RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and directed to prepare plans and specifications for said improvement, and submit same to the Council for approval; that upon said approval, the proper city officials are hereby authorized and directed to pro- ceed with the making of said improvement in accordance therewith. Pursuant to the ab©ire which we understand was approved by City Council in session Sept, 18th having been held over froa Aug. 27, 1957. We the undersigned ware certainly surprised and keenly dis- appointed at such action for the followirng, reasons. First - We were informed that for legal consideration a petition of this nature must Barry the signature of at least three (3) interested property holders, As the file will show, one of these signatures was that of Victor J. Lametti, who disposed of his abutting property by sale and warrantyrdeed in October of 1955 and maintains no eurreat interest, leaving only two (2) bona-fide petitioners which should have estoped the petition at its inception. Secondly A petition of remonstrance was filed by at least ten property owners concerned, with one more protecting at hearing on Aug, 27th, which certainly constituted an un- questionable :Tnjority against the project and it Was out hope and belief that the same courtesy and consideration would be dztended to such majority as was done at a recent hearing for a sidewalk installation on Fairview Ave, from Highland Parkway to Edgeauabe Road (which incidentally is a much heavier traveled thoroughfare, both pedestrian and vehicle is in closer proximity to parochial and public schools) , As to convenience and necessity from observation over a per- iod of years there was no time when the boulevard or ad- joining yards were impassable and presented any difficulty which would be ameliorated by a sidewalk. The only regular pedestrians are the mail-carriers and the newspaper boy who use and no doubt would continue to use the lawns believing that a straight line is the shortest distance between any two points or houses, There are also we believe two or three children of school age in this block, however, in this general classification sidewalks are generally disregarded if there is footage on either side thereof, 2 In the immediate a a the following, Fairview.
