WHEREAS, Departmen of Safety and Inspections has requested the City Council to
ho ublic hearings to consider the advisabilaty and necessity of ordering the repair or wrecking
and r oval of a two story, wood frame dwelling and its wood frame shed located on property
hereina r referred to as the "Subject Properiy" and commonly known as 801 LIVINGSTON
AVENU . This property is legally described as follows, to wit:

WHEREAS, this nuisance condition has not been c rrected and Department of Safety
and Inspections requested that the City Clerk schedule publi hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City C cil; and
WHEREAS, the interested and responsible parties have be served notice in accardance
with the provisions of Chapter 45 of the Saint Paul Legislative Cod of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Of er of the Saint Paul
City Council on Tuesday, June 23, 2009 to hear testimony and evidence, an after receiving
testimony and evidence, made the recommendation to approve the request to o er the interested

BE IT RE OLVED, that based upon the testimony and evidence presented at the above
referenced public h rings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the bject Property at 801 LIVINGSTON AVENUE.

That the Su � ct Property comprises a nuisance condition as defined in Saint Paul
Legislative Co , Chapter 45.
That the costs of de olition and removal of this building(s) is estimated to exceed
five thousand dollars 5,000.00).
That there now exists and s existed multiple Housing or Building code
violations at the Subject Pro rty.
That an Order to Abate Nuisanc uilding(s) was sent to the then laiown
responsible parties to correct the ficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisa�,ce condition have not been corrected.
6. That Department of Safety and Inspections as posted a placard on the Subject
Property which declares it to be a nuisance c dition subject to demolition.
7. That this building has been routinely monitored Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as p viously stated in this
resolution and that the notification requirements of Cha ter 45 have been fulfilled.

blighting influence on the community by rehabilitating ttus structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
ccordance with all applicable codes and ordinances, or in the alternative by demolishing
d removing the structure in accordance with all applicable codes and ordinances. The
re bilitation or demolition and removal of tl�e structure must be completed within
fifte n(15) days after the date of the Council Hearing.
If the a ove corrective acrion is not completed within this period of time Deparfinent of
Safety Inspections is hereby authorized to take whatever steps are necessary to
demolish d remove this structure, fill the site and charge the costs incurred against the
Subject Pro rty pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the b' ding is to be demolished and removed by the City of Saint Paul, all
personal property o ixtures of any kind which interfere with the demolition and removal
shall be removed fro he property by the responsible parties by the end of this time
period. If all personal p erty is not removed, it shall be considered to be abandoned
and the City of Saint Paul all remove and dispose of such property as provided by law.
4. It is further ordered, that a cop of this resolution be mailed to the owners and interested
parties in accordance with Chapt 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Deparm�ent of Safety and Inspections has
issued an order to the then Irnown responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was ro-inspected on Apri117, 2009. There was no compliance and the nuisance
condition remains unabated, the community continues to snffer the blighting influence of this
property. It is the recammendation of the Deparhnent of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurced against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two story, wood frame, single-fanuly dwelling with a wood frame shed on a lot
of 8,276 square feet.
According to our files, it has been a vacant building since November 16, 2007.
The current property owner is Deutsche Bank Nat Trust Co TruJCo Litton Loan Servicing Lp,
per tIMANDA and Ramsey County property records.
The city has had to board this building to secure it from trespass.
There has been one (1) Si.)MMARY ABATEMENT NOTICE since 2007.
There has been one (1) WORK ORDER(S) issued.
On February 11, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on March 16, 2009 with a compliance date of
April 15, 2009. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fee went to assessment on 12-19-08. (Renewal Irrsenr 12-8-08)

On February 11, 2009, a Building Deficaency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this rime.
As Frst remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame dwelling and its wood frame shed.
1. There is rot and rodent damaged; open eaves; missing fascia.
2. There is chipped/peeling paint; exposed wood surfaces.
3. The front porch has rotted supports and other members.
4. There are unsecured balusters on exterior steps to the 2 floor.

7. The masonry for the front porch needs tuck pointing.

24. Instail floor covering in the bathroom and kitchen that is impervious to water.
25. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
26. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
27. Provide complete storms and screens, in good repair, for all door and window openings.
28. Where wall and ceiling covering is removed install full-thiclrness or code-specified
insulation.
29. Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See St. Paul Legislative Code, Chap. 34 for
additional information).
30. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly, door
and window openings that are not headered, etc.) are to be reconstructed as per code.
31. Habitable rooms with new usage and replaced windows sha11 have glass azea equal to
8% of floor area, or a minimuxn of 8 sq. ft., one-half of which shall operate; and all
bedroom windows sha11 meet emergency egress requirements (20" minunum width, 24"
minimum height, but not less than 5.7 sq. ft. overall openable azea; minimum 5.0 sq. ft.
openable area if sill height is within 44 inches of grade).
32. Provide smoke detectors per the Minnesota Building Code and carbon monoxide
detectors per State law.
33. Repair siding, soffit, fascia, trim, etc. as necessary.
34. Provide weather-sealed, air-sealed, and vermin-sealed exterior.
35. Provide proper drainage around house to direct water away from foundation.
36. Maintain 6 inches minimum cleazance between wood and soil, sloped to drain away
from foundation.
37. Install downspouts and a complete gutter system.

Provide a complete circuit directory at service panel indicating location and use of all
circuits.
Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen
appliance circuit.
Verify that fuse/circuit breaker amperage matches wire size.
Provide one (1) light for each 200 square feet in unfinished basement. One light must be
switched from the top of the stairs.
Remove all cord wiring.
Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers
and plates.
Check all outlets for proper polarity and verify ground on 3-prong outlets.
Remove any 3-wire ungrounded outlets and replace with 2-wire or gound 3-wire to
code.
Throughout building, install outlets and light fixtures as specified in Bulletin 80-1.
Install hazd-wired, battery backup smoke detector as specified in Bulletin 80-1 and other
smoke detectors as required by the IRC. Also, Install carbon monoxide detector(s)
within 10 feet of all bedrooms.
Remove and/or rewire all illegal, improper or hazardous wiring in basement/ garage.
Duplex: Check Building write-up for fire resistance requirements if both panels aze in
the common area in a basement or move 2 °d unit electrical panel board to the second
unit.
All added receptacles must be grounded, tamper-resistant and be on an Arc-Fault
Circuit Interrupter protected circuit.
All electrical work must be done by a Minnesota- licensed electrical contractor under an
electrical permit.
Any open walls or walls that are opened as part of this project must be wired to the
standards of the 2008 NEC.
All buildings on the property must meet the St. Paul Property Maintenance Code
(Bulletin 80-1)
There is no power in the dwelling.

the repairs required by this order and compliance with preservation guidelines. Copies of the

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or

Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, single-family dwelling with a wood frame shed on a lot of 8,276 squaze feet and
had been vacant since November 16, 2007. A code compliance inspection had been done on
January 7, 2009, the vacant building registration fees in the amount of $1,000 went to assessment on
December 19, 2008, and the $5,000 performance bond had not been posted. On February 11, 2009,
an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on March 16, 2009
with a compliance date of April 15, 2009. To date, the property remained in a condirion which
comprised a nuisance as defined by the Legislative Code. Ramsey County Tascation estimated the
market value ofthe land to be approximately $53,600 and the building to be $123,600. Real estate
taYes were current. Code Enforcement esrimates the cost to repair the building to be approximately
$60,000 to $70,000. The cost for demolition was esrimated to be approximately $9,000 to $10,000.
There had also been one suuunary abatement order issued to this property since 2007, one of which
went to work order: to secure the building and the City had to board the building to secure it from
trespass. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1890 and was a Queen Anne style building. She said the building had been inventoried and she
needed to request the inventory form from Ramsey County. The building was located on a corner
lot, it had a corner tower with a`�vitches hat," had original barge board exterior siding, and the
doors and windows also had original detailing. She noted that the porch had been altered; however,
she believed the property was an historic resource and requested it be forwarded to the FIPC for
review and recommendation. Ms. Moermond asked whether this was a duplex given the exterior
staircase. Mr. Magner noted that the property was zoned R4 and Ramsey County had it listed as a
single-family dwelling.
Mr. Krco stated that the building was a very lazge structure, he had been through it recently, and it
was difficult to tell whether it had been a duplex at one time as everything had been stripped out of
the house. He said he had been in contact with Historic St. Paul and NeDA who both expressed
interest in the property.
Ms. Macko stated that she had obtained two bids to rehab the building, one for $97,000 and the
other for $112,000. She said she had also obtained rivo bids to demo the building, one for $15,000
and the other for $21,000. She said if she were going to market the property for sale, she would list
it starting at $74,900.
Ms. Moermond recommended forwarding this property to the HPC for recommendation. She also
recommended continuing to the August 11 Legislative Hearing and September 2 Council Public
Hearing.

Trust c/o Litton Loan Servicing LP. Laurie Macko, realtar with Keller Williams, also appeared.
Mr. Krco said that he had sent an e-mail outluung what had occurred since the last hearing. He said
he had not heard from the HRA whether they had completed their review of the property to
determine whether to accept it as a donation. NeDa and Historic St. Paul had looked at the property
and expressed interest; however, they indicated that they do not have the financial capacity to
rehabilitate the building. At this point, his client wished to cut their losses and proceed with
demolirion of the building.
Ms. Macko stated that she was in the process of obtaining updated demolition bids as well as bids to
abate any asbestos in the building.
Ms. Spong stated that the only feasible way the building could be saved for rehabilitation would be
if the HRA were to acquire it and for one of the non-profits to do the rehabilitation.
Ms. Moermond stated that she would recommend the building be removed ar repaired in 30 days.
This would allow time for the bank to obtain demolition bids and proceed with doing the demolition
themseives.

occurred since the last hearing. He said the HPC met to review the mater on July 9; however, there
wasn't a quonun so the matter was continued to July 23. At the meeting on July 23, the HPC
recommended that demolition be delayed as they believed the property was a historical and
azchitectural resource to the neighbarhood and that state and national historic designation should be
explored to preserve the property. NeDa and Historic St. Paul had looked at the property and
expressed interest; however, they indicated that they do not have the financial capacity to
rehabilitate the building. He had also met with Councilmember Dave Thune and A1 Carlson, PED,
to discuss the potential donation of the property to the HRA.
Ms. Spong stated that at the HPC meeting on July 23, the Commission voted 8 in favor to adopt
staff's recommendation that demolition be delayed in order far alternatives to be explored such as
mothballing or rehabilitation. They agreed that the property needed further study and that a
qualified historian be hired to evaluate possibly local eligibility but that it likely did not meet
national register eligibility.
Mr. Magner asked whether title work had been completed to determine whether there were any
outstanding creditors having a claim against the property. Mr. Krco stated that he was unsure as to
whether any title work had been done since the foreclosure process had been completed. He said
his client was interested in donating the property since it could not be sold and he did not believe
they were interested in doing the rehabilitation themselves. His clienYs main concern was to
mitigate any further losses due to the foreclosure and would prefer not to have a tax assessment for
demolition of the building.
Ms. Moermond suggested possibly arranging for the property to have a walk through by A1 Carlson,
Ms. Spong, representatives of NeDA and Historic St. Paul as potential recipients of the property, in
order for the HRA to determine whether to go through with the acquisition of the property. Mr.
Krco said he could provide the realtor's contact information so that anyone could go directly
through her to gain access to the interior of the building.
Ms. Moermond continued the Legislative Hearing to September 8 and the Council Public Hearing
to October 21.

A. S1TE DESCRIPTION: The house at 80] Livingston Avenue was constructed in 1890. The
building permit index card and 1903 Sanborn Map show the address as 793 and 795 Livingston as
well. This Queen Anne style house is two-and-one-half stories with and intersecting hip and gable
roof. The inventory form describes the building as having "complex massing with polygonal tower
above a two story bay window with stained glass transom windows on the southwest corner of the
house. Decorauve brackets visible at enclosed front porch. Projecting gable end over bay window
on north fapade. Additional stained glass and original sash. The front porch has been enlazged.
Some windows have been replaced. Additions have been added and the clapboazd has been covered
by asphalt shingle siding. This house is prominently sited on the southeast comer of Livingston and
Belvedere Avenues.
B. PROPOSED CHANGES: During the Legislative Hearing on June 23, the Legislative hearing
officer recommended the HPC consider this property for review as a historic resource. A historic
resource is defined as"A properry that is believed to have historical, cultural, architectural,
archaeological or engineering significance and to meet at least one of the criteria for designation as a
heritage preservation site or district as provided in this chapter."
C. GUIDELINE CITATIONS:
Sec. 73.05. Designatiun uf heritage preservation sites.
(a) Criteria. In considering the designation of any area, place, building, structure or similar object
in the City of Saint Paul as a heritage preservation site; the commission shall apply the following
criteria with respect to such designation:
(1) Its chazacter, interest or value as part of the development, heritage or cultural characteristics
of the City of Saint Paul, State of Minnesota, or the United States.
(2) Its locarion as a site of a significant historic event.
(3) Its identification with a person or persons who significantly contributed to the culture and
deveIopment of the City of Saint Paul.
(4) Its embod'ament of distinguishing characterisdcs of an architectural or engineering type or
specimen.
(5) Its identification as the woxk of an architect, engineer, or master builder whose individual
work has influenced the development of the City of Saint Paul.
{6) Its embodiment of elements of architectural or engineering design, detail, materials or
craftsmanship which represent a significant architectural or engineering innovation.
(7) Its unique location or singular physical characteristic representing an established and familiar
visual feature of a neighborhood, community or the City of Saint Paul.

D. FINDINGS
1. The property was surveyed and identified during the 1983 Historic 5ites Survey of Ramsey
County (RA-SPC-4334). The survey iden6fied 59 sites in District 3 as eligible fox designation or
as sites of major significance. Properties like 801 Livingston are integral to the historic context
of the neighborhoods. No images were found in a search of the MN Visual Resource database.
2. A more intensive level survey would be required to determine if the building would be
individually eligible for local designation or be eligible for the National Register.
3. It is always better to retain historic fabric type buildings than it is to demolish and create a hole in
the neighboxhood. This particular block face has a variety of housing styles and setbacks. There
is contemporary infill housing constructed on the lot just south of the residence. The house is a
mostly intact example of 1890s frame Queen Anne residential construction on the Westside.
4. The integrity, or authen6city as evidenced by a site's location, design, setting, workmanship or
association, is good because the alterations that have occurred, such as asphalt shingle siding
over clapboard, some non-original windows, storm windows and doozs aze easily reversible. The
non-historic additions could be removed or altered to have a lesser impact on the properry, There
are still design features intact on this property like the bazgeboazds in the gables and some
stained glass. The site's location and setting would be considered to have fair integrity.
E. STAFF RECOMMENDATION: Based on the findings, staff recommends that a qualified
historian be hired to evaluate both National Register and local eligihility. Staff xecommends that
demolition be delayed for this site in order for alternatives to demolition to be explored, such as
mothballing or rehabilitation.
