WHEREAS, Frank D. Marzitelli, then a duly elected, Qualified
and acting Councilman, of the City of Saint Paul, assigned, pursuant to
the Home Rule Charter of said City, as Commissioner of Public Works, on
the 14th day of August, 1957, addressed and delivered his formal letter of
resignation, in respect of his said Office of Councilman, to the Council of
said. City, whereunder and whereby he unconditionally and unreservedly
resigned therefrom and relinquished his said Office of Councilman effective
the end of said 14th day of August, 1957, and further appraised said.
Council of the fact of his acceptance of an inconsistent office, that of
Deputy Commissioner of Highways of the State of Minnesota; and
WHEREAS, said resignation and relinquishment having been accepted
by said Council and having become effective, in both instances, according
to the tenor of the same, at the end of the said 14th day of August, 1957,
thereby there has occurred and there now exists, a vacancy in the Office
of Councilman of said City which is required to be filled by election, by
said Council, under and pursuant to Sec. 27 of said Home Rule Charter;
therefore, be it
RESOLVED, that, said resignation therefrom and relinquishment of
said Office of Councilman, by said Frank D. Marzitelli, shall be deemed to
have become effective and to have been accepted by said Council, according
to its tenor, at the end of said 14th day of August, 1957; that by virtue
of said resignation and relinquishment a vacancy has occurred and now
exists in said Office of Councilman; and that said vacancy shall be filled
by election, by this Council, hereby called and to be held and conducted
by and at the regular public meeting of said Council on the 15th day of
August, 1957, at 10:00 o'clock, a. m., or as soon thereafter as shall be
reasonably convenient end feasible.
