WFIEREAS, Depariment of Safety and Tnspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ardering the xepair or wrecking
and removal of a single story, wood frame, single family dwelling and its oversized, single stall,
detached garage located on property hereinafter referred to as the "Subject Property" and
commonly known as 1016 BUSH AVENUE. This property is legally described as follows, to
wit:
TERRY'S ADDITION TO THE CITY OF ST. PAUL, COUNTY OF RAMSEY, STATE OF
MINN. E 45 FT OF LOT 9 BLK 12
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before October 20, 2008,
the following are the now known interested or responsible parties for the Subj ect Property: Carl
P ReecklStephen J Keane, 1427 Ashland Ave, St. Paul, MN 55104; Associated Bank, NA, Attn:
Nancy Suchon, 1305 Main St., Stevens Point, WI 54481; First National Bank of Omaha, P.O.
Box 2490, Omaha, NE 68172; Dayton's Bluff District 4 Community Council.
WHEREAS, Deparhneut of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Leglslative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated February 2, 2009; and
WHEREAS, this arder informed the then known interested or responsible parties that the
structure located on tve Subject Property is a nuisance building(s) pursuant to Chapter A 5; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by March 4, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolifion; and
WHEREAS, this nuisance condition has not been conected and Deparhnent of Safety
and Inspections requested that the City Cierk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served norice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREA5, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, May 26, 2D09 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June
17, 2009 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered hy the Council; now therefore
BE TT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceining the Subject Property at 1�16 BUSH AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislatiae Code, Chapter 4S.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Buildang code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition haue not been conected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitared by Deparhnent of Safety and
Inspections, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolutian and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, heaith, safety and welfare and remove its

accordauce with a11 applicable codes and ordinances. The demolition and removal of the
shucture must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above conecrive action is not completed within this period of time Deparnnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this strucriu fill the site and charge the costs incurred against the
Subject Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, a11
personal property ar fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It as further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one story, wood frame, single-family dwelling, on a lot of 5,663 square feet.
According to our files, it has been a vacant building since April 28, 2008.
The current property owner is Carl P Reeck/Stephen J Keane, per AMANDA and Ramsey
County properiy records.
The city has had to board this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2008.
There have been seven (7} WORK ORDERS issued for:
- Removal of improperly stored refuse, garbage and misc debris
- Boarding
- Removal of snow and ice
On December 23, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condiUon was developed and photographs were taken. An ORDER TO

Inspections, Division of Code Enforcement, hereby declares the premises located at:

On December 23, 2008, a Building Deficiency Inspection Report was compiJed and the
following conditions were observed.
This list of deficiencies is not necessarIly all the deficiencies present at this time.
As �rst remedial action, a Code Compliance Inspection must be obtained from
the Suilding Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This is a single story, wood frame, single family dwelling and its oversized, single
stall, detached garage.
Interior
L The bathroom floor covering is deteriorated ar inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Lack of Electricity. Immediately restore electrical service, Failure to provide
proper electrical service will result in these premises being declared Unfit for
Human Habitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension car wiring is not permitted while
the power is off.
FURNACE: Have a licensed heating contractar service and clean the furnace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
4. Lack of Nahzral Gas Service. Immediately restore natural gas service. Failure
to provide natural gas service will result in these premises being declared
Unfit for Human Habitation and ordered vacated for lack of this basic facility.
5. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permlt May
Be Required.
6. There are missing or defective guardrails. Provide all staarways, porches,
decks or steps which are more than 30" higl� with guardrails and intermediate
rails with openings in the guardrail no more than four (4} inches apart and in
accordance with the State Building Code,
The stairs have missing or defective handraiis. Provide al1 interior and
exterior stairways and steps of more that three (3) risers with handrails wtuch
are grippable and installed 34" to 38" above the nose of the stair treads.
S. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.

— the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestarion. Immediately remove any dead rodents from
the premises.
11. SANTTATION: Immediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle patts, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.
"Tha Saint Paul Legisiarive Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
12. S�noke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
Exterior
13. The chimney as defective, deterioxafed or in a state of disrepair. Replace all
missing ar defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
14. The eaves and soffits are in a state of disrepair or deterioration. Repair a11
defeets, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
15. The faundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a pxofessional manner t� a weatl�er-right, water-tight and
rodent-proof condition. Pemut may be required.
16. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
17. STORM DOOR(S): The storm doox(s) are in disrepair; repair or replace the
door(s).
18. The window andfor door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
19. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
20. The basement flooded there are frozen pipes.

— Inspections, Division of Code Enforcement, will hegin a substantial abatement process to
demolish and remove the building(s}. The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 3ackson Street, Suite 220, (651)266-909Q. This
inspection will identify specific defects, necessary repaars and legal requirements to correct this
nuisance condition. '
If this buiiding is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms aze availab3e from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staf£ No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for tlus property, you must within seven (7) days, notify the Enforcement Officer
with tl�e naines and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placazd on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shail
not be removed without the writtea authority �f the Depafinent of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If eorrective action is not taken within the tvne speeified in this order, the Enforcement Qfficer
wzll notify the City Couneil that abate�ent acfion is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which rime testimony will be
heard from intereseed parties. After this hearing the City Councai will adopt a resolutzon stating
what action if any, iC deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this tiuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

The property owner of recard, Carl P. Reeck and Stephen J. Keane, did not appeaz. No other parties
of interest appeared.
Mr. Magner stated the building was a one-story, wood frame, single-family dwelling on a lot of
5,663 square feet and had been vacant since Apri128, 20Q8. A code compliance inspection had not
been done, the vacant building registration fees in the amount of $1,000 went to assessment on
April 29, 2009, and the $5,000 performance bond had not been posted. On December 23, 2008, an
inspection of the buiiding was done and a list of deficiencies which consritute a nuisance condition
was developed. An order to abate a nuisance building was posted on February 2, 2009 with a
compliance date of March 4, 2409. To date, the properiy remained in a condition which comprised
a nuisance as defined by the Legislative Code. Ramsey County TaYarion estimated the market
value of the land to be approximately $21,500 and the building to be $82,40Q. Real estate taxes for
2007-2008 were delinquent in the amount of $3,582, plus penalty and interest. Code Bnforcement
estimates the cost to repair the building to be approximately $40,000 to $50,000. The cost for
demolition was estimated to be approximately $8,000 to $10,000. There had also been six sununary
abatements issued to this property since 2008, seven of which went to wark order: to secure the
building and the City had to board the building to secure it from trespass, remove improperly stored
refuse and debris, boarding, and remove snow and ice. Code Enforcement recommends the
building be repaired ar removed within 15 days. Mr. Magner presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that tlus building was a
worker's cottage-style building which was close to 3M. The building lacked architectural integrity
and demolition would not have an adverse effect on the neighborhood.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
