RESOLVED, that upon appeal of Raymond F. Luger from
the decision of the Commissioner of Parks, Playgrounds and
Public Buildings , and upon the favorable recommendation of the
Board of Zoning, permission is hereby granted, pursuant to
Ordinance No. 5840, as amended, to remodel the building at
1979 Ashland Avenue, also described as Lot 14, Block 3,
Merriam Park 3rd Addition, into three apartments, in place
of two apartments and one store, in accordance with applicant ' s
plans approved August 22, 1957.

Dear Sir:
This is in the matter of the appeal of Raymond F. Luger for special council per-
mission to remodel to three families, an existing building located adjacent to
the northeast corner of Ashland and Moore. The address is 1979 Ashland and the
property is described as Lot 14, Block 3, Merriam Park 3rd Add. The zoning is
"A" Residence.
This appeal is made pursuant to Section 20, Paragraph "o" of the Zoning Ordinance
which provides that the City Council may, in the cases of houses constructed
prior to the Zoning Ordinance, having a gross foundation area of 1,000 sq. ft. ,
authorize the remodeling of these structures to accommodate not more than four
families provided that certain findings are made with respect to the effect
which said remodeling would have on the adjacent neighborhood.
The property under consideration has a frontage of 50 ft. on Ashland, and extends
northerly a distance of 167.15 ft. on Moore. At present there is a converted store
bldg. located on the property which was constructed in 1922 prior to the adoption
of the Zoning Ordinance. This building has been used as a grocery store and two
apartments, one on the first floor and one on the second. The applicant desires
to convert the grocery store into an apartment to permit three family occupancy,
because, due to its location, the structure is no longer useable for non-Conforming
commercial purposes.
Field investigation discloses that the front of the building has been modified to
give it a residential appearance. There is also a garage for three-off-street
parking stalls at the rear of the building. The plans have been approved as to
conformance with the Building Code by the City Architect's office. In consideration
of the desirability of residential occupancy in this building as distingushed
from the commercial activities which formerly characterized the use of the site,
the Board of Zoning finds no objection to this proposal to permit three family
occupancy in this structure. If this is done, it will enable the applicants to
use this existing structure in a manner that is more in harmony with the estab-
lished character of the district than its former use.
In consideration of these factors, the Board of Zoning recommends that this
appeal be granted in accordance with the applicant's plans approved Au 22, 1957.

are not conducive to the best interests of the neighborhood.
In audition to this, as you know, a store such as this
grocery store is not lucrative and not adaptable to other
types of business.
This two story brick veneer and frame 36 ' x 36: and
/4' x 7 ' building constructed by May, 122 stands on a
50 x 167.15 level lot ana has adequate off-the-street parking
facilities including a three-car solid brick garage.
