Hurley, an employe of the Depart- ment of Public Safety of the City of Saint Paul, was injured on December 17, 1955 , while engaged in the performance of his duties for the Department of Public Safety, when the car driven by said employe was involved in a three car accident involving also automobiles driven by Anna M. Schleffler and James M. Banghart ; and WHEREAS , the City has incurred medical expense in the amount of $440.75 for said employe, and that he was paid $3340.41 in wages during the time he was disabled for work because of said accident , and the City is committed to pay an additional amount to Dr. Donovan L. McCain, not to exceed $157.00, and to Dr. Gordon Kamman an additional amount of $15.00, the total amount of medical and salary expense in- curred and to be paid being $3,953.16; and WHEREAS , a settlement has been negotiated between the parties in the total amount of $7,500.00, whereby the employe will receive $3,800.00 and the City of Saint Paul would receive one-half of its medical and salary expenses , or $1,976.58, less attorney's fees of one-fourth of the last amount , or a net recovery by the City of $1,482.43; now, therefore, be it RESOLVED, That the proper City officers are hereby authorized to accept the sum of $1,482.43 in full settlement of its claim in the abovementioned accident in connection with the personal injury of the said employe; that of this amount , $612.75 be credited to Fund 31-G1-B, and the remainder of $869.68 be credited to Fund 7-C-1.
