Presented by
WHEREAS, the Boazd of Ramsey County Commissioners has referred a repurchase application for
property located at 901 Conway Street to the Saint Paul Council for review and recommendation; and
4 WHEREAS, the Legislative Hearing Officer has reviewed police records, illegal activity, property code,
5 and health violations within the past four years; and
WHEREAS, the Legislative Hearing Officer determined that 901 Conway Street has had substantial
maintenance issues, necessitating numerous nuisance abatement orders; and
10 WHEREAS, the City of Saint Paul has had to conduct numerous cleanups at the property due to the
11 owner's failure to abate these nuisance conditions in a timely manner.

13 NOW, THEREFORE, BE IT RESOLVED, the Saint Paul City Council recommends that the Board of
14 Ramsey County Commissioners not approve the repurchase application for the property of 901 Conway
15 Street; and

17 BE IT FURTHER RESOLVBD, that the City Clerk is requested to forward a certified copy of this Council
18 resolution to the Ramsey County Taac Farfeited Land Office, 90 Plato Boulevard West, far final
19 processing; and
20
21 BE IT FINALLY RESOLVED, that the Saint Paul City Council requests the entire packet of materials
22 reviewed by the Council be included in the Ramsey County Board of Commissioners' meeting materials
23 on this subject.

Ms. Moermond stated that an application to repurchase the property was made by George B. Smith,
the son of the now deceased owner, Grace Fogelberg.
Mr. Magner stated that this was a category 2 vacant building which file was opened on April 28,
2008. According to STAMP, a code compliance inspecrion had been completed on April 8, 2009.
The violations at the property are as follows: June 8, 2009, garbage/rubbish; May 5, 2009,
gazbage/rubbish; Apri128, 2009, garbage rubbish; 7une 2, 2008, gazbage/ rubbish; and May 1, 2008,
garbage/rubbish. He said the vacant building fees for 2008 went to assessment and the vacant
building fees for 2009 went to assessment on June 1. In order for anyone to purchase the property
for rehabilitation, they would have to provide DSI with a work plan, present contractor bids, and
provide financial documentation indicating the ability to complete the rehab. It appeazed that the
property likely went taac forfeit as the estate of the deceased owner did not pay the property taxes.
Ms. Moermond reviewed the police records. In September 2008, there was a disturbance-disarderly
boys/girls/persons; in August 2008, there was a burglary; and July 2008, there was a traffic stop at
the property. After reviewing the records, Ms. Moermond said that she would recommend denying
an application to repurchase the property.

Enclosed please find a repurchase application received from the prior owner for a parcel that was
forfeited to the State of Minnesota on August 1, Z008.
The County Board policy adopted on December 21, 1999, No. 99-507, allows for "each repurchase
application to be referred to the municipality in which the properry is located. The municipality will
document whetherthe property is considered a municipal problem based on documented police,
building code, illegal activity, or health violations within the past five years. The municipality, by
resolution, shall recommend that the County Board approve or deny the repurchase application and
return the repurchase application to Ramsey County along with the resolution and documentation of
any violations:'

While the repurchase policy does not state a specific timeline for action by the City Council, we ask

The bwner at the time of forfeiture, or the owners heirs, devisees, or representatives, or any person to whom
the right to pay taxes was given by statute, mortgage, or other agreement, may file an application to repurchase
any parcel of Iand claimed by the state to be forfeited to the state for unpaid property taxes, unless sold or
conveyed to a third party:
The property may be repurchased for the sum of all:
o Cancelled taxes, including al� delinquent real property taxes, plus penalties, accrued interest and costs
attributable to the taxes.
o AII property taxes plus penalties, interest and costs on those taxes for the taxes payable year foilowing
the year of the forfeiture and all subsequent years through the year of repurchase.
o AII delinquent special assessments ca�ceifed at the time of for€eiture, plus penalties, accrued interest
and costs attributa6le to those assessments.
o Special assessments not levied between the date of forfeiture and the date of repurchase.
o Any additional costs and interesi relating to taxes or assessments atcrued between the date of
forfeiture and the date of repurchase.
o E�Rra costs related to repurchase and recording of deed.
A$250.00 administrative service (repurchase) fee, in certified funds, is due atthe time tfie application is
submitted.
