PAUL COUNCIL NO. c(1/ ' ' ,OFFICE OF THE CITY CLERK FILE • C U RESOLUTION—GENERAL FORM PRESENTED BY ` COMMISSIONER �t DATE— WHEREAS, this Council has passed C.F. 183844 approving organization of a new Port Authority of the City of Saint Paul, pursuant to Laws of Minnesota 1957, Chapter 812; and WHEREAS, the Mayor has appointed the seven members who shall constitute the said Port Authority under the law hereinabove mentioned, which appointments have been approved, confirmed and consented to by the Council of the City of Saint Paul, Now, therefore, be it RESOLVED, That the Mayor is requested by this Council to call the said Port Authority into its first meeting, and to act as the pro tem chairman of the said organization to the end that the new Port Authority, under the 1957 Legislative Act, shall begin its operations and exercise the powers given to it under said Laws of Minnesota for 1957, Chapter 812. Hurley IN RE: Port Authority - Laws of Minnesota 1957, Chapter 812 To transfer the powers of the present Port Authority over to a new Port Authority authorized by the above law, which Port Authority shall have the extended jurisdiction as granted under Chapter 812, the following steps are necessary under the provisions of the law and should be taken in this order : 1. The passage of a formal resolution by the Council authorizing the Port Authority of the City to be increased to seven members and to operate under Chapter 812. This step has already been taken by Council Resolution No. 183844, approved the 23rd day of July, 1957, a copy of which is hereto attached. 2. Under the law, the Mayor, with the approval of the Council, shall appoint the four new members to the new Port Authority. Two of these must be council- men, two of these must be lay persons. The term for each of these four new members is six years, provided, insofar as the Council appointees are concerned, that they retain their membership on the governing body of the City. 3. The Mayor also, under the law, appoints the other three members of the seven-man Port Authority, who shall be the present Port Authority Commissioners, and they shall be appointed for the remainder of their unexpired terms to such Port Authority. 4. When these steps have been taken, I suggest, although the law does not specifically set out the procedure, that a resolution of the Council be passed authoriz- ing the Mayor to call a first meeting of the newly MEMORANDUM To the Mayor . 2.
