5 WHEItEAS, the Legislative Hearing Officer recommended denying the appeal and granting an extension
6 for six (6) months for the egress windows in both units.

8 WHEREAS, on June 16, 2009, the Legislative Hearing Officer reviewed the records and recommended
9 granting a variance for each of the affected windows based on a change in policy by the Department of
10 Safety and Inspections in May 2009.

12 THEREFORE, BE IT RESOLVED, that C.F. #09-169 be amended to grant tY�e appeal for the egress
13 windows in both units for property at 870 Third Street East.

The appeai on this address was heard on January 20, 2009, and Ms. Moermond's
recommendation was that the appeal be denied and a six month extension granted for bringing
the egress windows into compliance. Based on the change in policy in May, Ms. Moermond
recommended granting a variance for each of the affected windows.
