1 WHEREAS, the City of Saint Paul, Division of Parks and Recreation (the "City") owns pazk land
2 known as Johnson Parkway, which is located between Maryland Avenue and Burns Avenue in Saint Paul;

WHEREAS, Steiner Real Estate Acquisitions, LLC and Lang Real Estate Acquisitions, LLC (the
"Property Owners") have requested the diversion of a 17,452 squaze-foot azea of Johnson Pazkway (the
"Pazk Properiy") adjoining 1001 Johnson Pazkway for pazking purposes, as depicted on the survey attached
hereto as Attachxnent A, a copy of which is on file in the Office of Financial Services, Real Estate Section,
in the file ntunber 06-PKLDVRS-2009; and
11 WHEREAS, the Saint Paul Pazks and Recreation Commission supports the diversion of the Park
12 Property, as stated in its resolution, Number 09-10, adopted June 10, 2009, a copy of which is attached

hereto; and
WHEREAS, the City recommends the sale of the Park Property to the Property Owners, and the
Properiy Owners have agreed to pay just compensation as determined by an independent appraisal
pursuant to Section 13.01.1 of the Saint Paul City Charter; now, therefore be it
RESOLVED, that the proper city officials aze hereby authorized and directed to convey via
quitclaim deed said Pazk Property to said Property Owners; and to accept just compensation from said
Property Owners in the form of land at 1001 Johnson Pazkway of equivalent value to the Park Property
and/or cash to be deposited into the Parkland Replacement Fund and held in reserve for future purchase of
pazk property as required in Chapter 13.01.1 of the City Charter; and that all fees required by the City to
comply with the its parkland diversion guidelines shall be fully compensated by said Property Owners.

Initiating Problem, lssues, Opportunity (Who, What, When, Where, Why):
The owners of 1001 Johnson Pazkway plan to sell the property to anothet party. Adjoining their property is Johnson Parkway upon
which are proposed to be constructed several pazking spaces to serve the property under the new owner. The owners have land
equivalent in acteage and value to exchange for the pazkland. If addikonal land is conveyed by the Ciry than received, the owners will
pay the difference and funds would be placed in the Earkland Replacement Fund. Pazks & Rec staff and the Pazks & Rec Commission
are supportive of the request.
Advantages H Approved:
The City may dispose of pazkway property it does not need and receive funding for future parkland purchases or equivalent addirional
pazkland.
Disadvantages HApproved:
None.
Disadvantages If Not Approved:
The City would continue to own unneeded parkland and forego addirional land or funding for future pazk purchases.

RESOLUTION 09-10
4VHEREAS, the Saint Paul Pazks and Recreation Commission is an appointed body
established to advise the Mayor and Ciry Council on long-range and city-wide matters related to
Parks and Recreation; and
WHEREAS, Section 13.01.1 of the City Charter requires that the Commission review
aziy diversion or disposal of park property and present a recommendarion to the Saint Paul City
Council; and
WHEREAS, the City of Saint Paul, Division of Parks and Recreation, owns cify parkway
property, lmown as Johnson Parkway, between Maryland Avenue and Bums Avenue; and
VJHEREAS, Steiner Real Estate Acquisitions, LLC ("Steiner") owns land adjacent to the
pazkway at 1001 Joluison Parkway and has requested the diversion of a 15,575 square-foot azea
af the pazkway for private pazking (as shown on Attacimient A); and
WHEREAS, Steiner proposes to exchange an equal portion of Steiner's property
adjoinina Johnson Parkway for the portian of city parkway property requested by Steiner for
pazking; and
WHEREAS, the Division of Pazks and Recreation I�as determined that the pazkrvay
properiy may be diverted for this purpose and recommends Commission support for the request;
now, therefore
BE IT RESOLVED, that the 3aint PauI Parks and Recreation Commission concurs with
the request to diverc city park land along Jolmson Parkway through a deed or easement To the
properiy owner at 100] Jolmson Pazkway, and in accordance witl� City Cl�arter Secrion 13.01. ]

Parkland Diversion File No. 06-PKLDVRS-2009
I recomxnend a public hearing before the City Council be held on Julv 15, 2009.
The purpose of this hearing is to consider a resolution to dispose of a section of
Johnson Parkway for the purpose of providing parking for the adjoining private
property at 1001 7ohnson Parkway, and to authorize city officials to convey the
parkway property to Steiner RE Acquisitions in exchange for conveyance of
adjoining property owned by Steiner RE Acquisitions. This is a follow-up to a
similar request, approved by the City Council in January, 2009, for the diversion of a
small portion of Johnson Parkway abutting this property.
This property is located in City Council District 6, Planning District 4.
