WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before December 1, 2008,
the following are the now lrnown interested or responsible parties far the Subject Property:

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated February 17, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subject Property by March 19, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to consritute a nuisance condition; subject to demolition; and
WIiEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tune, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, May 26, 2009 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,

this structure in accordance with all applicable codes and ordinances, or in the altemative by
demolishing and removing the shucture in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days a$er
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June
17, 2009 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Qrder concerning the Subject Property at 402 AOPE STREET.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s}.
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with a11 applicable codes and ordinances, or in the alternative by demolishing
and removing the shucture in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
r.r......,��c�� thirtv-sig (361 months after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Departrnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul sha11 remove and dispose of such property as provided by law.
It is fiuther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

SUMMARY FOR PUBLIC HEARING

The building is a two story, wood frasne, multi-family dwelling, on a lot of 4,792 square feet.
According to our files, it has been a vacant building since July 24, 2008.
The current property owner is Mtglq Investors Lp1Co Avelo Mortgage LLC, per AMANDA and
Ramsey County properry records.
The city has had to board this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2008.
There have been four (4) WORK ORDERS issued for:
- Boarding
- Removal of tall grass and weeds
On January 22, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on February 17, 2009 with a compliance date of
Mazch 19, 2009. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees aze paid.
TaYation has placed an estSmated market value of $60,000 on the land and $210,000 on the
building.
As of March 9, 2009, a team inspection has been completed.
As of May 18, 2009, the $5,000.00 performance bond has not been posted.

On January 22, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.

As first remedial action, a Code Compliance Inspection must be obtained from

This buiiding(s) is subject to the restricrions of Saint Paul Ordinance Chapter 33_03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame, four-plex and its oversized, single stall, wood frame,
detached garage.
1. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanabte throughout the
bathroom and seal around the edges and fixtures.
2. Lack of Electricity. Immediately restore electrical service. Failure to provide
proper electrical service will result in these premises being declared Unfit for
Human Habitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension cord wiring is not permitted while
the power is off.
3. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perforni a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
4. Lack of Natural Gas Service. Immediately restore natural gas service. Failure
to provide natural gas service will result in these premises being declared
Unfit for Human Habitation and ardered vacated for lack of this basic facility.
5. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
6. The interior ceilings are defeetive. Repair all ceiling defects and finish in a
professional manner.
7. The interiar walls are defective. Repair aii wall defects and finish in a
professional manner.
8. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harbotages in
the yard areas. Tuckpoint the foundafion if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.

10. Lack of Water Service. Tmmediately restore water service. Failure to provide
water service wiil result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
I 1. The window andlor door screens are missing, defective or in a state of
disrepair. Provide praper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
12. The windows andlor storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may he
required.
13. 'I`he chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
14. The eaves and soffits are in a state of disrepair or deteriorafion. Repair a11
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Pernut may be required.
15. The exterior walls andlor trim of the house and(or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
16. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
17. DBFECTIVE STAIRS. Stairs aze broken, defective, or in disrepair. Repair in
a professional manner.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by March 19, 2009 the Department of Safety and
Inspections, Division of Code Enfoxcement, will begin a substantial abatement process to
demQlish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taYes as a special assessmenY in
accordance withlaw.

the repairs required by this order and compliance with preservation guidelines. Copies of the
b idelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from Yhe HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-907$_
As an owner or responsible party, you are required by law to provide full and com�lete
disclosure of this "Order to Abate" to all interested parties, a11 present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolifion and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office,
If corrective action is not taken within the time specified in this order, the EnforcemenT Officer
will notify the City Council that abatement acrion is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what aetion if any, it deems appropriate.
If the resolution oalls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action
is not taken within the speeified fime, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

David Krco, attomey with Beisel & Dunlevy, appeared on behalf of his client, Avelo Mortgage
LLC, the loan servicer for Mtglq Investors Lp/Co. Laurie Macko, realtor with Keller Williams, and
Craig Oswell, Engineer with Ulteig, also appeazed.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, aparhnent building on a lot of 4,792 square feet and had been vacant since July
24, 2008. A code team inspection had been done on March 9, 2009, the vacant building registration
fees were current, and the $5,000 performance bond had not been posted. On January 22, 2009, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on February 17, 2009 with a
compliance date of March 19, 2009. To date, the property remained in a condition which comprised
a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market
value of the land to be approximately $60,000 and the building to be $210,000. Real estate taaces
were current. Code Enforcement estimates the cost to repair the building to be approximately
$75,000 to $95,000. The cost for demolition was estimated to be approximately $9,000 to $11,000.
There had also been six summary abatetnents issued to this property since 2008, four of which went
to work order: to secure the building and the City had to board the building to secure it from
trespass, boarding, and cut tall grass and weeds. Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1889; however, there was no original pernut so she was unsure of the actual date, and it was a
modified Italianate-style building. She said it was located in the Dayton's Bluff Historic District,
had been surveyed in 1989 and was considered a contributing property to the neighborhood. She
said that the porch had been enclosed with a permit being pulled in 1910 which she believed was an
attempt to transition the building into a Queen Anne-style building. She said she believed the
building was originally a single-family home. She said that if the recommendation were to
demolish the building, she suggested this property should be forwarded to the HPC for review.
Mr. Krco stated that the Bank was not in the business of rehabilitating properties and ideally, they
would like to sell it to someone who was qualified to do the rehabilitation. He said he understood
that since the building was a Category 3 vacant building, the Bank was prevented from selling the
property.
Ms. Macko stated that when she had been at a previous legislative hearing, she understood the
Council was looking at passing legislation allowing the transfer of titles of category 3 vacant
buildings to non-profit groups. She asked whether this ever succeeded.
Mr. Magner responded that the ordinance had passed and that a Bank was required to work with the
HRA who would then work with a non-profit to see if there was interest and funding to be able to
rehab a proeprty. He said that in this case, Dayton's Bluff Neighbarhood Housing Services
(DBNHS) wouid be the entity they would need to work with after contacting the HItA.
Mr. Oswell stated that he and Mr. Krco had gone through the building and he presented an
engineering report of his findings. Ae said the building suffered significant damage and he believed

it would take more than the City's estimated cost of $95,000 to rehabilitate the building. He

district and there would be preservation considerations to take into account in the rehab as well.
Mr. Magner stated that there were also zoning considerations to take into account as well. The
building was zoned multi-fanuly; however, the lot size was non-confornung. He believed a four-
unit building would likely be required to be de-converted to a single-family dwelling particulazly
given the history of problems at this property because of the over-occupancy of the building.
Ms. Spong also suggested to Mr. Krco that he contact the Dayton's Bluff Community Council and
meet with their vacant building committee. She said they had assisted in saving other vacant
properties that had historic value to the neighborhood.
Ms. Moermond stated that given the historic nature of the property, it was her desire to exhaust all
options towazds saving the building. She recommended continuing the Legislative Hearing to July
14 and the Council Public Hearing to August 5 in order far Mr. Krco to work with the HRA and
DBNHS.

residence noted above.
ASSIGNMEN`T
Ulteig Engineers has been retained to provide a structural condition xeview and assessment of
the condemned residence located at 402 Hope Street in St. Paul, MN, as directed by Laurie
Macko of Keller Williams Integrity, the realtor for the property.
BACKGROUND
The structure is a two-story four-unit residence with a full basement and an unoccupied partial
attic space buiit into the roof framing. The foundation is constructed of stone with several
courses of masonry atop it. The above-grade struchzre is wood framed, with the roof being
hand-framed. The structure appears to have been bufft around the turn of the 19�' century and
has been added onto at least three times. The structure is reportedly listed on the historic
register of district HPL-DB as building number RA-SPC-2230.

It is our understanding that the bank foreclosed on the residence last year and that it has sat
vacant since. Keller Williams Integrity is acting as the realtor for the bank. At some point, the
City of St. Paul issued a condemn notice (class 3) on the structure and then provided the realtor
with an itemized correction letter dated March 9, 2009. Contained in this letter are numerous
items found deficient by the City during their inspections, ranging from structural and
landscaping to mechanical and electrical.
Keller Wiliiams and the bank have requested an independent structural review of the
building's condition in xegard to the City's letter comments.
OBSERVATIONS
1. A site visit was performed by Craig Oswell, PE of Ulteig on May 18, 2009. The site visit
consisted of a visual wallc-through, observing the exposed elements and those accessible
without the removal of finished materials. The following items were noted:
a. What appears to be the original portion of the structure is approximately 30 feet
square and has two full stories plus a space contained with the hand-framed attic.
A porch structure has been added along the front of this section extending out
approximately eight feet. The structure has had two additions on the rear, each
two stories in height, but progressively smaller in both width and height. The
first is approximately tcventy feet long and the second is about ten feet. This
makes the entire structure about 68 to 70 feet long.
b. The floor framing at each level spans in the short direction from a centerline
bearing wall and basement beam line to the outer walls. The framing at the upper
levels could not be observed, but the first floor fraxning is 2x8 at 16" on center in
the original struchzre and then 2x6 at 16" on center in the middle portion
progressively getiing short uniil they are 2x4`s at the rear section of the building.
Overall, the joists appear to be in good condition, however they are sagging
noticeably and deflect when walked on.
c. The center beam line in the basement is comprised of a 6x6 timber which is
supported by steel pipes and tunber posts at about six to eight feet on center. The
beam is shiiruned at several of the posts and is severely checked at the rear
portion of the structure.
d. The basement clear height is approximately 6'-8", with the clear at the centeriine
beam being less as it is a dropped beam. The foundation walls are built of
plastered stone to a height of about 5'-6°, than are masonry above that. The stone
appears to be 12" to 16" thick, while the masonry is either 8" or 12" thick. The
floor joists are grouted/mortared in place atop the foundation wall.

e. T4ie exterior gzade is about flush with the top of the stone foundation. Several
cracks aze noticeable in the foundaHon, but they appeaz to be cracks in the plaster
coating rather than the walls themselves.
f. There are several small windows in the basement, one of which is located under
the porch addition. These windows are in the masonry portion of the walls.
There is also an exterior stairwell and door opening on one side at the middle
portion of the structure, but it is boarded over and is not in a usable condition.
g. The floor slab appears to be a skun coat of concrete and is in poor condition, being
broken, uneven, or exposing dirt at most locations.
h. The roof and floors show signs of water infiltration at several locations, with some
ceiling openings found exposed directly to the building exterior.
i. The wall framing could not be directly observed, but no significant out-of-plumb
or distressed wall areas were noted. The window headers appear to be very small
or non-existent at most locations.
j. A wood framed exterior stairwell exists on the back wall of the structuze to the
upper level. This stair is in very poor condition.
k. The wiring and mechanical systems observed appear to be in severely damaged,
rusted, and(or distressed.
COMMEI3T5
2. The following comments are made in regard to the noted conditions:
a. Overall, the structure appears to be in a sound and stable condition. However,
several items within it do not meet current Code requirements and are either
distressed or inadequate enough to warrant attention.
b. Despate being in relatively good condition at het observable areas, the floor
framing in particular at each level is severely undersized for its span and will
require corrective measures. The first level could easily be fixed by jacking and
installation of additional bearing beams in the basement, while the upper levels
would have to be exposed and sistered with new members.
c. The center beaan line and severai other framing conditions throughout the
structure require corrective measures. These items are minor enough that a
competent carpenter could likely perform the work with little difficulty or
direction.
d. The exterior rear stairwell should be removed and reframed if required. It should
aiso be placed on adequate frost footings if rebuilt.

e. The overall foundation and wall framing appeaz to currentiy be sound and stable
and likely would not need significant attention if left unmodified. Should the
basement's height or the exterior soil conditions be modified, further review may
be required.
f. The front porch addition is severely sloping down away from the structure. It
appears likely that this porcKs foundation is not frost protected.
g. Given the condition of the basement slab and the potential need for additional
footing pads to support posts, it should be replaced. However, given the tight
margin to an allowable 6'-8" ceiling clearance, the bottom of the new slab would
likely have to be installed at a slightly lower elevation than the existing.
h. The drainage around the s3te and the condition of the roof are allowing water to
directly enter the structure. There is evident warping and staining of the wall and
floor coverings. There also appears to be a high likelihood of mold being found
behind the coverings throughout most of the structure. A majority of the wall
coverings should be removed to search for and remediate mold, as well as any
distressed or rotted framing members which may be hidden.
i. The hand-framed roof inembers are currently stable, but appear to be severely
rotted by water infiltration and age. The roof inembers are sheathed on the
exterior by the original planking plus a layer of plywood, however gaps exist
between the planknlg and these were not covered at the vaileys and ridges,
allowing water to d'arectly enter the structure. Given the nature and condition of
the current hip and valley hand-framing, it is likely that any modification or
change in loading to the roof will make significant corrective measures of the roof
framing required.
j. It is also possible that asbestos could be found in the structure as well and its
presence should be determined and addressed before significant work takes
place.
k. We could not find any record of this structure or its number being on the national
or state historic registry. If it is true that it is, the recommendations made below
may require approval or modification before being implemented.
RECOMMENDATIONS
3. Based on our understanding of the project and the noted conditions, we make the
following recommendations:
a. The basement slab should be removed and replaced.
b. The basement interior and exterior stairwells shouid be modified and/or repaired
to allow for safer and more stable access.
c. The centerline support beam should be replaced or reinforced.

d. The support posts and cohimns should be repiaced, modified, or reinstalled so
that they aze in flush solid contact with their supported members and bear on a
adequate and stable footing.
e. The floor framing at each level should leveled, then be supported or sistered by
new members so that the framing is adequate for its final in-place span and
loading.
f. The rear stairwell to the structure should be removed and replaced if still needed.
It should be framed adequately and bear on frost protected footings ox piers.
g. The front porch should be removed from the structure and the wall openings to it
in-filled and supported as required.
h. The roof framing should be significantly modified or removed and replaced such
that it is adequate and can support the loads of both snow and future reroofing
work that is required.
i. Gutters and downspouts, as weli as swales, catch basins, or other surface
drainage elements, should be instalied around the structure to direct water away
from the foundation.
j. The structure should be invesiigated thoroughly for the presence of mold and
asbestos with remediation implemented as required. This work should be
performed by a professional company trained and competent in work of this
kind.
k. Any other member distresses or non-standard framing conditions found through
the course if the above work should be addressed as needed by a competent
carpenter, with the assistance of an engineer being involved when appropriate.
BISCUSSION
4. In our opinion, the cost to perform these corrective measures, including engineering
costs, will range between $90,000 and $100,000. These figures do not account for
addressing mechanical, electrical, and other issues that the structure may have. It is our
understanding that Keller Williams has received complete demolition bids at around
$30,000. We recommend that Keller Williams and the bank review the profit margin
available to them in their options, accounting for any historic registry issues, before
making a final decision to repair or demolish the structure.

PROFESSIONAL OPIAiION
5. It is our professional engineering opinion that:

a. The residence is currenfly stable, but it is in an unsound and continually
worsening condition which requires adequate corrective measure action be taken
should the structure continue to remain unsupervised.
b. The structure should remain condemned until the floor systems have been
adequately repaired and all necessary mechanical, electrical, and fire safety
systems have been brought into compliance with the City's requirements.
c. A majority of the shuctural issues are minor in naiure, but due to the size o£ ihe
structure, the cost to remedy them will likely become large.
d. If the structure is not to be demolished and assuming no historic registry
requirements for salvage are found to exist, the simplest and least costly repair
solution may be the demolition without replacement of the most severely
distressed elements, such as the front porch, the rear stairweli, and the rear
addition.

engineering judgment and professional practice, as well as the visual inspection.

for the property had been ordered and they were in the process of working out an agreement for

responsibility for the property. He said he did not have a closing date scheduled as of yet and was
not optimistic that it would be scheduled prior to the Council Public Hearing on August 5.

Ms. Moermond stated that pending the completion of the transfer, she would grant the HRA 1$0
days to deterniine whether they wished to rehabilitate the structure or to proceed with demolition. If
they chose to rehabilitate the building, she would grant 36 months to complete the rehab.
Ms. Spong stated it was her understanding it was the desire of the HRA to rehabilitate the building.
She said the HPC had not reviewed the property and if the HRA proceeded with demolition, she
would first want the HPC to review the property and make recommendations.
Ms. Moermond stated that she would recommend granting 180 days for the HRA to determine
whether they wished to proceed with repairing the building or demolishing the building. If the
HftA determines to proceed with demolition, this matter will be referred back for anothex
Legislative Hearing.
