Presented by
1 WHEREAS, the Board of Ramsey County Commissioners has referred a repurchase application for
2 property located at 539 Charles Avenue to the Saint Paul Council for review and recommendation; and
3
4 VJHEREAS, the Legislative Hearing Officer has reviewed police records, illegal activity, property code,
5 and health violations within the past four yeazs; and
7 WHEREAS, the St. Paul Police Department responded to on numerous occasions for a variety of criminal
8 and nuisance activity at 535 and 537 Chazles Avenue, the neighboring property to 539 Charles Avenue;
9
10 WHEREAS, the Legislative Hearing Officer determined that 535 and 537 Charles Avenue, the neighboring
11 property to 539 Charles Avenue, has had substantial maintenance issues, necessitating numerous nuisance
12 abatement orders; and
13
14 WHEREAS, the City of Saint Paul has had to conduct numerous cleanups at the property due to the
15 owner's failure to abate these nuisance conditions in a timely manner.

17 NOW, THEREFORE, BE IT RESOLVED, the Saint Paul City Council recommends that the Boazd of
18 Ramsey County Commissioners not approve the repurchase application for the property of 539 Charles
19 Avenue; and
20
21 BE IT FURTHER RESOLVED, that the City Clerk is requested to forward a certified copy of this Council
22 resolution to the Ramsey County Tax Forfeited Land Office, 90 Plato Boulevard West, for final
23 processing; and
24
25 BE IT FINALLY RESOLVED, that the Saint Paul City Council requests the entire packet oFinaterials
26 reviewed by the Council be included in the Ramsey County Board of Commissioners' meeting materials
27 on this subject.

Ms. Moermond stated that an application to repurchase the property was made by Wells Fargo Bank
NA. The reason that was listed to repurchase the property was: "the borrower did not maintain the
agreement with Wells Fargo which commenced foreclosure proceedings and were unaware of any
delinquent taaces or assessments on the property. On December 26, 2008, Wells Fazgo became the
owner of the property and claim that they are in now a position to satisfy all outstanding tases and
assessments on the property and wish to sell the property.
Mr. Magner stated that this property was previously owned by Joni Torgerson and was a category 2
vacant building which file was opened on March 9, 2009. According to STAMP, a code
compliance inspection had been done on March 23, 2009 for Eric Oberg representing Ocwen Loan
Processing. The violarions at the property are as follows: June 1, 2009, there was garbage/rubbish;
May 26, 2009, there was garbage/rubbish, tall grass and weeds and boarding/securing; May 19,
2009, there was tall grass and weeds and boarding/securing, beginning December 19, 2008 through
March 4, 2009, the City provided gazbage hauling service; September 18, 2008, garbage/rubbish;
June 25, 2008, tall grass and weeds and garbage/rubbish; May 15, 2008, garbage/rubbish; April 15,
2008, exterior-discuded furniture; February 7, 2007, garbage/rubbish; May 6, 2006, tall grass and
weeds; January 7, 2005, garbage/rubbish; and Apri12, 2004, garbage/rubbish. In order for anyone
to purchase the property for rehabilitation, they would have to provide DSI with a work plan,
present contractor bids, and provide financial documentation indicating the ability to complete the
rehab. The goal for this area was to have less density in the neighborhood.
Ms. Moermond reviewed the police records. On December 11, 2008, there was an invesrigation-
juveniles; on November 14, 2008, there was an auto theft; on November 8, 2008, a police visit-
proactive; on September 24, 2008, there was family/children-child abuse; on August 5, 2008, there
was a traffic violation; on August 4, 2008, there was criminal damage to property; on July 28, 2008,
there was disturbance-suspicious person/activity; on July 17, 2008, a traffic violation; on June 12,
2008, there was aggravated assault-domestic strangulation; on February 29, 2008, there was an auto
theft; on February 4, 2008, there was a warrant served; on December 22, 2007, there was a
disturbance-disorderly boys, girls, persons; on September 15, 2006, there was a burglary in the
garage; on July 20, 2006, there was an auto theft; on July 5 and 6, 2006, there was a burglary; on
June 7, 2006, there was a burglary, on May 6, 2006, there was a traffic stop; on January 1, 2005,
there was a disturbance-disorderly boys, girls, persons; on March 23, 2004, there was a warrant; and
on February 14, 2004 there was an auto theft at the property. After reviewing the records, Ms.
Moermond said that she would recommend denying an application to repurchase the property.
537 Charles Avenue (second house on lot with 535 Charles)
Ms. Moermond stated that an application to repurchase the property was made by Wells Fargo Bank
NA. The reason that was listed to repurchase the property was: "the borrower did not maintain the
agreement with Wells Fargo which commenced foreclosure proceedings and were unaware of any
delinquent taxes or assessments on the property. On December 26, 2008, Wells Fargo became the

snow and ice; October 30, 2006, gazbage/rubbish; July 27, 2006, vacant building-category 2; July
25, 2006, garbage/rubbish; and October 29, 2004, garbage/rubbish. In order for anyone to purchase

visit-proactive; on July 12, 2008, there was a police visit-proactive; on July 11, 2008, there was a
police visit-proactive; on July 7, 2008 there was a welfare check; on July 4, 2008, there was a police
visit-proactive; on June 26, 2008, there was an investigation juvenile; on June 25, 2008, there was a
police visit-proactive and a disturbance-trespassing; on June 23, 2008 there was a weapons
discharge; on May 19, 2008, there was a traffic stop-advise; on May 14, 2008, there was criminal
damage to property-felony; on January 6, 2008, there was disturbance-suspicious person/activity; on
January 3, 2008, there was a burglary; on July 22, 2007, there was sex offense; on June 3, 2007
there was a police visit-proactive; on May 18, 2007, there was a traffic stop-advise; on May 9, 2007,
there was a traffic stop-advise; on December 1, 2006, there was an investigation; on April 13, 2005,
there was a disturbance-fights; on September 3, 2004, there was a thefr; and on Februazy 10, 2004,
there was a traffic accident at the property. After reviewing the records, Ms. Moermond said that
she would recommend denying an application to repurchase the property.
539 Charles Avenue (vacant lot associated with 535 & 537 Charles)
Mr. Magner stated that there was no activity in STAMP associated with this vacant property as he
believed Ramsey County was maintaining the property.
Ms. Moermond stated that she would recommend denying an application to repurchase the property
given the history of violations at the neighboring properties.

Enclosed please find a repurchase application received from the prior owner, Wells Fargo Bank
NA for the Registered Holders of Home Equity Loan Asset-Backed Certificates, Series 2004-3 for
a parcel that was forfeited to the State of Minnesota on August 1, 2008.
The County Board poiicy adopted on December 2i, 1999, No. 99-507, allows for "each
repurchase application to be referred to the municipality in which the property is located. The
municipality will document whether the property is considered a municipal problem based on
documented police, building code, illegai activity, or health violations within the past five years.
The municipaiity, by resolution, shall recommend that the County Board approve or deny the
repurchase application and return the repurchase application to Ramsey County along with the
resoiution and documentation of any violations."

As a note, City files had identified this property as 537 Charles Ave, which is incorrect. 537
Charles Ave. is located on the same lot as 535 Charies; therefore two houses on one lot. The tax
forfeited lot is vacant land and should be assigned the address, 539 Charles. We are still trying to
get the assessment charges corrected on the property and moved to 535-537 Charles. There are
no code violations logged to the tax forFeit property. If you review the police history summary, I
believe the complaint calls actually came from 537-535 Charles. Both houses are now vacant
and going through foreclosure.

EXHIBIT A
On August 12, 2004, Joni L. Torgerson encumbered the subject property with a mortgage in the
amount of $161,600.00 which was duly recorded as Document No. 38010D3. Torgerson 6ecame
delinquent under the terms of the mortgage and Wells Fargo Bank, N.A. as Trustee commenced
foreclosure proceeding against the property.
Abstracting ordered at the time of foreclosure did not indicate any delinquent taxes or outstanding
assessmentslpenalties pending against the Property. Wells Fargo Bank, N.A. as Trustee
therefore had no knowledge of the delinquency status of the taxes and/or assessments, and did
not realize that forteiture was imminent. Now, through no fault of its own, Weils Fargo's interest in
the Property may be lost.
Wells Fargo Bank, N.A. as Trustee became the fee owner of the Property on December 26, 2008.
Wells Fargo Bank N.A., as Trustee is now in a position to satisfy all outstanding tax and
assessment delinquencies so as to stop the forfeiture of the property so that Wells Fargo may
continue to pursue a purchase with third party Buyer.
