GeisenCoff; and PRESENTED BY /j/ ✓/�f Whereas, The City has incurred COMMISSIONER medical expenses in the amount of $122.0 in connection with said injury; that the employe was paid his vacation--__ le. ... h...ai,ce elf cid r WHEREAS , Henry Horwath, an employe of the Department of Parks , Playgrounds and Public Buildings of the City of Saint Paul , was injured on duty on November 29, 1955, in a third party accident involving also Richard K. Geisenhoff ; and WHEREAS , the City has incurred medical expenses in the amount of $122.50 in connection with said injury; that the employe was paid his vacation leave while disabled because of said injury, but that $192.00 in workmen's compensation was paid to him during said period, or a total of $314.50; and WHEREAS , the employe has received $2,300.00 in settlement of his claim against thethird party causing the accident, and the City has been offered a settlement of one- half of its expenses of $314.50, or $157.25, less 25 per cent for attorney' s fees , or a net amount of $117.95, Now, therefore, be it RESOLVED, That the proper City officers are hereby authorized to accept said sum of $157.25, less atprney's fees , in full settlement of its subrogation claim in connection with said accident, and that the full amount of $117.95 be credited to Fund 31-G1-A.
