An Ordinance authorizing the issuance of a permit
to The Minnesota Transfer Railway Company, its successors
and assigns, to construct and maintain a track across
Capp Road. This is an emergency ordinance rendered
necessary for the preservation of the public peace,
health, and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That upon compliance with the conditions hereinafter
set out, the Commissioner of Public Works is authorized to issue a permit to
The Minnesota Transfer Railway Company, its successors and assigns, to con-
struct and maintain a track across Capp Road for the purpose of operating
cars or trains oyas the same; that the center line of the proposed track is
described as follows:
A straight line extending southeasterly from a point on the
northerly line of Capp Road, 500 feet northwesterly of the
west line of Vandalia Street extended northerly, to a point
on the southerly line of Capp Road, 430 feet northwesterly
of the west line of Vandalia Street.
The conditions are as follows:
1. Permittee shall save said City harmless from any and
all liability, judgments, suits, costs, charges, damage or
expense accruing to person or property, arising out of the con-
struction, maintenance, use, presence, or removal of said track.
\ 2. Permittee shall file plans and specifications for said.
track with the Commissioner of Public Yorks, which shall be satis-
factory to him and the Chief Engineer, and said track shall be
constructed as he shall direct. Permittee shall so construct the
track as not to oover existing manholes and shall adjust the man-
holes to the top of tie of the track. Permittee shall pay the

3. Permittee shall pay the cost of the publication of this
ordinance.
4. This permit may be revoked by the Council at any time,
and thereupon permittee shall remove said track.
5. Permittee shall, within ten days after the publication
of this ordinance, file a written acceptance thereof with the
City Clerk.
Section 2. That said track and any addition thereto or extension
thereof shall be used for the purpose of serving industries now located or
to be located hereafter on property adjacent to or to be served industrially
by said track and to be used by said Railway for other railway purposes.

Capp Road. This is an emergency ordinance and rendered necessary for thepreser

The Council of the City of Saint Paul does ordain:
SECTION 1.
That upon compliance with the conditions hereinafter set out, the Commissioner
of Public Works is authorized to issue a permit to The Minnesota Transfer Railway
Company, its successors and assigns, to construct and maintain a track across Capp
Road for the purpose of operating cars or trains over the same; that the center
line of the proposed track is described as follows:

line of. Capp Road, 500 feet northwesterly of the west line of Vandalia
Street extended northerly, to a point on the southerly line of Capp Road,
430 feet northwesterly of the west line of Vandalia Street.
The conditions are as follows:

judgments, suits, costs, charges, damage or expense accruing to
person or property, arising out of the construction, maintenance,
use, presence, or removal of said track.
2. Permittee shall file plans and specifications for said track with
the Commissioner of Public Works, which shall be satisfactory to
him and the Chief Engineer, and said track shall be constructed
as he shall direct. Permittee shall so construct the track as
not to cover existing manholes and shall adjust the manhotes to
the top of tie of the track. Permittee shall pay the cost of
inspection, if any.
3. Permittee shall pay the cost of the publication of this ordinance.
4. This permit may be revoked by the Council at any time, and there-
upon permittee shall remove said track.
5. Permittee shall, within ten days after the publication of this
