An ordinance providing therefor and subject to f ^ certain provision,—
certain provisions, terms, and conditions therein ex
pressed, granting several separate Permits for connec-
tion of several separate parcels of real estate situate
in the Village of Maplewood, County of Ramsey, State of
Minnesota, and therein particularly described, with
the public sewer system of the City of Saint Paul for
drainage and disposal of sanitary sewage originating in
such subject real estate. This is an emergency ordinance
rendered necessary for the preservation of the public
peace, health, and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That in each case listed in the Permit Schedule
hereinafter contained, subject to the applicable provisions, terms, and
conditions hereinafter set forth, the designated permittee hereby is
permitted ane authorized, at such designated permitteet separate cost
and expense, to construct, install, maintain, and operate a house sewer
service connection, to be approved by the Commissioner of Public Works of
the City of Saint Paul, connecting the designated permitee's parcel of
real estate, the description whereof is set forth opposite the designated
permittee's name in the said Permit Schedule, situate in the Village of
Maplewood, County of Ramsey, State of Minnesota, with the public sewer system
of the Cityof Saint Paul for the drainage and disposal of sanitary sewage
originatinglin the subject parcel of real estate.
section 2. That the provisions, terms, and conditions hereof, in
respect of the several designated permittees and the several parcels of real
estate listed in said Permit Schedule, shall be separable and in each case
the designated permittee, as a condition precedent to the exercise of such
granted permission and authority, shall pay unto the City of Saint Paul
the sum which shall represent the equivalent of x'.5.00 per frontage foot of
the subject real estate, for the entire frontage of the same as listed in
said. Permit Schedule, such sum being deemed in lieu of items of taxes and
special assessments on account of sewer service which ordinarily attach in
comparable cases to rel estate situate within said City' s corporate limits
end distinguishable from sewer rental charges. That upon such payment, in
each scheduled case, and not prior thereto, the designated permittee shall
become entitled. thereto and shall be granted a City of Saint Paul permit for
the construction, installation, maintenance, and operation, by and at the
separate cost and expense of such designated. permittee, of such house sewer
service connection for the aforesaid limited purposes. That the following
is the aforesaid Permit Schedule containing under appropriate column headings the des-
ignation of each permittee, the description of his subject parcel of real
estate, and the frontage of the same for the application of said frontage
rate:

Section 3. That , in each such case, the granted
privileges and imposed obligations hereunder, respectively,
shall inure to the benefit of and be binding upon the desig-
nated permittee, or his successor in interest, and shall
run with the land. That in each such case the designated
permittee or his successor in interest, within ninety (90)
days next after the passage of this ordinance, by written
instrument shall accept this ordinance and covenant to comply
with all applicable provisions , terms , and conditions of the
same, and file such written instrument with the City Clerk,
and thereupon and upon the payment hereinabove specified to
be made by said permittee to the City of Saint Paul, the said
Commissioner of Public Works hereby is authorized to issue
to the designated permittee or his successor in interest , a
City of Saint Paul permit for the subject sewer connection;
and that each such permit shall be subject to all applicable
provisions , terms , and conditions of this ordinance and
further subject to the applicable provisions, terms , and
conditions of City of Saint Paul Ordinance No. 8831, as amended,
particularly Sections 6 to 14 inclusive of said latter ordinance.
Section 4 . This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health, and safety.
Section 5. This ordinance shall take effect and
be in force upon its passage, approval, and publication.
