WHEREAS , Vernon P. Michel, an employe of the
Department of Public Safety of the City of Saint Paul,
was injured in a third party accident on December 5,
1956, when an automobile driven by Matthew Morelli
struck the motorcycle driven by the employe; and
WHEREAS , the City has incurred medical expenses
in the amount of $20.50 in connection with the injury of
said employe and has paid the employe salary in the amount
of $60.90 during the time he was disabled for work by
reason of said accident; and
WHEREAS , a settlement has been negotiated between
the parties whereby said employe will receive the sum of
$230.00 in settlement of his claim against the party causing
the accident , and the City will receive the sum of $81.40
for medical expense and wages paid said employe because of
said injury, less one-fourth of that amount for attorney' s
fee, or a net recovery by the City of $61.05 ; and
WHEREAS , the office of Corporation Counsel now has
in its possession a check in the amount of $61.05 payable
to the City, from the offices of Harold E. Ruttenberg,
attorney for the employee, now, therefore, be it
RESOLVED, that the proper City officers are hereby
authorized to accept the sum of $61.05 in settlement of
its claim against the third party involved in said accident,
representing its medical and salary expenses less attorney's
fees ; and that of said sum, $20.50 be credited to Fund 31-G1-B,
and $40.55 be credited to Fund 7-C-1.
