1 WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two story, wood frame four-plex located on property hereinafter referred to as
4 the "Subject Property" and commonly lrnown as 514 AOYT AVENUE EAST. This property is
5 legally described as follows, to wit:

10 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
11 information obtained by Department of Safety and Inspections on or before December 1, 2008,
12 the following are the now known interested or responsible parties for the Subject Property: 514
13 Hoyt Avenue East LLC, 3363 Oasis Ave N, Stillwater, MN 55082; Interbank c/o Cenlar, 425

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an arder identified as an "Order to
Abate Nuisance Building(s)" dated March 16, 2009; and
WHEREAS, this arder informed the then known interested or responsible parties that the
structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by April 15, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accardance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WIIEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, June 23, 2009 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

41 or responsible parties to make the Subject Property safe and not detrimental to the public peace,
42 health, safety and welfaze and remove its blighting influence on the community by rehabilitating
43 this structure in accordance with all applicable codes and ordinances, or in the alternative by
44 demolishing and removing the structure in accordance with all applicable codes and ordinances.
45 The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
46 the date of the Council Hearing; and

48 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, July
49 15, 2009 and the testimony and evidence including the action taken by the Legislarive Hearing
50 Officer was considered by the Council; now therefore

52 BE IT RESOLVED, that based upon the testimony and evidence presented at the above
53 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
54 Order concerning the Subject Property at 514 HOYT AVENUE EAST.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Deparhnent of Safety and Inspections has posted a placazd on the Subject
Property which declazes it to be a nuisance condition subj ect to demolition.
7. That this building has been routinely monitored by Deparhnent of Safety and
Inspections, VacanflNuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

biighring influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the shucture in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
f'dteen (15) days after the date of the Council Hearing.
2. If the above corrective acrion is not completed within trris period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislarive Code.

The Depariment of Safety and Inspections has declazed this building(s) to consritute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parhies to eliminate tius nuisance condition by
conecting the deficiencies or by razing and removing this building(s).
'I'he property was re-inspected on April 15, 2009. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repaiz, or demolish and
remove tius building in a tunely manner, and failing that, anthorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taaces.

The building is a two story, wood frame, four-plex on a lot of 7,841 square feet.
According to our files, it has been a vacant building since July 6, 2006.
The current property owner is 514 Hoyt Avenue East LLC, per AMAIVDA and Ramsey County
property records.
The city has had to boazd this building to secure it from trespass.
There have been five (5) SUMMARY ABATEMENT NOTICES since 2006.
There has been five (5) WORK ORDER(S) issued:
- Boarding
- Removal of tall grass and weeds
- Removal of improperly stored refuse, garbage and misc debris
On February 10, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on March 16, 2009 with a compliance date of
April 15, 2009. As of this date this property remains in a condirion which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
TaYation has placed an estimated market value of $60,000 on the land and $14Q000 on the
building.
As of November 3, 2006, a Code Compliance Inspection has been completed.
As of June 19, 2009, the $5,000.00 performance bond has not been posted.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On February 10, 2009, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial acfion, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame four-plex.
1. The exterior walls and/or trim of the house and/or gazage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
2. The window and/or door sereens aze missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
The windows and/or storm windows aze in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardwaze and associated trim in a professional manner. Pemut may be
required.
4. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
5. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
The exterior walls of the house and/or garage aze defective. Repair ail holes,
breaks, loose or rotting siding, to a professional state of maintenance.
DEFICIENCY LIST
1. BASEMENT - SPLC 34.11 (4), 34.34 (1) - Repair the clogged sewer drain.
Previous complaint of sewer being backed up in basement.
Clean and sanitize flooring from backed up sewer.
2. ELECTRICAL - EXTERIOR - SPLC 34.12 (2), 34.35 (1) - Repair and maintain all
required and supplied equipment in an operative and safe condition.
Replace the painted fixture cover.
3. ELECTRICAL - EXTERIOR - SPLC 34.14 (2) f- Provide and maintain an minimum of
1 foot candle at the grade level of exterior exits and entryways far security. This wark may

outlets, switches and junction boxes where missing.

Replace the GFCI located in the restroom in Unit one (doesn't trip).
9. ELECTRICAL - GENERAL - NEC 210-7 (d) - Provide for electrical replacement
receptacles to be grounded.
Open grounds in receptacles in Unit 2(GFCI by sink), Unit three (through out).
Check a11 receptacles through out building.
10. ELECTRICAL - GENERAL - NEC 230-13 - Provide for the electrical service to be
adequately sized to meet the needs of the occupancy type.
11. ELECTRICAL - GENERAL - NEC 410-8 (b) (1) Provide for the incandescent fixtures
in closets to have a completely enclosed lamp.
12. ELECTRICAL - GENERAL - NEC 240-24 (a) (b) - Provide for each occupant to have
ready access to all over current devices far that occupancy.
13. ENTIRE BUILDING - SPLC 34.23, MSFC 110.1 - This occupancy is condemned as
unfit for human habitarion. This occupancy must not be used until re-inspected and approved
by this office.

All exterior unprotected surfaces must be painted or protected from the elements and maintained
in a professional manner free from chipped ar peeling paint.
Remove and replace all deteriorating wood trim/sashes/frames on doors/windows.
18. EXTERIOR - SPLC 34.09 (1) e, 3432 (1) d- Provide and maintained the roof weather
right and free from defects.
Downspouts to be fun to divert water away from building.
19. EXTERIOR - MSFC 603.9- Call Xcel Energy at 1-800-895-4999 to provide vehicle
impact protection for the gas meter.
20. EXTERIOR - SPLC 34.09 (3), 34.32 (3) - Repair and maintain the window in good
condition.
Replace a11 broken windows throughout building.
Remove all deteriorating putty (Glazing) around window glass and re-glaze.
21. INTERIOR - SPLC 39.02(c) - Complete and sign the provided smoke detector affidavit
and retum it to this office.

and demolition costs will be assessed against the property taxes as a special assessment in

disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, norify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolirion and removal by the City. This placard shall
not be removed without the written authority of the Deparnnent of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the fime specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution staring

If the resolution calls £or abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legisiative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including admis�istrative costs will be assessed against the property as a special
assessment in accordance with law.

4. Ordering the owner to remove or repair the building(s} at 514 Hoyt Avenue East within
fifteen (15) days from adoption of resolution.
Andrew Hybben stated that he was the owner of 514 Hoyt Avenue East LLC. Marilyn Fisher and
Cheryl Endres, 522 Hoyt Avenue East, also appeared.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, four-plex on a lot of 7,841 square feet and had been vacant since July 6, 2006.
A code compliance inspection had been done on November 3, 2006, the vacant building registration
fees were current, and the $5,000 performance bond had not been posted. On February 10, 2009, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on March 16, 2009 with a
compliance date of April 15, 2009. To date, the property remained in a condition which comprised
a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market
value ofthe land to be approximately $60,000 and the building to be $140,000. Real estate taxes
were current. Code Enforcement estimates the cost to repair the building to be approximately
$80,000 to $120,000. The cost for demolition was estimated to be approximately $14,000 to
$20,000. There had also been five suminary abatements issued to this property since 2006, five of
which went to wark order: to secure the building and the City had to board the building to secure it
from trespass, remove improperly stored refuse and debris, boarding, and cut tall grass and weeds.
Code EnforcemenY recommends the building be repaired or removed within 15 days. Mr. Magner
stated that the code compliance inspection had expired and a new inspection would need to be
completed He also noted that there was a building permit pulled in November 2008 valued at
$2,000 which had not been finaled. He presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an
early 1878 pioneer-era cottage. She noted that there were several additions and the exterior had
been severely altered. The building was surrounded by apartment buildings and houses built in later
years; thus, there was little context or continuity on the block. She believed demolition would not
have an adverse effect on the neighborhood.
Ms. Moermond asked Mr. Hybben what his plans were for the building. Mr. Hybben responded
that it was his intention to have the rehabilitation completed within 90 days. He said he had been
helping his daughter rehab a house which she bought in Shareview. Since that was now done, he
could concentrate his efforts on completing the rehab of this building. He said he was unaware of
the orders until he received the notice of the hearings in Apri12009.
Ms. Moermond asked Mr. Magner who the OTA was addressed ta Mr. Magner responded that it
was sent to 514 Hoyt Avenue East LLC at 3363 Oasis Avenue North in Stillwater. There was no
returned mail. Mr. Hybben confirmed that this was his mailing address. He said he had purchased
the property from Interbank, which was a foreclosed property, in August 2008. He said that
although he was not a general contractor, he had the laiowledge to do the rehab and had done many
others in St. Paul.
Ms. Moermond asked when the property became a category 3. Mr. Magner responded that it was a
category 2 until the OTA was issued in March 2009. He noted that the area was zoned RTl which
the existing use of the building would not be allowed. He said the building would need to be de-
converted to a duplex or the matter would need to be appealed to the BZA. Mr. Magner also

explained the state law concerning the ability to pull pemuts without a state contractor's license in
that only one building permit could be pulled in a 24-month time period unless it was for a person's
own residence. He told Mr. Hybben that he would need to hire a licensed general contractor as well
as licensed trade contractors to do the rehab of the building.
Ms. Moermond invited Ms. Fischer and Ms. Endres to testify. Ms. Fischer stated that her family
had owned their house since 1934 when the house was moved onto the lot. She said there had been
constant problems at 514 since 2005 with the deterioration of the property including the following:
noisy residents; number of vehicles; blasring music from vehicles; irregular gazbage service; trash
strewn about and into their yard; rats and mice; and overalllack of yard maintenance causing her to
mow the lawn. Ms. Endres stated that the trash area for the containers was three feet from their
property and there was constant trash strewn throughout both yazds. She said she was a property
manager, had been inside the building, and believed it had severe deficiencies. She was aware that
there was a broken sewer line in the basement which was likely where the rats were coming from.
She said that they had considered purchasing the empty lot once the City had demolished the
building and were unaware that anyone owned it. She requested the building be demolished.
Ms. Spong noted that almost the entire front yard was an asphalt parking lot which she considered
to be unusual and a blighting influence to the neighbarhood. She asked whether there was a garage
or alley access. Mr. Hybben responded that there was not. Ms. Moermond stated that she would
require him to remove half of the western portion of the asphalt in the front yard leaving two spaces
for parking and re-sod the remainder of the yard.
Mr. Magner asked whether this was going to be a rental property. Mr. Hybben responded that it
was, that he managed several properties throughout St. Paul, and did not haue any problems with
tenants as he went through a thorough screening process. He said that he had also attended crime
free multi-housing training. Mr. Magner stated that given the past history of this property, one of
the conditions must be that a management plan be provided on how the property was going to be
managed.
Ms. Moermond stated that the following conditions must be met by July 7: 1) provide closing
documents; 2) obtain a new code compliance inspection for a duplex; 3) post the $5,000
performance bond; 4) de-convert the building to a duplex; 5) provide a list of all other properties
owned in St. Paul; 6) provide a work plan; 7) obtain contractor bids, including general contractor
bid; 8) provide financial documentation; 9) the property must be maintained; 10) remove the asphalt
in the front yard (must have plans to be done by end of August 2009); and 11) provide a
management plan on how the property is going to be managed.
