The grant is with the Department of Justice. The grant totals $325,000 and would pay for the 2009 program for Internet Crimes Against Children. This is an annual program that includes contracts with several other law enforcement agencies. SPPD serves as the fiscal agent and manages the grant. Because this will amend the Police budget, this will require a public hearing. It will be on the Council's agenda July 3` as the first and third meetings each month are the opporiunities for budget amendments. This proposal seems reasonable, I recommend signing. Kellog Boulevard Saint Paul, MN 55702 Deaz Chief Harrington: Conga[ulations on your recent award. In es[ablishing financial assisTance programs, Congress hnked the receipt of Fedecal funding to compliance vrit6 Federal civil nghts laws. The Office for Civil Rights (OCR), Office of Jusflce Progcams (OJP), U.S. Deparhnent of Justice is responsible for ensuring that recipients of financial aid fiom OJP, its component offices and bureaus, the Office on Violence Agamst Women (OVI, and the Office of Community Ortented Policmg Sernces (COPS) compiy with applirable Federnl civil rights siatutes and cegulalions. We a[ OCR are available to help you and your organimuon meet the civil rights requrements that come with Justice Department funding. Ensuring Access to Fedetally Assisted Progams As you kow, Federal laws prohibit recipients of financial assisTance from discriminadng on the basis of rnce, color, national origin, religion, sex, or disability in funded programs or activides, no[ onty in respect to employment practices but also in the delivery of services or benefiis. Fedeial law also prohibiis funded programs or activities from discriminaring on the basis of age in the delivery of services or benefiis. Providing Servires to Limited English Roficiency (LEP) Individuals In accordance with Departrnent of JusUCe Guidance pertaining to Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d, recipients of Federnl financial assistance must take reasonabte steps to provide meaningful access W their progrnms and activities for persons with limited English proficiency (LEP). For more informauon on the civil righ[s responsibilitles that recipents have in providing language services to LEP individuals, please see the website at http://www.lep.gov. Ensuring Equal Treatmeot for Faith-Based Organizations The Depamnent of Susvice has published a regulation specifically pertaming to the fundiag of faith-based organizations. In general, the regulafioq Participa4on in JusUCe Department Programs by Religious Organizations; Providig for Fqual Treatrnent of all Justice Departrnent Program Pazhcipants, and lmown as the Equal Treatment Regula6on 28 C.F.R. paz[ 3$ requires State Administering Agencies to heat these organizarions the same as any other applicant or recipient. The regulanon pwhibits State Administering Agencies from making award or gant admmistration decisions on [he bass of an organization's religious character ot atliliaUOn, religious name, or the relie ous composidon of iu boazd of directors. The regulario also prohibits faith-based orgamzations &om using Snancial assistance finm the DepaRment of Jushce [o fund inherently relious activities. While faith-based orgaoiations can engage in non-funded inherently religious activides, they must be held separately &om the Departmen[ of Iustice funded program, and cusmmers or beneFciaries cannot be compelled to particpate in them. The Equal Trealment Regulalion also makes cteaz that organizations pancipating in programs funded by the Department oFlusUCe aze not permitted to discriminate in the provson of services on the basis of a beneficiary's religion. For more infoxma4on on the regulafion, please see OCR's website at http://www.ojp.usdoj.gov/ocdetfbo.htrn. State Administering Agencies and faith-based organizarions should also note that the Safe Sheets Act, as amended; the Victims of Crime Act, u amended; and the Juveniie Jusrice and Delinquency Prevention Act, as amended, contain prohibitions against discrimmatlon on the basis of religion in employment Despite these nondiscrimination pwvisions, the Juslice Deparhnent Uas concluded that the Reiigious Freedom Resuration Aa (RFRA) is reasonably consirued, on a case-bycase basis, to iequire that its funding agencies pemit faith-based organizarions applying for funding under Ihe applicable progracn statutes both to receive DOJ funds and to continue cousidering relgion when hiring staff, even if the staNte Ihat authorizes the funding program generally forbids considenng of religon in employment decsions by grantees. Questions about the regulation or the application of RFRA to the stahUes ihat prohibit discrimination in employment may be directed to tktis Office. 09-754 Enfarcing Civtl Righ Laws All recipirnts of Fedetal financal assstance, regazdless of Ihe particulaz fvnding source, the amount of the grant awazd, or the number of employees in che woxidorce, aze subjeCt to tfe prohibitions against unlawfiil discrimination.
