This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That upon compliance by the permittee with the conditions hereinafter set out, the Commissioner of Public Works is authorized to issue a permit to American Hoist and Derrick Company, a corporation, to install a 1,000 gallon capacity gasoline storage tank on the northwest corner of Livingston Street and Fairfield Avenue, said storage tank to be 19 feet west of the west property line of Livingston Street and 5 feet south of the north property line of Fairfield Avenue. The conditions are as follows : 1. Said permittee shall furnish a bond of $10,000 to the City of Saint Paul, conditioned to save said City harmless from any and all liability, judgments, suits, costs , charges, damage or expense accruing to person or property, arising out of the construction, maintenance, use, presence, or removal of said gasoline storage tank. Said bond shall be satisfactory to the Commissioner of Finance as to surety, to the Corporation Counsel as to form and execution, and shall be filed with the City Comptroller. 2. Permittee shall file plans and specifications for said installation with the Commissioner of Public Norks, which shall be approved by said Commissioner, and such installation shall be under the supervision and subject to the direction of said Commissioner of Public Works and to the satisfaction of the Commissioner of Public Safety. Permittee shall fn1:ly reimburse the City for all costs and expenses of said City on account of inspection and supervision. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. Tews Chief Engineer Department of Public Works Court House Dear Mr. Tews: In regard to the application of the American Hoist & Derrick Company for permission to install a one-thousand gallon underground gasoline storage tank in the boulevard immediately south of their power plant at the South- west corner of Livingston and Fairfield Avenues. We have investigated the foregoing and report that the location of this tank would be in the boulevard between the building and the curb. There is no sidewalk on this side of Fairfield Avenue. The inside of the tank will be at least five feet from the building line and gasoline would be drawn off at the top with no gravity feed. It will be buried two feet uM.erground with earth covering. I do not believe that this would increase the fire hazard to any great extent, therefore, we will approve the installation and will you please issue the necessary bond to protect the city as this is on city property. I will issue the necessary gasoline tank permit from this office.
