Marzitelli- Resolved, Pursuant, to the proposal therefor,that all controversies between RESOLVED, pursuant to the proposal therefor, that all contro- versies between the City of Saint Paul and Donat R. Courteau and Mae B. Courteau, the registered fee simple owners of the real estate abutting on the east line of Etna Street, a duly platted and dedicated public street within the corporate limits of said City, described. as follows, to-wit: The West a of Lots 1, 2, and 3, in Block 1 of Mayan Park, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, and the occupiers under claim of ownership thereto of that certain frame residence building directly opposite said real estate and located within and as an encroachment upon said Etna Street, be and such controversies hereby are entirely and forever, in accordance with the provisions, terms, and conditions hereof, compromised and settled, such controversies being those which have arisen and which now exist in respect of the asserted. claim of said City as against said Donat P. Courteau and Mae B. Courteau for the summary removal of said frame residence building from said Etna Street and in respect of the asserted claim of said Donat R. Courteau and Mae B. Courteau against said City, for the undisturbed and continued maintenance of said frame residence building at said location within the said Etna Street; RESOLVED FURTHER, that. said Donat R. Courteau and Mae B. Courteau shall be obligated therefor and by their written acceptance hereof shall covenant and bind themselves unto said City, to entirely and permanently remove said frame residence building from said Etna Street, at their own separate cost and expense and in a manner conformable to the Building Code Ordinance of said City, not later than September 1, 1957; that said Donat R. Courteau and. Mae B. Courteau have warranted and by their acceptance of this resolution shall be deemed to warrant unto said City, their exclusive ownership of said frame residence building and to thereby have bound them- selves unto said City to fully indemnify and hold. said City harmless on account of any and all liability unto any third party or parties resultant from such removal of said frame residence building from said Etna Street; that said Donat R. Courteau and Mae B. Courteau and Mae B. Courteau shall be liable therefor and by their acceptance of this resolution shall be deemed to bind themselves unto said City for the procurement and delivery to said City of the written assent to such removal of said frame residence building, duly executed by the registered owners of Lots 1, 2, and 3, in Block 2 of said Mayall Park; RESOLVED FURTHER, that in consideration of their performance of their aforesaid several obligations hereinabove defined, in compliance herewith, said Donat F. Courteau and Mae B. Courteau shall be paid. the sum of Seven Hundred Fifty Dollars (8750.00) by said. City of Saint Paul, from Judgment and Compromise Fund of said City, such payment to be further contingent upon the written acceptance of this resolution, by said Donat F. Courteau and Mae B. Courteau, and the filing of the same with the City Clerk not later than ten days after the publication of this resolution, and such written acceptance to be in a form approved by the Corporation Counsel.
