09-751Council File # 09-751 Green Sheet# 3072201 RESOLUTION NT PAUL, MINNESOTA Presented by 3/ 1 WHEREAS, the City of Saint Paul ("Ciry") has determined that there is no longer a public purpose 2 for maintaiuiug its right-of-way easement rights within unopened Corning Avenue as dedicated in 3 Corning's Addition to the City of St. Paul, Ramsey County, Minnesota, and the City wishes to vacate its 4 interest in said right-of-way; and 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 WHEREAS, the City has received a request from Steiner Rea1 Estate Acquisitions, LLC ("Steiner"), Lang Real Estate Acquisitions, LLC ("Lang") and Hmong Village, LLC ("Hmong Village") to vacate said right-of-way prior to executing a land exchange between the City and said parties as part of a pazkland diversion request being separately considered by the City Council; now, therefore be it RESOLVED, that, upon the petition of the City of Saint Paul, as documented in Office of Financial Services Vacation File Number 06-2009, the public property described in the attached E�ibit A is hereby vacated and discontinued as public properry and the public utility easements within said public properry are hereby released. This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended, and to the following conditions: 1. Steiner, Lang and Hmong Village, their successors and assigns shall pay $1,200.00 to the City of Saint Paul as an administrative fee for this vacation which is due and payable within 60 days of the effective date ofthis resolution. Steiner, Lang and Hmong Village, their successors and assigns agree to indemnify, defend and saue hannless the City of Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a resuit of injuries or damages received or sustained by any person, persons or property on account of this vacation, or the petitioner's use of this property, including but not limited to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising from any violation of any law or regulation made in accordance with the law, whether by the petitioner or any of its agents or employees. 31 3. Initiating Problem, Issues, OppoRunity (Who, What, When, Where, Why): The Ciry has received a request from the current owners and futute putchasers of the property at 1001 Johnson Pazkway to vacate a platted, unopened street located within a grassy portion of Johnson Pazkway well away from the roadway and adjoining 1001 Johnson Pazkway. This vacafion is a necessary step prior to the Ciry and owners execuring a land exchange that will provide addiuonal pazking for the owners wi[hin the unused portion of Johnson Pazkcvay and additional pazkland for the Ciry from property currently owned by 1001 Johnson Pazkway. The land exchange will be authorized by the City Council in a sepazate resolution. Corning was platted in 1887, but likely never improved by the City. It is now located within Johnson Parkway because the City acquired underlying fee for that area in 1914 when it created the parkway. Corning is located just south of the intersection of Johnson Parkway and Phalen Boulevard. It is outside of the Johnson Parkway street right-of-way and is part of a wide grassy boulevard well away from roadway. Please review this request and return the completed Inquiry Reply Form to me via email or US mail.
