09-671Return copy to: bn OFS Real Estate Section 1000 City Hall Anneg l� Council FIle #�—{p� ` Green Sheet # 3071480 Presented by RESOLUTION SAINT PAUL, MINNESOTA 2 WHEREAS, on 7uly 16, 2008 the City Council approved Council File Number 08-763, a Final 3 Order authorizing acquisition of right-of-way easements necessary for the reconstruction of 4 Payne Avenue between Bush Avenue and Edgerton Street; and WHEREAS, the City has secured an agreement for the purchase of a temporary easement on, over, under and across a parcel of land whose address is 690 Edgerton Street; and 10 11 12 13 14 15 16 17 18 19 20 21 22 WHEREAS, the City has agreed to pay Eight Thousand and 00/100 Dollars ($8,000.00) for said easement, this being a fair and reasonable value as determined by an appraisal and negotiated and agreed to between the City and property owners; and WHEREA5, the acting Valuation and Assessments Engineer has recommended purchase of said easement at the agreed-upon value, plus other considerations as outlined in the Purchase Agreement attached hereto as Exhibit A; NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby approve said Purchase Agreement and accept said temporary easement in a forxn and content substantially as set forth in Exhibit B attached hereto; and further authorize and direct the proper city officials to pay the property owners the above-listed amount, said sum to be charged to Activity Code CPL C08-2E032-0789-00000.
