This property is legally described as follows, to wit: SYNDICATE NO. 1 ADDITION S 1/2 OF LOTS 1 AND LOT 2 BLK 3 9 WHEREAS, based upon the records in the Ramsey County Recorder's Office and 10 information obtained by Department of Safety and Inspections on or before December 28, 2008, ll the following are the now lrnown interested or responsible parties for the Subject Property: Kia 12 Yang, 125 Hyacinth Ave W, St Paul, MN 55117-4511; Shapiro, Nordmeyer & Zielke, 12550 W 13 Frontage Rd, Suite 200, Burnsville, MN 55337; First Cleveland Mortgage, 7100 E Pleasant 14 Valley Rd, Suite 145, Independence, OH 44131; Kia Yang, 10609 Toledo Dr N, Minneapolis, 15 MN 55443-4500; Thomas Dale District 7 Planning Council. 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, Department of Safety and Inspections has served in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated March 25, 2009; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by April 24, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Departrnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, July 14, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested 1' :• I 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the sh-ucture to be completed within fifteen (15) days after the date of the Council Aearing; and WIIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, August 5, 2009 and the testnnony and evidence including the acrion taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 501 GROTTO STREET NORTH. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies ar to demolish and remove the building(s). C� 7 That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declazes it to be a nuisance condition subject to demolition. That this building has been rourinely monitared by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. If the above corrective action is not completed within this period of rime Department of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. According to our files, it has been a vacant building since December 19, 2008. The current property owner is Kia Yang, per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been two (2) SUMMARY ABATEMENT NOTICES since 2008. There have been three (3) WORK ORDERS issued for: - Boarding - Removal of snow and ice On March 11, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on March 25, 2009 with a compliance date of April 24, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (went to c�ssessment on 3-27-09). General This property was condemned by the DSI Certificate of Occupancy progam. The basement could not be inspected because of unsafe conditions. ORDER: Repair the structure to a habitable condirion. This structure is a registered vacant building that must have a Code Compliance Certificate before the structure may be occupied. Obtain a Code Compliance Certificate from the Department of Safety and Inspections. You may contact Jim Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and issuance of the Code Compliance Certificate. Under Chapter 33.03 of he Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate before occupying the structure may result in issuance of criminal summonses. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by April 24, 2009 the Deparhnent of Safety and Inspections, Division of Code Enfarcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property tases as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. March 25, 2009 501 GROTTO ST N page 4 09-840 The Enforcement Officer is required by law to post a placazd on this property which declazes it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Depariment of Safety and Inspections, Division of Code Enforcement. The depariment is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this oider, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, including administrarive costs will be assessed against the property as a special assessment in accordance with law. Mr. Magner stated the building was a two-story, masonry/wood frame, single-family dwelling on a lot of 3,920 squaze feet and had been vacant since December 19, 2008. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,000 went to assessment on March 27, 2009, and the $5,000 performance bond had not been posted. On March 11, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on March 25, 2009 with a compliance date of Apri124, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $60,000 and the building to be $220,000. Real estate taxes for the first half of 2009 were delinquent in the amount of $2,865.62, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $70,000 to $80,000. The cost for demolition was estimated to be approximately $10,000 to $11,000. There had also been two suuimary abatements issued to this property since 2008, three of which went to work order: to secure the building and the City had to board the building to secure it from trespass, boarding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1888 and was a double house with a brick veneer which had been painted and the exterior had been altered. She noted that the machine shed located next to the building hurt the integrity of the property. She said the property had been inventoried and was located approximately two blocks outside the potenrial Frogtown Historic District. She requested the property be referred to the HPC for review and recommendation. Ms. Moermond stated that a code compliance inspection had not been done and after looking at the mailing notificarion, she noted that Shapiro, Nordmeyer were listed as the attorneys, possibly in a foreclosure situation. She suggested she would talk to Larry Zielke at Shapiro, Nordmeyer to see if a code compliance inspection could be done and whether access could be allowed to the building so Ms. Spong could take photographs. He said his client was hying to determine whether to proceed with demolition or rehabilitation of the building. Mr. Magner stated that at the hearing on 7uly 14, no one appeared. It was indicated that the properry should be forwazded to the HPC for review. He said as of today's date, there was no application for the code compliance inspection. He noted that the real estate taxes since the last hearing had been paid and were current. Ms. Boulware stated that the property was on the agenda for review by the HPC on August 27 and she should have a recommendation back to the hearing officer by the following day. Mr. Patterson stated that he had received two demolition bids in the approximate amount of $22,000 and was currently waiting for a third bid. A building contractar had also gone through the building and presented a bid in the amount of $60,000. He said his client would then decide how they wanted to proceed with the property; however, he believed they were leaning towards demolition. Ms. Moermond expressed dismay that the code compliance inspection had not been applied for and if the building did not have historic significance, she would not be interested in hearing from Mr. Patterson. She indicated that the following conditions must be met by the close of business on September 1 in order to recommend a grant of time: 1) the code compliance inspection must be ordered; and 2) the $5,000 performance bond must be posted. SITE DESCRIPTION: This two-story, brick double-house with a truncated hip-and-gable roof was constructed in 1888. The building has a central box-like mass has gabled windows projecting from the side walls and central gable end on the main fa�ade, decorative brick work above windows and between stories and entrance porches at the sides of the main faqade. There are two interior brick chimneys and rectangular and segmental arched windows. The soft, brick exterior has been painted since at least 1982 when the Historic Sites Survey form was completed. The listed original owner and builder is John Brandl. This property, at the corner of Grotto and Sherburne is two blocks west of the potential Frogtown Historic District boundaries but was individually identified in the 1983 Historic Sites Survey. B. PROPOSED CHANGES: During the Legislative Hearing on July 14, the Legislative hearing officer recommended a one month layover so that a code compliance report could be completed staff could get into the building. Staff has yet to gain access to the building. At the August 5 City Council public hearing the legislative hearing officer requested a layover so the HPC could consider this property for review as a historic resource. A historic resource is defined as "A property that is believed to have historical, cultural, architectural, archaeological or engineering significance and to meet at least one of the criteria for designation as a heritage preservation site or district as provided in this chapter." This property will go back to Legislative Hearing on September 8 and on to the City Council agenda for September 16. C. GUIDELINE CITATIONS: Sec. 73.05. Designation of heritage preservation sites. (a) Criteria. In considering the designation of any area, place, building, structure or similar object in the City of Saint Paul as a heritage preservation site; the commission shall apply the following criteria with respect to such designation: (1) Its character, interest or vaiue as part of the development, heritage or cultural characteristics of the City of Saint Paul, State of Minnesota, or the United States. (2) Its location as a site of a significant historic event. (3) Its identification with a person or persons who significantly contribuYed to the culture and development of the City of Saint Paul. (4) Its embodiment of distinguishing characterisfics of an architectural or engineering type or specimen. (5) Its idenrification as the work of an architect, engineer, or master builder whose individual work has influenced the development of the City of Saint Paul. (6) Its embodiment of elements of architectural ar engineering design, detail, materials or craftsmanship which represent a significant azchitectural or engineering innovation. The property was surveyed and identified during the 1983 Historic Sites Survey of Ramsey County (RA-SPC-1640). The survey identified two potenrial historic districts and sixty-one sites in District 7 as eligible for designation or as sites ofmajor significance. Properties like 499-501 Grotto Street North aze integral to the historic context of the neighborhoods. No images were found in a search of the MN Visual Resource database. 2. A mare intensive level survey would be required to determine if the building would be individually eligible for local designation or be eligible for the National Register. 3. It is always better to retain historic fabric type buildings than it is to demolish and create a hole in the neighborhood. This particular block face has a variety of housing styles. There are other large brick residential and commercial structures in the immediate area, as the property is located only a half-block north of University Avenue. The rhythm and the style of houses and commercial building around the adjacent intersection appear to have changed very little over the past several decades. The house is a mostly intact example of 1880s-90s brick double-houses that were built throughout Frogtown, the North End and the West Side. 4. The integrity, or authenticity as evidenced by a site's location, design, setting, workmanship or association, is good because the alterations that have occurred, such as the enclosed side porches and non-original windows and storms are easily reversible. The brick has been painted formany years and appears to be a very soft brick. The removal of the paint would be unadvised, as it would likely cause more harm than good. There are still design features intact on this property like the bargeboards in the gables and decorative brick detailing. The site's location and setting would be considered to have good integrity. The condition of the rear brick walls would be considered to have fair to poor integrity, as it appears that water, salt and freeze-thaw cycles have causes spawling and some bowing at the rear sidewalk. E. STAFF RECOMMENDATION: Based on the findings, staff recommends that a qualified historian be hired to evaluate both National Register and local eligibility. Staff recommends that demolition be delayed for this site in arder for alternatives to demolition to be explared, such as mothballing or rehabilitation.
