1 WfIEREAS, the Board of Ramsey County Commissioners has referred a repurchase application for
2 property located at 1523-1525 Reaney Avenue to the Saint Paul Council for review and recommendation;
3 and
4
5 WHEREAS, the L,egislative Hearing Officer has reviewed police records, illegal activity, property code,
6 and health violations within the past four years; and
8 WHEREAS, the Legislative Hearing Officer determined that 1523-1525 Reaney Avenue has had
9 substantial maintenance issues, necessitating numerous nuisance abatement orders; and
10
11 WHEREAS, the City of Saint Paul has had to conduct numerous cleanups at the property due to the
12 owner's failure to abate these nuisance conditions in a timely manner.

14 NOW, THEREFORE, BE IT RESOLVED, the Saint Paul City Council recommends that the Board of
15 Ramsey County Commissioners not approve the repurchase application for the property of 1523-1525
16 Reaney Avenue; and
17
18 BE IT F[JRTHER RESOLVED, that tYie City Clerk is requested to forward a certified copy of this Council
19 resolution to the Ramsey County Tax Forfeited Land Office, 90 Plato Boulevard West, for final

processing; and
BE IT FINALLY RESOLVED, that the Saint Paul City Council requests the entire packet of materials
reviewed by the Council be included in the Ramsey County Board of Commissioners' meeting materials
on this subject.

Mr. Magner said that this was a side-by-side duplex owned by Tou Yang. He said there was no
noted history of complaints for 1523; however, for 1525, there were Real Estate tas assessments for
September 2006, a building permit was issued in July 2005, there was an exterior complaint for a
chair in the backyazd in May 2004 and another exterior complaint for a refrigerator in the backyazd
in 7anuary 2004. It appeared from the property tax records that payments had been made in July
2007 the amount of $3,751.78 with $1,875.89 being reversed; another payment was made in August
2007 in the amount of $3,751.78 which was then reversed; in 2008, there were two adjushnents
made in the amounts of $1,721 and $3,960; there was a payment made in May 2009 in the amount
of $27.04 which was then reversed and another payment was made in May 2009 in the amount of
$54.08.
Ms. Moermond reviewed the police reports. On August 31, 2008, there was a report of an
automobile theft where a vehicle was stolen out of the driveway; on August 11, 2005, there was a
report of another automobile theft with no further information; on July 5, 2008, there was a routine
traffic stop in which an arrest was made for obshucting the legal process; and on May 5, 2003, a
female was placed at Regions for an evaluation. After reviewing the records, Ms. Moermond said
that she would recommend denying an application to repurchase the property.

Dear Marcia Moermond,
Enclosed please find a repurchase applicat+on received from the prior owner, Tou 1 Yang for a
parcel that was forfeited to the State of Minnesota on August 1, 2008.
The County Board policy adopted on December 21, 1999, No. 99-507, allows for "each
repurchase application to be referred to the municipality in which the property is located. The
municipality will document whether the property is considered a municipal problem based on
documented police, building code, illegal activity, or health violations within the past five years.
The municipality, by resolution, shall recommend that the County Board approve or deny the
repurchase application and return the repurchase application to Ramsey County along with the
resolution and documentation of any violations."

• Map of the parcel
While the repurchase policy does not state a specific timeline for action by the City Council, we
ask that the City Council's recommendation be received within 60 days for timely processing.

282.241:
. The owner at the time of forfeiture, or the owner's heirs, devisees, or representatives, or any
person to whom the right to pay taxes was given by statute, mortgage, or other agreement,
may file an application to repurchase any parcel of land claimed by the state to be forfeited
to the state for unpaid property taxes, unless sold or conveyed to a third parfy.
. The property may be repurchased for the sum of all:
o Canceiled taxes, including all delinquent real property taxes, plus penalties, accrued
interest and costs attributable to the taxes.
o All properfy taxes plus penalties, interest and costs on those taxes for the taxes payable
year following the year of the forFeiture and all subsequent years through the year of
repurchase.
o AII delinquent special assessments canceiled at the time of forfeiture, plus penalties,
accrued interest and costs attributabie to those assessments.
o Special assessments not levied between the date of forfeiture and the date of
repurchase.

Squad 310 (Matsen) was sent to 1523 Reaney on 8/31/08 at 2050 for a motor vehicle theft report. Sometime
between 1915 on 8l29 and 2012 on 8/31 unknown suspects stoie ihe victim's vehicle. The victim parked his
vehicie on his driveway while out of town for the weekend. Stoien was MN NGX-499, a 1995 Bfack Acura
Integra. There was no suspect information.
