PAUL LOT 20 BLK 3 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before January 8, 2009, the following are the now l�own interested or responsible parties for the 5ubject Property: Federal National Mortgage Assoc, PO Box 650043, Dallas TX 75265; Nina VasquezlCountrywide, 301 B. Vanderbilt Way, San Bernardino, CA 92408; District 6 Planning Council. WHEREAS, Deparhnent of Safety and Inspections has served in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated March 12, 2009; and WHEREAS, this order informed the then known interested or responsible parties that the structure loeated on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair ar demolish the shucture located on the Subject Property by April 13, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEItEAS, this nuisance condition has not been corrected and Department of 5afety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Councii; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, June 23, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested 09-769 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfaze and remove its blighting influence on the community by rehabilitating this shucture in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the struchue in accardance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, July 15, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 113 WINNIPEG AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. � That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed mukiple Housing or Building code violations at the Subject Praperty. 4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � � That the deficiencies causing this nuisance condition have not been corrected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacanUNuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the norification requirements of Chapter 45 have been fulfilled. ORDER The Saint Pau1 City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting a11 09-'T69 85 86 87 88 89 90 91 92 93 94 95 9b deficiencies as prescribed in the above referenced Order to Abate Nuisance Building{s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of the structure must be completed within P�fteen (1S� days after the date ofthe Council Hearing. 2. Priar to demolition of the building(s) and/or remaval of any unigue building or architectural features, the Deparhnent of Safety and Inspection shall ensure that a qualified consultant be hired to evaluate the prooerty for National ReQister or local historic desimation and if determined eligible, would continue to work to protect the site from demolition. If demolition is considered the oniy reasonable alternative, then the following level of documentation for the historic resource at 1342 York Avenue is recommended bv HPC staff: A. The buildine exterior and its immediate context shall be documented with digital photog�raphy. The images shall be at least 2400 x 1800 pixels and the images shall be submitted to HPC staff on a Qold CD. B. According to our files, it has been a vacant building since November 20, 2007. The current property owner is Federal National Mortgage Assn, per AMANDA and Ramsey Cuunty property records. The city has had to board this building to secure it from trespass. There have been two (2) SUMMARY ABATEMENT NOTICES since 2007. There have been four (4) WORK ORBERS issued for: - Boarding - Improperly stored refuse, garbage and misc debris On February 10, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. The property owner oF record, Federal National Mortgage Assn, did not appear. No other parties of interest appeazed. Mt Magner stated the building was a two-story, brick, duplex with a detached garage on a lot of 4,792 square feet and had been vacant since November 20, 2007. A code compliance inspection had been done on February 17, 2009, the vacant building registration fees were cunent, and the $5,000 perfoxmance bond had not been posted. On Februazy 10, 2004, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuasance building was posted on March 12, 2009 with a compliance date of April 13, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $20,000 and the building to be $159,200. Real estate ta�ces were current. Code Bnforcement estimates the cost to repair the building to be approximately $70,000 to $80,000. The cost for demolition was estimated to be approximately $10,000 to $12,000, There had also been two summary abatements issued to this property since 2007, four of which went to work order: to secure the building and the City had to board the building to secure it from tresgass, remove improperly stored refuse and debris, and boarding. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Ma�er presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1910 and was considered a"flats" style building. She said it originally had a flat roof; however, a gable had been added at some point in time. The exterior was painted brick as opposed to brick veneer, which added value to the building. The building had been inventoried and was a potential historic resource as it was located west of the Oakland Cemetery. She requested the property be referred to the HPC for review and a recommendation. Ms. Moermond recommended laying this matter over to the July 28 Legislative Hearing and the August 19 Council Public Hearing in order for the HPC to review and make a recommendation concerning the property. Ms. Moermond asked Ms. Vang whether the new O& E indicated any updated ownership information. Ms. Vang responded that the ownership information had not changed. Ms. Boulwaze stated that the HPC reviewed this property at the July 23 meeting and did not agree wath staff's recommendation which was to hire a qualified historian to evaluate the National Register and local eligibility. The HPC instead recommended that the property be photographed and the history be recorded. They did not recommend an evaluation of the property far either National Register or local desigxation eligibility. They did, however, recommend a context study of the neighborhood be conducted. Ms. Moermond recommended the building be removed or repaired within 15 days and that the resolution be amended to include documenting the property for historic archival purposes priar to demolition. SITE DESCRIPTION: The two-story, brick duplex at 113-115 Winnipeg Avenue was constructed in 1910. The building permit index card lists J.E. Sundberg as the contractor and the inventory form lists 106 Manito Co. as the azchitecUengineer. Significant details of the property include the elaborate brick cornice with corbelled bands and brick dentil course along with concrete or stone sills and lintels. There was a door on the second story which has been covered up since the inventory from was completed in 1982. The 1903 Sanborn Map shows there was an open, two-story porch at the front of the property at one time. The brick has been painted and the front elevation has been stuccoed. A shallow-pitched front gabled roof now spans the length of tl�e once flat-roof building. There is a shallow two-story bay on the east elevation that has temporary anchoring to contain buckling just underneath the eaues (probably due to the instailation of the gabled roof and water infiltration). B. PROPOSED CHANGES: During the Legislative Hearing on June 23, the Legislative hearing officer recommended the HPC consider this properiy for review as a historic resource. A historic resource is defined as "A property that is believed to have historical, cultural, architectural, archaeological or engineering significance and to meet at least one ofthe criteria for designation as a heritage preservation site or district as provided in this chapter." C. GUIDELINE CITATIONS: 5ec. 73.05. Designation of heritage preservation sites. (a) Criteria. In considering the designation of any area, place, building, structure or similar object in the City of Saint Paul as a heritage preservation site; the commission shall apply the following criteria with respect to such designation: (1) Its character, intarest ar value as part of the development, heritage or cultural characteristics of the Ciry of Saint Paul, State of Minnesota, or the United States. (2) Its location as a site of a significant historic event. (3) Its identification with a person or persQns who significantly contributed to the culture and development of the City of Saint Paul. (4) Its embodiment of distinguishing characteristics of an architeattual or engineering type or specimen. (5) Its identification as the work of an architect, engineer, or master builder whose individual work has influenced the development of the City of Saint Paul. (6} Its embodiment of elements of architectural or engineering design, detail, materials or craftsmanship which represent a significant architectural or engineering innovation. (7) Its unique location or singulaz physical chazacteristic representing an established and familiar visual feature of a neighborhood, community or the City of Saint Paul. 1 Agenda Item VIT.B. RA-SPC-5120 D. FINDING5 ������ 1. The properiy was surveyed and identified during the 1983 Historic Sites Survey of Ramsey County (RA-SPG5120). T'he survey identified 37 sites in District 6 as eligible for designation or as sites of major significance. Properties like 113 Winnipeg Avenue are integral to the historic context of the neighborhoods. No images were found in a search of the MN Visual Resource database. 2. A more intensive level survey would be required to determine if the building would be individually eligible for local designation or be eligible £or the National Register. 3. It is always better to retain historic fabrlc type buildings than it is to demolish and create a hole in the neighborhood. This particulaz block face has a variety of housing styles; most constructed prior 1883 when building permit records began in the city and up until 1917. This duplex is a unique structure for this block and neighborhood, as the other residences have gabled or hipped roofs. 4. The integrity, or authenticaty as evidenced by a site's location, design, setting, workmanship or association, is fair because the alterations that haue occurred, such as stucco on the front elevation, deferred maintenance and the construction of a gabled roof over the flat roof. There are still design features intact on this properiy like the cornice and the Flemish Bond brick pattern evident under the paint. The site's location and setting would be considered to have good integrity. � • � � � � . � . • . . ' F. HPC RECOMMENDATION: The propertv shall be documented photo�raphically and the history of the propertv shall be recorded.
