1 Wf�REA5, the Boazd of Ramsey County Commissioners has refened a repurchase application for
2 property located at 1384 Westminster Street to the Saint Paul Council for review and recommendation; and
4 WHEREAS, the Legislative Hearing Officer has reviewed police records, illegal activity, property code,
5 and health violations within the past four years; and
6
7 WHEREAS, the St. Paul Police Departsnent responded to on numerous occasions for a variety of criminal
8 and nuisance activity at 1384 Westminster Street;
9
10 WHEREAS, the Legislative Hearing Officer determined that 1384 Westminster Street has had substantial
11 maintenas�ce issues, necessitating numerous nuisance abatement orders; and

WHEREAS, the City of Saint Paul has had to conduct numerous cleanups at the property due to the
owner's failure to abate these nuisance conditions in a timely manner.
NOW, THEREFORE, BE IT RESOLVED, the Saint Paul City Council recommends that the Board of
17 Ramsey County Commissioners not approve the repurchase application for the property of 1384
18 Westminster Street; and

BE IT FURTHER RESOLVED, that the City Clerk is requested to forward a certified copy of this Council
resolution to the Ramsey County TaY Forfeited Land Office, 90 Plato Boulevard West, for final
processing;and
BE IT FINALLY RESOLVED, that the Saint Paul City Council requests the entire packet of materials
reviewed by the Council be included in the Ramsey County Board of Commissioners' meeting materials
on this subject.

Ms. Moermond stated that an application to repurchase the property was made by Bank of America
f/k/a Countrywide. The reason that was listed to repurchase the property was: "the borrower did
not pay taxes on the parcel as it was not included in origination which was omitted from policy due
to the parcel being taken by the state. The property was foreclosed upon and the Bank wished to
repurchase the pazcel to sell two pazcels as one to a new borrower."
Mr. Magner stated that this property was previously owned by Charles and Patricia Salley and was a
category 2 vacant building which file was opened on Apri14, 2Q08. According to STAMP, a code
compliance inspection had been done on July 30, 2008 by ReMax. The violations at the property are
as follows July 8, 2009, there was garbage/rubbish and tall grass and weeds; April 9, 2009, there
was garbage{rubbish, tall grass and weeds and boardinglsecuring; Mazch 31, 2009, there was tall
garbagelrubbish; and April 21, 2005, sanitation, vehicles. In order for anyone to purchase the
property for rehabilitation, they would have to provide DSI with a work plan, present contractor
bids, and provide financial documentarion indicating the ability to complete the rehab. The goal for
this azea was to have less density in the neighborhood.
Ms. Moermond reviewed the police records. On November 21, 2008, a police visit-proactive; on
May 30, 2008, there was an assist/other agency call; on November 10, 2007, there was a
disturbance-fights call; on October 6, 2007, there was a domestic assaulUstrangulation, opposite sex
call; on April 5, 2007, there was a warrant served; on March 10, 2006, there was a familyJchildren-
mentaUvulnerable adults call; on October 2, 2005, there was a domestic call; on August 5, 2005,
there was a lost/missing property; on July 31, 2005, there was a drunkenness call; on April 15,
2005, there was a landlord/neighbar/tenant call; and on January 15, 2005 there was an assist citizen
call.
After reviewing the recards, Ms. Moermond said that she would recommend denying an application
to repurchase the property.

Enclosed please find a repurchase application received from the prior owner, Bank of New York
C/O Country Wide Home Loans Seniices for a parcel that was forfeited to the State of Minnesota
on August 1, 2008.
The County Board policy adopted on December 21, 1999, No. 99-507, allows for "each
repurchase application to be referred to the municipality in which the property is located. The
municipality will document whether the property is considered a municipal problem based on
documented police, building code, illegal activity, or health violations within the past five years.
The municipality, by resolution, shall recommend that the County Board approve or deny the
repurchase application and return the repurchase application to Ramsey County along with the
resolution and documentation of any violations:'

Note: There are no code violations logged to the property
While the repurchase policy does not state a specific timeline for action by the City Council, we

ELECTRICAL
1. Ground the electrical service to the water service within 5' of the entrance point of
the water service.
2. Provide a complete circuit directory at service panel.
3. Close open knockout in junction boxes with lrnockout seals.
4. Properly strap cables and conduits in basement and remove lose cables.
5. Repiace GRCI receptacle in second floor bathroom adjacent to the sink.

Install globe typed enclosed light fixture on all closet lights.
Repair or replace all broken, missing ar loose light fixtures, switches & outlets,
covers and plates.
Check a113-wire outlets for proper polarity and verify ground.
Remove any 3-wire ungrounded outlets and replace with 2-wire or �ound 3-wire to
code.
Throughout building, install outlets and light fixtures as specified in Bulletin 80-1.
Install hard-wired, battery backup smoke detectors as specified in Rnlletin 80-1 and
other smoke detectors as required by the IRC.

Remove and/or rewire all illegal, improper or hazardous wiring in garage.

HEATING
1. Clean and Orsat furnace burner. Check all controls for proper operation. Check furnace heat
exchanger for leaks; provide documentation from a licensed contractor that the hearing unit is
safe.
2. Install cliiuuiey liner for hot water heater if one is not present.
3. Vent clothes dryer to code. (Ventilation or plumbing permit and inspection are required).
4. Provide support for gas lines to code.
5. Plug, cap and/or remove all disconnected gas lines.
6. Install approved lever handle manual building shutoff gas valve in an accessible location
ahead of the first branch tee.
7. Clean all supply and rehun ducts for warm air heating system.
8. Repair and/or replace heating registers and duct as necessary.
9. Appropriate mechanical permits are required for this work.
ZONING This house was inspected as a single family dwelling.
NOTES **See attachment for permit requirements and appeals procedure.
Most of the roof covering could not be properly inspected from grade. Recommend this be done
before rehabilitation is attempted.
There was considerable storagefclutter within properiy at the tune of the inspection, Property is
to meet appropriate Codes when complete.
Ail items noted as recommended do not haue to be completed for code compliance but should be
completed at a later date. Possible purchasers of property shall be made awaze of these items.
This is a registered vacant buiiding. In order to reoccupy the building, all deficiencies
listed on the code compliance report must be corrected and be in compliance with the
Minimum Housing Standards of the St. Paui Legislative Code (Chapter 34), and all
