1 WHEREAS, the City of Saint Paul ("Ciry") has determined that there is no longer a public purpose
2 for maintaiuiug its right-of-way easement rights within unopened Corning Avenue as dedicated in
3 Corning's Addition to the City of St. Paul, Ramsey County, Minnesota, and the City wishes to vacate its
4 interest in said right-of-way; and

WHEREAS, the City has received a request from Steiner Rea1 Estate Acquisitions, LLC
("Steiner"), Lang Real Estate Acquisitions, LLC ("Lang") and Hmong Village, LLC ("Hmong Village") to
vacate said right-of-way prior to executing a land exchange between the City and said parties as part of a
pazkland diversion request being separately considered by the City Council; now, therefore be it
RESOLVED, that, upon the petition of the City of Saint Paul, as documented in Office of Financial
Services Vacation File Number 06-2009, the public property described in the attached E�ibit A is hereby
vacated and discontinued as public properry and the public utility easements within said public properry are
hereby released.
This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
1. Steiner, Lang and Hmong Village, their successors and assigns shall pay $1,200.00 to the City of
Saint Paul as an administrative fee for this vacation which is due and payable within 60 days of the
effective date ofthis resolution.
Steiner, Lang and Hmong Village, their successors and assigns agree to indemnify, defend and saue
hannless the City of Saint Paul, its officers and employees from all suits, actions or claims of any
character brought as a resuit of injuries or damages received or sustained by any person, persons or
property on account of this vacation, or the petitioner's use of this property, including but not
limited to, a claim brought because of any act of omission, neglect, or misconduct of said
petitioners or because of any claims or liability arising from any violation of any law or regulation
made in accordance with the law, whether by the petitioner or any of its agents or employees.
31 3. Steiner, Lang and Hmong Village, their successors and assigns shall, within 60 days of the effective
32 date of this resolution, file with the Office of Financial Services/Real Estate Section, an acceptance
33 in writing of the conditions of this resolution and shall, within the period specified in the terms and
34 conditions of this resolution, comply in all respects with these terms and conditions.

The Ciry has received a request from the current owners and futute putchasers of the property at 1001 Johnson Pazkway to vacate a
platted, unopened street located within a grassy portion of Johnson Pazkway well away from the roadway and adjoining 1001 Johnson
Pazkway. This vacafion is a necessary step prior to the Ciry and owners execuring a land exchange that will provide addiuonal pazking
for the owners wi[hin the unused portion of Johnson Pazkcvay and additional pazkland for the Ciry from property currently owned by
1001 Johnson Pazkway. The land exchange will be authorized by the City Council in a sepazate resolution.

The vacation will allow the land exchange to proceed because the property will no longer be encumbered with a street easement.

None. The City has never used ttris portion of Corning Avenue as right-of-way and has no need for it. If approved, the subsequent

Those parts of Corning Avenue and Langtry Avenue as delineated and dedicated in
Corning's Addition to the City of St. Paul Ramsey Co Minn, according to the recorded
plat thereof, Ramsey County, Minnesota, lying northerly of the westerly ea�tension of the
northerly line of Lot 19, said Corning's Addition to the City of St. Paul Ramsey Co
Minn, and lying southwesterly of the northwesterly extension of the southwesterly line of
Lot 1, said Corning's Addition to the City of St. Paul Ramsey Co Minn.
Also
That part of said Langtry Avenue lying southwesterly of a line described as follows:
Commencing at the intersection of the westerly line of said Corning Avenue and
the westerly extension of the northerly line of Stillwater Avenue (now Ames
Avenue) as delineated and dedicated in said Corning's Addition to the City of St.
Paul Ramsey Co Minn; thence on an assumed beazing of North 13 degrees 50

RE: Real Estate Vacation File No. 06-2009 (Vacation of Corning Avenue)
I recommend a public hearing before the City Council be held on Julv 15, 2009 to
consider the petition of the City of Saint Paul to vacate platted Corning Avenue
abutting 1001 Johnson Parkway.
The puxpose of this vacation is to remove street easement rights over a portion of
city-owned land so it may be exchanged with adjoining private land to facilitate
additional parking as part of the redevelopment of 1001 Johnson Pazkway. No
building will be constructed within the proposed vacated area.
This property is located in City Council Ward 6, Planning District 4.

The City of Saint Paul hereby petitions to vacate surplus platted street right-of-way abutting 1001
Johnson Pazkway, Saint Paul, which is intended to be conveyed to the owner of 1001 Johnson Parkway
in exchange for an equal amount of land from the 1001 Johnson Parkway property. The property to be
vacated is shown on the attached map and described as follows:
That part of Corning Avenue dedicated in the plat of Corning's Addition to the City of St.
Paul Ramsey Co Minn, accarding to the recorded plat thereof, Ramsey County, Minnesota,
described as follows:
All that part of Corning Avenue lying northwest of the westerly extension of the
southeast line of I,ot 18, including that portion of Langtry Avenue lying westerly of
the northerly extension of the southwest line of Lot 1, Corning's Addition to the City
of St. Paul Ramsey Co Minn.
The City, through its Office of Financial Services, Real Estate Section, has determined this property
to be surplus to its right-of-way needs.

Attached are a Reply to Vacation Inquiry form and Maps related to a petition by the property owner at 1001
Johnson Parkway, Saint Paul to vacate adjacent platted Corning Avenue in order to facilitate the City's
conveyance of this area to the property owner as part of a land swap. Corning was platted in 1887, but likely
never improved by the City. It is now located within Johnson Parkway because the City acquired underlying fee
for that area in 1914 when it created the parkway. Corning is located just south of the intersection of Johnson
Parkway and Phalen Boulevard. It is outside of the Johnson Parkway street right-of-way and is part of a wide
grassy boulevard well away from roadway.
Please review this request and return the completed Inquiry Reply Form to me via email or US mail. I would
appreciate receiving it by Friday, 7une 19th if at all possible to facilitate a rather short processing time line
for this request.
