This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES cR DAIN: Section 1. That Ordinance No. 5840, approved July 7, 1922, as amended, be and the same is hereby further amended so as to rezone the following described property from "B" Residence District to Commercial District : Lots 1 to 12 inclusive, and Lots 19 to 30 inclusive, except the portion of Lots 1 and 30 taken for the widening of Milton Street, Block 12, Winter's Addition to St. Paul, in the block bounded by Chatsworth Street, Milton Street, Seminary Avenue and Hubbard Avenue. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. J Section 3. Warehouse Corporation to rezone from "B" Residence to Commercial twenty-rfour out of thirty lots in the block bounded by Chatsworth St., Milton St., Semin I Ave. and Hubbard Ave. This is described as lots 1-12 inclusive and lots 19-30 incive except the portion of lots 1 and 30 taken for the widening of Milton Street; bl 12, Winter Addition. The property is presently vacant and is formerly the site o dump. The property extends a distance of 145.6 ft. along Hubbard Ave. and Seminary A and 268.5 ft. on the W. side of Milton St. The adjacent land use is as follo Klein's super market and a Conoco filling station are to the south, vacant industriy zoned property is to the east and north, and single family residences are to twest across Chatsworth. The site of the proposed "Northern Route" to be constructender the 1953 Bond Issue program will cut a diagonal path through the area to be rezon These relationships are illustrated on the map accompaning this report. Arrangeis have been made through Mr. Seamer's office for the acquisition of that portion of the property to be used for highway purposes. Mr. Seamer has negotiated an agreement whereby the City will not be required to pay more for this land in the event it is r oned for Commercial classification than it would if it remained in its present "B" sidence classification. A separate report dated August 13, 1957 has been filed with the Council on this matter in connection with the vacation of Hubbard Ave. abutting a plicant's property on the north. The applicant is proposing to const uct a twenty lane bowling alley which includes adequate off—street parking as a part of a neighborhood shopping center in accordance with attached plan received June 21 1957. The applicant is the owner of all the lots in the block bounded by Chatsworth, Hubbard, Seminary, and Milton. However, they are leaving in "B" Residence the wester y 119.1 ft. cf this block which will provide a buffer between the residences acros Chatsworth and the bowling alley. In view of the commercial and indu rial character of the area to the north, east and s. south, the Zoning Board feels the u e contemplated is appropriate and finds that the applicant's plans are in accordance with the existing standards as far as parking, traffic and the relationship to adjacent land uses are concerned.
