This 5 property is legally described as follows, to wit: CHAS. WEIDE'S SUBDIVISION OF BLOCK 37 OF ARI,INGTON HILLS ADDITION TO ST. PAUL EX E 2 FT LOT 14 AND ALL OF LOT 15 BLK 37 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 WHEREAS, based upon the records in the Ramsey County Recarder's Office and information obtained by Department of Safety and Inspections on or before June 9, 2008, the following are the now known interested or responsible parties for the Subject Property: HSBC Bank USA Na As Trustee/Co Ocwen Loan Servicing LLC, 12650 Ingenuity Dr, Orlando, FL 32826; Shapiro, Nordmeyer & Zielke, 12550 West Frontage Rd, Suite 200, Burnsville, MN 55337; Terry Daniels, 1282 Dennis St. N, Maplewood, MN 55119; Ray Hessler, Hessler Properties Inc, PO Box 7419, St. Paul, MN 55107; Payne Phalen District 5 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated September 16, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the sh located on the Subject Property by October 16, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, December 23, 2008 and Tuesday, January 13, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation � � : 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, January 21, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 664 WELLS STREET. 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies ar to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the laiown interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested ar responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its b�' `6 s� 88 89 90 91 92 93 94 2. 95 96 97 98 99 100 3. 101 102 103 104 105 106 4. 107 blighting influence on the community by rehabilitating this structure and conecting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of the struchu must be completed within r.r��� one hundred-eiehtv (180) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accardance with Chapter 45 o£the Saint Pau1 Legislative Code. According to our files, it has been a vacant building since August 10, 2007. The current property owner is HSBC Bank USA NA c/o Ocwen Loan Servicing, LLC, per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been five (5) SUMMARY ABATEMENT NOTICES since 2007. There have been four (4) WORK ORDERS issued for: - Removal of improperly stored refuse - Boarding On 5eptember 3, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on September 16, 2008 with a compliance date of October 16, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $39,400 on the land and $69,300 on the building. As of December 22, 2008, a Code Compliance inspection has not been completed. On September 03, 2008, a Building Deficiency Inspection Report was compiled and the following candifions were observed. This list of deficiencies is not necessarily all the deficiencies present at this time. As first remedial action, a Code Compliance Inspection must be obtained from the Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce Building (651)266-9090. That inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. You may also be required to post a five thousand dollar ($5,000.00) performance bond with the Building Inspection and Design Office before any permits are issued, except for a demolition permit. This is a two story, wood frame, single family dwelling. Exterior I. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing or defective bricks, tuckpoint as needed to restore the chimney to a professional state of maintenance and repair. Pennit may be required. 2. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boaxds to a professional state of maintenance. Permit may be required. 3. The exterior walls and/or trim of the house and/or garage has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 4. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. 5. There are missing or defective guardrails. Provide all stairways, porches, decks or steps which are more than 30" high with guardrails and intermediate rails with openings in the guardrail no more than four (4) inches apart and in accordance with the State Building Code. 6. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. The exterior wa11s of the house andJor garage are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. 8. The window andlar door screens are missing, defective or in a state of disrepair. Provide proper window and doar screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 9. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not conected by October 16, 2008 the Departrnent of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatesnent process to September 16, 2008 664 WELLS ST page 3 �-�3 demolish and remove the building(s). The costs of this action, including adminlstrative costs and demolition costs will be assessed against the property tases as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 8 Fourth Street, Suite �200 Commerce Building, (651)266-9090. This inspection will identify specific defects, necessary repairs and legal requirements to cotrect this nuisance condition. As an owner or responsible party, you are required by law to provide full and complete discl�sure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the Ciry. This placai�d shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this °Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this arder, the Enforcement Officer will notify the Ciry Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopC a resolution stating what acrion if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The property owner of record, HSBC Bank USA NA c/o Ocwen Loan Servicin� LLC, did not appear. No other parties of interest appeared. Mr. Ma�er stated the building was a two-story, wood frame, single-family dwelling on a lot of 6,098 squaze feet and had been vacant since August 10, 2007. A code compliance inspection had not been done, the vacant building registration fees were current, and the $5,000 performance bond had not been posted. On September 3, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on September 16, 2008 with a compliance date of October 16, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $39,400 and the building to be $69,300. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $7,598 to $10,598. There had also been five summary abatements issued to this property since 2007, four of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and weeds, and bouding. Code Bnforcement recommends the building be repaired ar removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner responded that the inspector for the area found the building to be unoccupied with numerous exterior violations and referred the property to V acant Buildings. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1888 and may have been originally built as a stick-style house; however, there was a loss of exterior omamentation. This building backed up to the Hamm Brewery and was near Wadena Street. This property had not been surveyed and there was no potential for historic designation; however, it did support an East Lake-style building which was built during the Victorian era. She also noted that there were three vacant lots on this street and the "feel" of a neighborhood had been lost as a result. Ms. Moermond recommended the building be removed within 15 days with no option for repair. a��3 January 13, 2009 Legislative Hearing Minutes Page 2 2. (Originally heard on Dec. 23; no one appeazed; ordered removed within 15 days no option for repair) Andrew Dick, property owner, appeared and stated that he had closed on the property on November 26. Mr. Ma�er read his report into the record that was presented on December 23. He said that he had been contacted by Mr. Dick after the hearing who claimed that he had been out of town for the December 23 hearing. He told Mr. Dick to contact Mai V ang and request that the hearing be rescheduled. He also indicated to Mr. Dick that he would need to fill out the vacant building registration form and retum it to his office, apply for a code compliance inspection, and post the $5,000 performance bond. According to STAMP, on January 13 the application for a code compliance inspection had been made and the performance bond had been posted. He did not have the vacant building registration form in the file and would need to check to see if it had been received in his office. Ma Moermond indicated to Mr. Dick that the properiy was a Category III vacant building and should not have been sold to him. She explained that the Council had enacted an ordinance requiring that the current owner was responsible for rehabilitation of Category III vacant buildings prior to selling. Since she was unsure of the timeline on enforcement of the ordinance change, she said she would need to consult with City Attorney's Office for a determination. Mr. Dick responded that he was not aware that this building was a Category III vacant building when he purchased it and said that he had rehabbed several other Category II vacant buildings in the City. Ms. Moernnond asked whether a realtor or attorney were present at the time of closing. Mr. Dick responded that the realtor, Newell Hill, and the title insurance company, First Financial Title, were present at the closing and no one indicated to him that the building was a Category III vacant building. Ms. Moermond asked Mr. Dick what other properties he had rehabbed in the City and what his plans were for this property. Mr. Dick presented a letter outlining his intention for the property; a copy of said letter is attached and made a part of this record. Mr. Magner asked Mr. Dick if it was his intention to rehab and then sell the property. Mr. Dick responded that this was correct and that the properties on Hawthorne and Maria were currently for sale. Mr. Magner asked Mr. Dick whether he was a licensed general contractor with the state. Mr. Dick responded that he was not. Mr. Magner stated that according to the State Building Code, a property owner could pull as many building permits to do work on their own residence; however, they were only permitted to pull one additional building permit for another dwelling within a 24-month time period. Since Mr. Dick indicated that he had recently worked on at least two other properiies, he would need to hire a general contractor do the rehab for this property. DG-8�3 To Whom It MayConcern: I plan on fixing up 664 Weils Street. I have already repaired all broken windows and storm windows and removed the boards covering broken windows. I have also maintained the sidewalk insofar as shovefing and putting down deicer throughout the winter. 1 plan on making sure all permits necessary to meet code compliance are pulled by the end of lanuary. I have not as yet received the code compliance inspection report, but I am familiar with this process, as I have purchased two vacant properties in St. Paul (763 Hawthorne Ave E and 372 Maria Ave), both of which now have letters of code compliance. 1 have been pretty busy with the holidays and a vacation since I purchased this property, but i am now committing myself in earnest. I anticipate that all the electrical, mechanical and piumbing work wili be done by March 15"'. There is some work that cannot be compfeted until the weather permits, namely the exterior work. The interior is not in that bad of shape, and contains several nice Victorian features that I intend to refurbish. I plan on repairing and painting the entire e�erior, including repairing all the masonry and foundation. (Refeffed back by Council on Feb. 4) Andrew Dick, property owner, appeared. Mr. Magner stated that a legislative hearing was held on January 13 at which time Mr. Dick indicated that he had ordered the code compliance and posted the bond. He said that he srill needed to put together a work plan, obtain contractor bids, and submit fmancial documentation. The work plan that was submitted after the hearing was not based on what was on the code compliance. He said that he had not received any updated documentation from Mr. Dick. Mr. Dick stated that he had bids from his general contractor, Gutierrez Construction, as well as bids for electrical from HC Electric, a mechanical bid from Midland Heating & Air Conditioning, and a plumbing bid from Home Town Pluxnbing. He also had a letter from his bank, US Bank, indicating that he had $60,000 auailable funding to rehab the property at 664 Wells. He presented the documentation for review. Mr. Magner stated that afrer reviewing the bid from HC Electric, he did not find that it addressed many of the items on the code compliance. He asked Mr. Dick whether he had any concerns about the cost of the bid. Mr. Dick responded that he had given the contractor the code compliance list and had reviewed all of the items. He believed only the main items were addressed on the bid and that the contractar believed that since the electrical panel was installed approximately 20 years ago, the inspector may not require it to be replaced. Mr. Magner stated that item 8 under electrical on the code compliance indicated "illegal service upgrade; rewire to 2008 NEC; purchase permit for service an all circuits." He said that if a 2008 service upgrade was required, it was not addressed on the electrical bid from the contractor and the bid was way underestimated. Mr. Magner said that in reviewing the plumbing bid, it only indicated "complete various plumbing code repairs" and quoted $5,999 to do the work. He asked Mr. Dick if the contractor indicated that tYus would address all of the items detailed under plumbing on the code compliance report. Mr. Dick responded that he believed this was correct and that he had another plumbing bid that he received via e-mail which was cheaper which was the plumber he would likely contract to do the work. Ms. Moermond asked Mr. Dick why he had not submitted the plumbing bid for the contractor that he was going to use. Mr. Dick responded that the bid he had submitted had a$6,000 figure which was why he had submitted that bid. Ms. Moermond asked Mr. Dick for the bid which was from Rhinex Plumbing in the amount of $1,451. Ms. Moermond asked Mr. Dick why he had not submitted the plumbing bid from the contractor that he was going to hire to do the project considering the significant cost difference in bids; almost a$5,000 difference. Mr. Dick responded that he had received one bid over the phone whereas the other bid, the contractor actually came out and inspected the building before he gave him his bid. Ms. Moermond suggested that Mr. Dick was not answering the question in that he presented the bid which was almost $6,000 to do the electrical work when he had also received a bid that was approximately $1,500 for the electrical which was who he intended to contract to do the work. She February 24, 2009 Legislative Hearing Minutes 6�-�3 Page 5 viewed it as using the inflated bid to show that the total cost of the rehab was a$58,000 to $60,000 project when it in fact would not cost that much. Mr. Dick said that the second electrical bid he received via e-mail which was less formal than the bid he received from Home Town Plumbing. He said that he was submitting it at the hearing now and was not trying to "keep any secrets" from anyone. Mr. Magner asked Mr. Dick who he was going to use to contract for the plumbing work. Mr. Dick responded that he did not have Home Town Plumbing inspect the house as he didn't believe it was fair to have them drive from Ham Lake to look at the property when it might get torn down. He said that he would have them come out and look at the house to see if they could give him a lower bid. Mr. Magner stated that in reviewing the bid from Rhinex Plumbing, the specific items on the code compliance inspection had also not been addressed. Mr. Magner stated that at the previous hearing, Mr. Dick had testified that he had experience rehabbing other properties other than 619 North. He asked Mr. Dick whether he had rehabbed other properties with a code compliance report. Mr. Dick responded that he had rehabbed two Category 2 vacant buildings; 372 Maria and 763 Hawthorne Avenue East. Mr. Magner asked Mr. Dick what he was going to do with 664 Wells once it was rehabbed. Mr. Dick responded that he planned to sell the property. Mr. Magner asked Mr. Dick what he was doing with the other two houses that he had rehabbed. Mr. Dick responded that one of the houses had been scheduled to close on February 18; however, the closing date had been pushed back. The other house was on the market for sale. Mr. Magner asked Mr. Dick if he would agree that he was using these properties for "speculation." Mr. Dick responded that he didn't understand what he meant by "speculation." Mr. Magner respanded that "speculation" was defined as someone who acquired a property, rehabilitated it and then put it on the market for sale; he asked Mr. Dick if he would agree with this definition. Mr. Dick responded that yes, he was purchasing properties, fixing them up and then selling them to make a profit. Ms. Moermond asked Mr. Dick how much labor he had planned to put into the project. She explained that the bid from Gutierrez indicating that Yhe cost of labor was listed at $20,950 and she wanted to know how much of the labor he had planned to do himself. Mr. Dick responded that he had worked with Gutienez before and it was generally a"work in progress" on what he could do to assist on working on a project or if he could provide supplies at a lower cost. Ms. Moermand said that the bid submitted by Gutierrez indicated the labor to be at approximately 1,000 hours and she wanted to know how many of those hours Mr. Dick planned to contribute. Mr. Dick responded that he could submit that information by the following day. Ms. Moermond reviewed the letter from US Bank and requested Mr. Dick present an Affidavit indicating that he was dedicating $50,000 for the rehabilitation of 664 Wells as she wanted to be assured that he would not use this money then to purchase other properties. Ms. Moermond said that the Council had requested that she look at the details of the work plan and the financial information. She said she would provide the Council with a detailed review and it would then be in the CounciPs purview to make a decision, particularly as it related to Chapter 33.03(fl concerning this property. The first question you raised is whether this ordinance is constitutional. As you know this ordinance, prior to introduction, was reviewed by the Office of the City Attorney pursuant to Administrative Code § 3.02, which requires our office to approve the "form and su�ciency" ofproposed ordinances. We wnsider legal sufficiency to inciude constitutionality. Thus our review and approval of this amendment includes our opinion that it is constitutional. You also asked about Mr. Dick's recourse for the sale of the property to him contrary to the ordinance. As you know, the Office of the City Attorney is the attorney for the City and not Mr. Dick individually. Also, we aze not fully informed of all the facts. So we cannot advise him on potential claims. WEIDE'S SUBDIVISION OF BLOCK 37 OF ARLINGTON HILLS ADDITION TO ST. PAUL EX E 2 FT LOT 14 AND ALL OF LOT 15 BLK 37 to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter 45.02, and subject to demolition under authority of Chapter 45.11. On September 03, 2008, a Building Deficiency Inspection Report was compiled and the following conditions were observed. This list of deficiencies is not necessarily all the de�ciencies present at this time. As first remedial action, a Code Compliance Inspeclaon must be obtained from the Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce Building (651)266-9090. That inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. You may also be required to post a five thousand dollar ($5,000.00) performance bond with the Building Inspection and Design Office before any permits are issued, except for a demolition permit. 'I'his is a two story, wood frame, single family dwelling. Exterior 1. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing or defective bricks, tuckpoint as needed to restore the chimney to a professional state of maintenance and repair. Permit may be required. 2. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be requ3red. 3. The exterior walls and/or trim of the house and/or garage has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 4. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a pt�ofessional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. S. There are missing or defective guardrails. Provide all stairways, porches, decks ox steps which are more than 30" high with guardrails and intermediate rails cvith openings in the guardrail no more than four (4) inches apart and in accardance with the State Building Code. 6. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. The exterior walls of the house and/or garage are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. 8. The window and/or door screens are missing, defective ar in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 9. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make alt necessary repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. As owner, agent or responsible pazty, you are hereby notified that if these deficiencies and the resulting nuisance conditaon is not corrected by October 16, 2008 the Department of Safety and InspecYions, Division of Code Enforcement, wi11 begin a substantial abatement process to September 16, 2008 664 WELLS ST page 3 � demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If conective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a sesolution stating what action if any, it deems appropriate. If 2he resolurion calls for abatement acrion the Council may either oxdet the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action is not taken within the specified time, the City shall abate this nuisance.
