rate to include use of the Stadium at night when the playing field lights are to be in operation. The user of the Stadium for such event shall, in addition thereto, pay for the public address announcer and scoreboard operator. The City shall pay for such addi- tional attendant help as may be necessary out of its share of the receipts. In addition to , the foregoing charge, the user shall be required to pay for the public address announcer and scoreboard operator to the extent such personnel is desired. e) Night baseball games between teams of college level, the charge shall be $200.00 or ten per cent of the gross receipts, whichever is greater, with the City to furnish necessary attendant help out of the aforementioned charge. 2. For use of the Stadium for football events: a) For use by collegiate teams, $250.00 per day, plus 10 per cent of the gross receipts. In addition, the user shall furnish all attendant services, or shall pay for such attendant services as shall be required. b) For use by high schools or secondary schools, $100.00 per day, plus 5 per cent of the gross receipts. Charges for other events except as hereinbefore pro- vided, shall be established by resolution adopted by the Council, upon the recommendation of the Commissioner of Libraries, Auditorium, Museums and Stadia, and approved by the Council, until such time as experience will permit the establishment of fixed and standard rates for other events. 4. Charges for vehicle parking on the Municipal Park- ing Areas adjacent to said Stadium shall be 25$ per vehicle per event conducted at the Stadium, except for events other than professional baseball games, where the Council may by resolution determine that a different rate should be charged, or that parking should be permitted free of charge. 2 . 183073 HO Yi 5. Concession Sales. Concession receipts shall belong entirely to the City, or to the City and to the organization operating the concessions under agreement with the City. Section 2. When the use of the Stadium is for a strictly public purpose, or of particular benefit to the general public and where no admittance fee is charged, the Council may grant the free use of the Stadium for such performance or event. Section 3. Whenever in this ordinance the rental of the Stadium is provided for on the basis of a percentage of the gross receipts of any event, or on a fixed charge and a percentage of gross receipts of any event, the term "gross receipts" shall mean the total revenue received from the admissions charge, less any Federal, State or City amusement taxes, if any. Section 4. Whenever the free use of the Stadium is granted, the Stadium Fund shall be reimbursed from the Contingent Fund to the extent of the cost of opening and oper- ating the Stadium for any such free use event. Section 5. The Superintendent of the Stadium, under the direction of the Commissioner of Libraries, Auditorium, Museums and Stadia, may, in his discretion in the rental of the Stadium or any part thereof, require a deposit from the respective user which in no case shall be less than the base use charge for such type of event as is hereinbefore specified, or as the Council may, by resolution, determine. Section 6. It shall be the duty of the Superintendent of the Stadium, under the direction of the Commissioner of Libraries, Auditorium, Museums and Stadia, to collect the fore- going charges when the use of the Stadium or any of its facil- ities shall be granted to any person or persons, unless a proper agreement in writing, signed by such person or persons and by the Commissioner of Libraries, Auditorium, Museums and Stadia on behalf of the City of Saint Paul, shall have been entered into. Said agreement shall define the use for which the Stadium i#hired, the price to be charged for same, and shall contain such additional provisions as are usual in agree- ments of this kind, including a provision for insurance coverage to protect and save the City harmless from all demands, claims, actions, causes of action, costs, etc. arising out of the use of the Stadium for such events. Section 7. Nothing herein contained shall be construed as affecting or ch nging the rates to be charged for the use of the Stadium or an art thereof now existing under contracts or commitments herei before entered into by the City. 3 . Section 9 This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 10.
