There are to be no patrons admitted to the establishment after 12:30 a.m. Last call will be
given at 12:30 a.m. El Pantano Plus management and security personnel will ensure that
patrons do not leave en masse but rather management and security will encourage '
patrons to leave in an orderly and controlled manner between 12:15 a.m. and 1:30 a.m.
The licensee will provide and maintain working video surveillance cameras and
equipment to record activity on these premises prior to issuance of the license and in
accordance with Saint Paul Police Department (SPPD) recommendafions. Tapes and
recordings must be maintained for a minimum of thirty (30) days, and there shall be an
employee on-staff at all times during business hours with the ability to make them
immediately available to the SPPD and/or the Department of Safety and Inspecrions (DSI)
upon request.
Exterior lighting must be maintained and adequate to support the camera/security
equipment.
Doors and windows must remain closed during the time that entertainment is offered.
Management will monitor sound levels of music to insure that neighbors are not disturbed
by loud noise levels or bass vibrations.
Security personnel shall be on duty at all tunes entertainment is provided.
Security personnel shall be assigned to each entrance starting at 9:00 p.m. and remain until
all patrons have left the licensed premises, which include the parking lot(s). Security
personnel shall "wand" (using a metal detector) each patron and check all handbags and
packages carried by patrons. Security personnel shall verify the age of patrons by
checking state or federally issued identification cards (no picture I.D., no entrance).
Customers re-entering the establishment shall be subject to the same security measures as
customers entering the establishment for the first time.
Adherence to Strict Idenfification Requirements: El Pantano Plus will require proper
picture identification from anyone who appears to be younger than thirty (30) years old.
Those without proper identification shall be denied entrance.
The license holder is responsible for the behavior of all persons on the licensed premises,
which includes persons inside the establishment and outside in the parking lot(s).
Betcveen 9:00 p.m. and 1 hour after closing, security/staff will patrol the parking lot(s) to
monitor lot(s) for patron behavior of that would disturb the neighbors.
The licensee shall pick up trash, litter and empty bottles and/or cans on the premises and
also between Pennsylvania Avenue and Charles Avenue and between Rice Street and
Capitol Boulevard on a daily basis.
WHEREAS, the Deputy Legislative Hearing Officer recommends that application of V& HM Plus
LLC (I.D. #20080002369), doing business as El Pantano Plus, 586 Rice Street, for Liquor On Sale -
181-290 Seats, Liquor On Sale - Sunday, Entertainment B and Restaurant (5) -151 and Over
licenses, be approved with the following conditions:

THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this
license applicafion with the aforementioned agreed-upon condifions.

10. Licensee will maintain a list of patrons who have been banned from the establishment for
assaultive, disorderly or disruptive behavior. The list must, at a minimum, contain the
names and descriprions of banned patrons, as well as the date they were advised they
were banned. No persons who are on the list shall be permitted to be in the establishment
or remain on the grounds. This list will be made available upon request to the SPPD or
DSI.
11. The license holder will not allow anyone under the age of eighteen (18) to enter the
establishment except in accordance with Minnesota State Statute 340A.503(4) and Section
409.08 of the City of Saint Paul Legislative Code. Events held for individuals under the
age of twenty-one (21) require a special permit from DSI and require that such events are
held in a portion of the establishment where liquor is not permitted, consumed, sold or
served. The licensee shall be responsible far ensuring that individuals under the age of
twenty-one (21) who attend such events can not gain access to an area where liquor is
sold, served, permitted or consumed.
12. � The licensee shall comply with applicable provisions of the City Health Code and obtain
approval from the DSI Environmental Health inspector for any food served inside the
establishment.
13. Any remodeling of this facility must be reviewed and approved in writing by DSI prior to
beginning a project.

The hearing was called to order at 10:03 a.m.

El Pantano Plus: Liquor On Sale —181-290 Seats, Liquor On Sale — Sunday, Liquor On Sale
— 2 AM Closing, Restaurant (5) —151 and Over, and Entertainment (B) licenses
Ms. Vang stated that this is an informal legislative hearing for a license application. This is a
Class N license notification which means that the neighborhood gets notified and has a chance
to voice its concerns. If anyone has a concern, it automatically triggers a hearing. Other Class
N licenses include: tattoo parlors, auto repair, auto sales, etc.—things that have an immediate
impact on the neighborhood. The City received five (5) letters of concern regarding this
applicaEion. UltimateIy, there are three (3} possible outcomes from this hearing: 1} Ms. Vang
may recommend to the City Council that they approve this license with no conditions; 2) she
may recommend to the City Council that they approve this license with agreed upon
conditions; or 3) she may recommend to the City Council that they not approve the requested
license but refer it to an administrative law judge for a further hearing and findings. Ms. Vang
will make her recommendation in the form of a resolution that will go before the City Council
for their approval. It will appear on the Consent Agenda at a City Council meeting. The City
Council is the final authority on whether the license application is approved or denied.
Ms. Vang will begin with a staff report. Staff will be asked to explain their review of the
application and will also explain their recommendation. Then, she will ask the applicant to
explain their business plan. Next, she will hear from people who are here in support and those
with concerns, and she will review the letters that were sent regarding this request.
Ms. Kristina Schweinler, Senior License Inspector, DSI, reported that the Department of
License and Inspections (DSI) is recommending approval with conditions for the Liquor On
Sale —181-290 Seats, Liquor On Sale — Sunday, Liquor On Sale — 2 AM Closing, Restaurant (5) —
151 and Over, and Entertainment (B) licenses and recommending denial for the Liquor On Sale
— 2 AM closing license with reconsideration of the 2 AM license after the summer if everything
goes welI. There are also some changes to the conditions that were recommended after

police reparts: no person under the age of 18 will be allowed in the establishment and that any
21 year old and under events will need permits, on a case by case basis. If the 2 AM closing is
denied, condition #1 will also need to be changed to reflect that. Current recommended
conditions are:

will be given at 1:30 AM. El Pantano Plus management and security personnel will

Ms. Vang asked the co-owners to present a general idea of their business intentions. Ms. Leon-
Beltran responded that they intend to run a Mexican restaurant, rent meeting spaces for Latino
parties, weddings, etc., and open as a type of sports bar. Ms. Vang asked about the hours of
operation. Ms. Leon-Beltran replied that currently, they are open just on weekends while they
are remodeling the place to include the restaurant. Permits have not yet been pulled. The
restaurant will be fully opened in approximately twenty (20) days. Their current hours of
operation are from 9:00 p.m. to 2:00 a.m., Friday, Saturday and Sunday nights (entertainment
venue, only).
Ms. Vang asked Ms. Leon-Beltran if she had any questions regarding the conditions placed on
the licenses. Ms. Leon-Beltran said that she was comfortable with the conditions and had no
questions.

Mr. Paul Mandell, principal planner, Capitol Area Architectural and Planning Board, which
has zoning jurisdiction of the area in which El Pantano Plus is located. This site at 568 Rice
Street does not have enough parking but it is grandfathered-in with the current status. It
would be very helpful to the neighborhood if the co-owners of El Pantano Plus would
purchase the adjoining vacant lot for parking. If so, there would be a drive-through so that it
wouldn t be a dead end parking lot. Mr. Mandell has a concem about the parking. T'he
neighborhood has had a lot of complaints about patrons parking on the street in the residential
neighborhood. He is also concerned about whether they plan to have any open doors to the
back/have an outdoor sidewalk restaurant. Any parking would need to be screened
effectively. There has also been an issue with trash; and the neighborhood is concemed about
security. Signage must be approved by both the City and the Capitol Area and Planning
Board. Mr. Mandell is also concerned about the posters that say, "Diva Night." T'he poster is
in Spanish and from the suggestive pictures, it leads him to believe that there is a concern
about whaYs going to go on in there as far as entertainment is concemed.
Ms Vang gave the co-applicants time to respond to Mr. Mandell's concerns. Mr. Hoang
replied that they are planning to buy the adjoining lot for parking but they are waiting to see
whether or not it could be zoned for commercial parking. Ms. Vang asked what they could do
to create a buffer if they could not purchase the adjoining lot for parking. Mr. Mandell
responded that they want to make sure that no outside walls would be opened-up or doors
opened. Ms. Leon-Beltran added that they are also working on a plan to rent the parking lot
from the clinic across the street; there is also a Capital building that has a large parking lot that
they may be able to rent on the weekends.
Ms. Vang asked about the hours of operation once the kitchen is opened. Ms. Leon-Beltran
responded that they plan to be open from 12 noon to 1:00 a.m. They have fifteen (15) to twenty
(20) part time employees currently working on the weekends. Ms. Vang asked how many
security guards they have. Mr. Hoang replied, "Eleven (11) to fifteen (15)." They work the
whole shift.
Ms. Vang asked about exits. Ms. Schweinler stated that there is no exit on the back of the
building, only in the front and parking lot side. Ms. Vang asked about the structure of the
building in reference to noise transferring into the neighborhood. Mr. Hoang stated that it is
an old, brick building, and they already have put in soundproofing inside. He added that no
one can hear anything standing three (3) feet outside the walls. It's very solid. Ms. Vang
questioned the applicants about the placement of cameras outside the building. They replied
that they have not been installed except for one. They have met with the police department
and are aware of where the cameras are to be placed.
Mr. Mandell added that it is imperative that there be no off-site drinking; liquor must be
consumed on-site. Ms. Vang responded that the applicants did not apply for off-sale liquor.

Ms. Leon-Beltran added that patrons are not allowed to take any drinks outside of the bar.
Staff personnel and security personnel have been trained.
Ms. Vang asked if the applicants intend to create a sidewalk service azea. The applicants
replied that they are not planning to have sidewalk service.
Tait Danielson Castillo, Executive Director, District 7 Plann;ng Council, addressed the hearing.
He referred to District 7's license review form. The information on that form was gathered at a
license review meeting held at Capitol Heights Block Club meeting. If anything happens in
that area, District 7 Planning Council defers to the Capitol Heights Block Club because they
have been a standing block club for about twenty (20) years now; they meet every second
Thursday. District 7's board has agreed that whatever comes out of that block club should
stand. They voted to recommend approval of these licenses with some condition changes and
also to recommend denial of the 2 AM closing license. The neighbors wanted Condition #5
modified: Security should be on duty at all times entertainment is provided and at least 2 hours
before entertainment begins (the neighbors were concerned that if there were a major event going
on that there would be some sort of security in case there were a waiting line); and #9
modified: The licensee shall pick up trash, litter and empty bottles and/or cans on the
premises and also between Pennsylvania Avenue and Charles Avenue, and between Rice Street and
Capitol Blvd (two (2) blocks to the east and one (1) block north and south), whether on public or
private property, at least on a daily basis. Actually, most of the parking goes back three (3)
blocks. Some neighbors wanted to go further — this is a compromise. Mr. Danielson Castillo
stated that the manager of the club was at the meeting and today's hearing is the first time he's
met co-applicants, Maria Leon-Beltran and Vu Hoang. Ms. Leon-Beltran commented that they
already have staff coming two (2) hours early before an event. And, they also have a person
cleaning-up around the block. Security guards are outside to make sure that everyone leaves.
Ms. Vang asked how many employees are at work after the place closes. Ms. Leon-Beltran
answered that everyone stays unti13:00 a.m. Ms. Schweinler stated that there should be no
one in there after 2 a.m. Doors should be locked with no one inside of the building after 2:30
a.m. Ms. Leon-Beltran asked how iYs possible to get everything cleaned-up by 2:30 a.m. Ms.
Schweinler replied that it is why DSI suggests an earlier last call. Cleaning can be done in
early morning or sometime before the 9:00 p.m. opening time.
Ms. Schweinler suggested taking out the words whether on public or private property regarding
trash pick-up on Condition #9.
Mr. Mandell asked for an explanation of the current posters. Ms. Vang asked how posters are
regulated in Saint Paul. Ms. Schweinler replied that if the posters are outside, they require a
temporary signage permit; if the posters are inside the windows, there is no regulation. If,
however, the advertizing is a form of entertainment that's not covered under the license, there
is an issue. Mr. Mandell commented that the CAAPJC Board doesri t permit anything of an
"adult entertainment° nature. Ms. Leon-Beltran explained they have the following posters: 1)

°No I.D. No entrance" 2) ones for liquor; and 3) °Diva Show," which is Drag Night with no
stripping every Sunday. Mr. Mandell added that CAAPCJ also tries to control temporary
signage, so they need to be contacted before any ads are put up. Ms. Schweinler stated that
currently, Ei Pantano's windows are covered more than 30 percent. The applicants disagreed.
Ms. Vang may add a condition stating that windows are not to be covered more than 30
percent. Mr. Danielson Castillo said that he is a little concemed about over-crowding the
conditions. If there are laws already in place, maybe a condition is not needed. He is already
concerned about enforcement. Mostly, enforcement comes from the police department on
these.
Regarding the 2 AM closing, Mr. Danielson Castillo stated that the main problem is parking
because people are parking all over the neighborhood, they are likely to bring disturbance and
litter, etc., to wherever they are parked. The neighbors are asking that the latest they should
be disiurbed is 1:00 a.m. so that the people living in the neighborhood can get their sleep. A 2
AM closing just doesn't make sense to the neighborhood. A last call at 12:30 a.m. and
everyone out of the establishment by 1:00 a.m. is what the neighbors, the district and DSI is
asking for. Ms. Schweinler added that a 2 AM closing will be denied. Patrons need to be out
by 1:00 a.m.; staff out by 1:30 a.m. DSI will re-visit this case after the summer (September
2009) to see whether things improve; a permanent parking lot may ease the problems in the
neighborhood. Ms. Schweinler added that DSI's concern lies in this business being a"last call
bar," which means that people will come from 1 a.m. closing bars to this one. People who
have already been drinking or may have been kicked-out of another bar will end up at 586
Rice Street which causes even more problems for the neighborhood. Mr. Danielson Castillo
added that people dori t always leave right away but go and party by their cars. He thinks
that the neighborhood would be OK with the 2 AM closing being re-visited in September.
Mr. Hoang stated that closing earlier would hurt their business a lot. Ms. Schweinler
commented that if the business has a quiet summer, they could again ask for a 2 AM closing.
Mr. Hoang said that since they're opening at 9:00 p.m., people dori t show up until 10:00 p.m.,
10:30 p.m. or 11:00 p.m. Closing an hour or so after they come doesri t make sense. Ms.
Schweinler suggested that they open earlier and close earlier during this summer. From the
police reports that DSI is getting, the place is a last call bar. DSI is not recommending approval
of the 2 AM closing.
Ms. Vang asked whether they plan to have entertainment only on the weekend. Ms. Leon-
Beltran responded that she is not concerned about having a lot of people during the week; so,
entertainment will be only on the weekends. Fridays and Sundays dori t draw many people;
Saturday brings in a lot.
Mr. Danielson Castillo noted that this bar hasri t yet proven itself. He added that they may
have had the opportunity to talk to neighbors about trusting if they had shown up at the
neighborhood meetings or returned calls made to them when setting up those meetings.

Given that no trust has been built up between the applicants and the residents, it may be
difficult for the co-applicants to be granted a 2 AM closing which partly played a big part in
their decision to deny the 2 AM closing. The fear and distrust of the neighborhood is greater
right now than what happens to the business. In order to get their manager to come to a
meeting, Mr. Danielson Castillo had to knock on the door at 586 Rice Street. He had called the
number on the license application four (4) times; twice in Spanish, twice in English. No one
returned the calls. The applicants need to prove to the residents that they can operate in a way
that is not too disturbing to the neighborhood and maintain some kind of accountability to the
residents. The bar is located inside a residential neighborhood and needs to be kept in mind
while in operation. Originally, this building was a warehouse; then, it became a bowling alley.
Now, it's a bar with entertainment and many more people can fit into it. He asked about the
fire capacity of the building. Ms. Schweinler did not know the exact number. Ms. Leon-
Beltran responded that they have approximately 500 people there on Saturday nights. Mr.
Danielson Castillo estimated that meant at least 200 cars without a parking lot that end up in
the neighborhood. The neighbors are OK with the applicants having a bar there but they are
not OK with 200-300 people spilling into the neighborhood at 2:00 a.m. They would rather see
that happening at 1:00 a.m. Ms. Vang said that the summer will be a trial period for the
applicants to show the residents that they understand the neighborhood's concerns.
Ms. Vang reviewed the letters of objection/concern. Concerns raised: trash, litter, broken
bottles, increased vandalism, cars parked on private property, residents' cars and patrons' cars
being damaged, cannot park in front of own house, graffiti, El Pantano Plus' patrons fighting
on Winter Street, customers leaving at 3:00 a.m. turning up the volume on their car stereos,
radios, urinating outside peoples' houses, beer cans/bottles left on the street and in peoples'
yards, opened doors to the club, cars broken into, fear of retaliation for reporting complaints;
this bar is not an asset to the neighborhood and it does not fit into the neighborhood. Ms.
Vang stated that not all of these concerns can be completely attributed to El Pantano Plus but
the City would like the owners/applicants to play a more responsible role. One way to help do
that is by ensuring that El Pantano Plus will close at a reasonable hour. She encouraged the
applicants to agree to a 12:30 a.m. last call, close by 1:00 a.m. and everyone out by 1:30 a.m.
with a revisit in September.
Mr. Huang stated that he has already explained how the earlier close would hurt their
business.
Mr. Danielson Castillo asked if this would go to a law judge if the applicants did not agree to a
12:30 a.m. last call. Ms. Vang responded in the affirmative that she would make that
recommendation. 1VIr. Castillo added that if this goes to a law judge, District 7 Planning
Council will probably push for denial of the 2 AM closing license forever; not re-visit it in
September. The district may even try to deny all the applied for licenses if it goes to a law
judge, especially since there's a trust factor that the neighbarhood and district are worried
about.

Ms. Schweinler said that first this will need to go to the City Council; the Council can refer it to
the law judge. If the applicants do not agree to a 12:30 a.m. last call, they can make their case
before the City Council.
Ms. Vang reiterated that the applicants have until September to establish trust with the
neighborhood. At which point, they may seek the 2 A.M. license again.
The applicants agreed to a 12:30 a.m. last call with the revisit in September.
Ms. Vang will recommend approval with the following agreed-upon conditions:

personnel will ensure that patrons do not leave en masse but rather management
and security will encourage patrons to leave in an arderly and controlled manner
between 12:15 a.m. and 1:30 a.m.
2. The licensee will provide and maintain working video surveillance cameras and
equipment to recard activity on these premises prior to issuance of the license
and in accordance with Saint Paul Police Department (SPPD) recommendations.
Tapes and recordings must be maintained for a minimum of thirty (30) days, and
there shall be an employee on-staff at all times during business hours with the
ability to make them immediately available to the SPPD and/or the Department
of Safety and Inspections (DSI) upon request.
3. Exterior lighting must be maintained and adequate to support the
camera/security equipment.
4. Doars and windows must remain closed during the time that entertainment is
offered. Management will monitor sound levels of music to insure that
neighbors are not disturbed by loud noise levels or bass vibrations.
5. Security personnel shall be on duty at all times entertainment is provided.
6. Security personnel shall be assigned to each entrance starting at 9:00 p.m. and
remain until all patrons have left the licensed premises, which include the
parking lot(s). Securiry personnel shall "wand" (using a metal detector) each
patron and check all handbags and packages carried by patrons. Security
personnel shall verify the age of patrons by checking state or federally issued
identification cards (no picture I.D., no entrance). Customers re-entering the
establishment shall be subject to the same securiry measures as customers
entering the establishment for the first time.
7. Adherence to Strict Identification Requirements: EI Pantano Plus will require
proper picture identification from anyone who appears to be younger than thirty
(30) years old. Those without proper identification shall be denied entrance.

8. 'T'he license holder is responsible for the behavior of all persons on the licensed
premises, which includes persons inside the establishment and outside in the
parking lot(s). Behveen 9:00 p.m. and 1 hour after closing, security/staff will
patrol the parking lot(s) to monitor lot(s) far patron behavior of that would
disturb the neighbors.
9. The Iicensee shall pick up trash, litter and empty bottles and/or cans on the
premises and also between Pennsylvania Avenue and Charles Avenue and
between Rice Street and Capitol Boulevard on a daily basis.
10. Licensee will maintain a list of patrons who have been banned from the
establishxnent for assaultive, disarderly or disruptive behavior. The list must, at
a minimum, contain the names and descriptions of banned patrons, as well as the
date they were advised they were banned. No persons who are on the list shall
be permitted to be in the establishment ar remain on the grounds. This list will
be made available upon request to the SPPD or DSI.
ll. The license holder will not allow anyone under the age of eighteen (18) to enter
the establishment except in accordance wifih Minnesota State Statute 340A.503(4)
and Secfion 409.08 of the City of Saint Paul Legislative Code. Events held for
individuals under the age of twenty-one (21) require a special permit from DSI
and require that such events are held in a portion of the establishment where
liquor is not permitted, consumed, sold or served. The licensee shall be
responsible for ensuring that individuals under the age of twenty-one (21) who
attend such events can not gain access to an area where liquor is sold, served,
permitted or consumed.
12. The licensee shall comply with applicable provisions of the City Health Code and
obtain approval from the DSI Environmental Health inspector for any food
served inside the establishment.
13. Any remodeling of this facility must be reviewed and approved in writing by
DSI prior to beginning a project.
Ms. Schweinler stated that the applicants will need to renew, on a prorated basis, the existing
license.
Mr. Danielson Castillo asked when the old license expires. Ms. Schweinler responded, "May
31, 2009."
