An ordinance authorizing the University of
Minnesota to replace present 8" pipe sewer
serving existing State-owned buildings on
Saint Paul Campus by 10" cast iron pipe
sewer to serve said existing State-owned
buildings and additional State-owned Student
Center Building, thereon located outside the
City of Saint Paul, said existing sewer now
connecting and said replacement of the same
to connect said State-owned buildings, for
sanitary sewage, drainage and disposal purposes
with the public sewer system of the City of
Saint Paul. This is an emergency ordinance
rendered necessary for the preservation of
the public, peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby granted
to the University of Minnesota to replace existing 8" pipe sewer
serving existing State-owned buildingson the Saint Paul Campus by
a 10" cast iron pipe sewer to serve said existing State-owned
buildings and additional State-owned Student Center Building
thereon located outside the City of Saint Paul, said existing
sewer connecting said existing State-owned buildings and said
replacement of the same to connect said existing State-owned
buildings and said additional State-owned Student Center Building
for sanitary sewage, drainage and disposal purposes with the
public sewer system of the City of Saint Paul.
1. That the descripton of the land on which said additional
State-owned Student Center Building shall be located is the
following to-wit:
SW u of the NW u of Section 21, T 29 N, R 23 W.
The Student Center Building is approximately
427 feet East of the North-South section line
of Section 20 and 21 and 132 feet North of the
h \ u East-West line of the Center line of Section 21;
situate in the County of Ramsey and State of
Minnesota according to the United States Government

of the Register of Deeds in and for said County.

2. That all such connections to said public sewer system

direction, and in accordance with such rules and regulations
as he may from time to time prescribe .
3. That the Chief Engineer of said City of Saint Paul
shall have the right to enter upon and inspect said system
at any time deemed necessary by him.
4. That plans and profiles for said proposed sewer
shall be submitted to and shall be subject to the approval
of said Chief Engineer before the work is started.
5. That the University of Minnesota shall at no time permit
st-o n water, rain water leaders, or ground drainage water to
be directed into said sewers.
u. That the University of Minnesota shall pay to the
City of Saint Paul the following applicable amount per year
for and on account of such sanitary sewage, drainage and
disposal service hereunder for and in respect of said State-
owned Student Center Building such amount per year being
governed by the size of the water connection or meter to
said State-owned Student Center Building and set forth in
the following schedule of annual charges :

7. That the University of Minnesota shall indemnify and save
harmless the City of Saint Paul from any liability arising from
the construction, maintenance, operation, or connection or said
sewer system with the sewer system of Saint Paul.
8. That the University of Minnesota, in form approved by the
Corporation Counsel, shall execute and Dle with the City Clerk,
within the period of thirty days next after the official
publication of this ordinance, its written acceptance of the
same and covenant to comply with all provisions, terms and
conditions of this ordinance, compliance wherewith is thereby
enjoined upon it.
9. That the connection of the aforementioned State-owned
buildings, other than said State-owned Student Center Building,
to said public sewer system for such sanitary, sewage, drainage
and disposal purposes was authorized and provisions for sewer
rental or sewer service therefor were made by that certain
Resolution of the Council of said City of Saint Paul bearing
Council File No. 102481, approved December 31, 1935; and no
provision of this ordinance (in respect of any sewer rental or
sewer service charge) for the assessment of any sewer rental or
sewer service charge shall be deemed to have application to
such State-owned buildings other than such State-owned Student
Center Building.
