WHEREAS, She ' Eriksrud s submitted an application on behalf of Macy's at 411 Cedar Street for an
exception to the general hours peration for the pedestrian skyway system. That application requests an exception
to the general hours of operation for the portion of the skyway system leading from bridge number 16, requesting the
building to have the hours of 10:00 a.m. to 7:00 p.m. Monday through Saturday, and 12:00 p.m. to 5:00 p.m. on
Sunday;and
WHEREAS, Chapter 1A011(b) of the Saint Paul Legislafive Code give the Council the power to grant such
exceptions; and
WHEREAS, Macy's is a department store and the pedestrian skyway system is through the store with no
barrier between the easement area and the merchandise; and
WHEREAS, store is intended to be closed outside of the proposed liours; and
WHEREAS, the Skyway Advisory Committee considered this application and recommended approval of the
proposed hours; and
WHERLAS, the Council may reconsider the exception to the general hours if the circumstances change; and
WHEREAS, the Council held a public hearing on the application for an exception on January 7 2009 at
which time the Council heard a recommendation from the Department of Safety and Inspections, the applicant was
given an opportunity to speak, and public testimony was allowed; now therefore be it
RESOLVED, that the Council hereby finds that the proposed hours of operation are reasonable for the
above-stated reasons and approves the alternate hours of 10:00 a.m. to 7:00 p.m. Monday through Saturday, and
12:00 p.m. to 5:00 p.m. on Sunday; and be it
FURTHER RESOLVED, that the Council may reconsider the exception to the general hours of operation if
the circumstances that gave rise to the exception change.
A copy of this resolution, as adopted, shall be sent by first class mail to the app]icant.

The Skyway Advisory Committee ("the Committee") held a community meeting on January 6, 2009 on Skyway
Hour Variance Application number thirteen, The meeting was publicized through flyers placed in residential and
commerclal buildings and e-mails to over 400 residents, building owners, building managers, and downtown
workers. Four people attended the meeting.
First the applicant, Sheri Erkstrand of Macy's, made a presentation. After the applicant had presented their
case, the floor was opened for comment, after which the applicant was given time to respond. A total of two
people commented on the application. The Committee discussed the Application, after which the Committee
voted on the Application.
John Mannillo, of the Skyway Advisory Committee made the following motion, which was seconded by Bill
Thurmes. Motion: The Skyway Advisory Committee approves the application with the understanding that there
is no plan to reduce hours further, and that if the store hours expand, the skyway hours will expand. The motion
was passed unanimously.
