WHEREAS, the Ciry of Saint Paul, Police DepaRment hu been awarded the 20091ntemet Crimes Against Childrrn £rom the Department of Justice, Office of
Juvrnile lustice and Delinquency Preven[ion with the use of the Recovery Act Funds;
WHEREAS, Ihis grnnt provides funds to support and enhance the Minnesota Intemet Cnmes Against Children Task Force Activines, mcludmg identification,
apprehension and prosecution of child sezual predators;
WHERAS, ihis grant provides the Samt Paul Police Department the retwtion of the curzent task force commander's positioq

Subject: Police Budget Amendment to establish financing & spending plan for 2009
Internet Crimes Against Children grant
Date: June 22, 2009
The attached resolution establishes a financing and spending plan for a federal law enforcement grant.
The grant is with the Department of Justice. The grant totals $325,000 and would pay for the 2009
program for Internet Crimes Against Children. This is an annual program that includes contracts with
several other law enforcement agencies. SPPD serves as the fiscal agent and manages the grant.
Because this will amend the Police budget, this will require a public hearing. It will be on the Council's
agenda July 3` as the first and third meetings each month are the opporiunities for budget amendments.
This proposal seems reasonable, I recommend signing.

The recipient agi�ees to submit annuai reports ro OJP that set forth the following�
(A) SYaffing levels of the task force, mctuding the number of investigators, prosuutors, educahon specialists, and
forensic specialists dedicated to investigating and prosecuting Internet crimes against children.
(B) Inveshgation and prosecunon perfottnance measures of the fask force, includmg--
(i) the number of invesagaaons initiated relaced to Intemet crimes against children;
(ii) the number of azrests rela[ed to I�temet crimes against children; and
(iii) the number of prosecutions for Intemet crimes against children, including—
(n whether the prosecution resulted in a convic6on for such Crime; and
(II) ihe sentence and the siatutory maacimum fot such crime under Sfate law.
(C) The number of refetcals made by the task force to the United States Attomeys office, includmg whether the referral
was accepted by the United States Attomey.
(D) Statistics tk�at account for die disposition oF3mestigations that do not result m arrests or prosewrions, such as
referrals to other law enforcement
(E) The number of mvestigative technical assistance sessions that the task force provided to nonmember law
enforcement agencies.
(F) The number of computer forensic exazninations that the task force comple[ed.
(G) The number of law enforcement agencies participating m Internet crimes against children program staudards
established by the task fome.

16. RECOVERY ACT—Access to Records; Interviews
The recipient understands and agees tbat DOJ (includiog O.iP and the Office of rhe Inspecmr Geneml (OIG)), and iu
represenpnves, and the Govemment Accountability Office (GAO), shali have access to acid the right to examme all
records (induding, but not limi[ed to, books, papers, and documents) related to Ihis Recovery Act awazd, including
such records of any subrecipient, contractor, or subcontractor

ll. RECOVERYACT—O�e-timefunding
The recipient understands and agrees [6at awazds under the Recovery Act will be one-hme awards and accordingly that
its proposed project activities and delivernbles are to be accomplished without additional DOS funding.
18. RECOVERY ACT — Sepaza[e Tracking and Reporting of Recovery Act Funds and Outcomes
The rempient agrees to track, account for, and report on all funds from [his Rewvery Act awazd (including specific
outcomes and benefits a[tlibutable W Recovery Act funds) separately 6om all o[her funds, including DOJ awazd funds
from non-Recovery Act awazds awazded for the same or similar purposes or programs. (Recovery Act funds may be
used in conjunction with other funding as uecessary [o comple[e projects, but tracking and reporting of Recove[y Act
funds must be separate.)
Accordingly, the accoun4ng systems of the recipient and all subrecipienis must rnsure that funds from this Recovery
Act awazd are not commingled with funds from any other source.
The recipient further agrees that all personnel (including subrecipient personnel) w6ose activities are to be chazged to
the awazd will mai�txm Umesheets to documen[ hours worked for activities related to this awazd and non-awazd-
related activities.
19. RECOVERYACT—Subawatds—Monitoring
The recipient agrees to momtor subawazds under this Recovery Act awazd in accordance with all applicable statu[es,
regilarions, OMB c'vculazs, and guidelines, mcluding the OJP Financial Guide, and to include the applicable condirions
of this award in any subaward. The recipie�t is responsible for overstght of subrecipient spending and monitoring of
specific outcomes and benefifs attlibu[able to use of Recovery Aci funds by subrecipients. The recipient agrees to
submit, upon requesk documentation of its policies and procedures for momtoring of subawards under this awazd.
20. RECOVERY ACT — Subawards — DLJNS and CCR for Reporting

The recipient agrees to submit quarterly financial status repor[s to OJP. At presen[, Ihese reports aze to be Submit[ed

calendar quarter. The recipient understands that after October 15, 2009, OJP will disconlinue its use of the SF 269A,
and will require award recipie�ts to submit quaRerty financial status reports within 30 days after tl�e end of each
catendaz quazier, using the govemmeni-wide Shandard Fortn 425 Federnt Financ�al Report from (available for viewing

22. RECOVERY ACT — Recovery Act Trensactions Listed m Schedule of ExpendiNres of Federal Awards and Recipirnt
Responsibilities for Informing Subrecipients
(a) The rec�pient agrees to maintam records that identify adequately the source and apphcation of Recovery Act
funds, to marzimize the transpazency and accountabiliry of fwids authorized under the Recovery Act u requaed by the
Ac[ and in accordance with 2 CFR 21521, "Unifo[m Administrative Requuements for Grants and Ageements with
Insritutious of Higher Educadon, Hospitats, and Other Non-profit Organizations" and OMB A-102 Common Rules
provisions (relaung to Grants and Cooperafive Ageemenu with State and Local Governments).
(b) The recipient agrees to separately ideufify the expenditures for Federal awards under tt�e Recovery Act on the
Schedule of Expendihves of Federai Awazds (SEFA) and [he Data Collection Foim (SF-SAC) required by OMB
Ciroulaz A-133. This condition only appl�es if [he recipient is covered by the Smgle Audit Act Amendmen[s of 1996
and OMB Circular A-133, "Audits of States, Locai Govemments, and Non-Profit OrganizaROns.° This shall be
accompl�shed by ideutifying expenditures for Federat awards made under the Recovery Act sepazately on f}ie SEFA,
and as separate rows under Item 9 of Part I[I on the SF-SAC by CFDA number, and inclusion oFthe prefix "ARRA-"
in �denfifying the name of the Federal program on the SEFA and u the first cttaracters in Item 9d of Pan III on the SF-
SAC.
(c) The recipien[ agrees to separa[ely identiCy to each subrecipient the Federal awazd number, CFDA number, and
amount of Recovery Act funds, and to document tlils �dentlfication both at the fime of subawazd and a[ the tune of
disbursement of funds. When a recipient awazds Recovery Act fuuds for an existing program, the information
fiunished to subrecipien[s shall d�stmguish the subawazds of incremental Recovery Act funds from regular subawards
under the exisGng program.
(d) Tt�e c�ipiettt agrezs to cequire its subrecipients to specifically identify Recovery Act funding on theis SEFA
informatioq similar to the requirements for the recipient SEFA described above. This infoanation is needed to allow
the recipient to propedy monitor subrecipient expendiNre of Recovery Act funds as well as facilitate oversigh[ by the
Federal awarcUng agencies, the DOJ 0[G, and the GAO.

The recipient understands that thls award is subject to Ihe provis3ons of sec4on 1605 of the Recovery Act ("Buy
American"). No award funds may be used for iron, steel, or manufactureA goods for a project for the construction,
alteration, muntenance, or repair of a public building or public work, unless the rec�pient provides advauce writteu

tunnels, sewers, mains, power lines, pumping stafious, heavy generators, railways, aitports, terminals, docks, piers,
whatves, ways, ligh[houses, buoys, �emes, breakwaters, levees, and canals, and the consWC[ioq alteration,

"Manufac[ured good" means a good brought to [he construction site for mcorporation into the building or work thai has
been--
(1) Processed into a specific fonn and shape; or
