THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Chapter 60 of the Saint Paul Legislative
Code, pertaining to the Zoning Code, Use Districts, and Re-
zoning of certain properties in the City of Saint Paul, as
amended, be and the same is hereby further amended so as to
re-zone the following described property from "C" Residence
District to Commercial District.
Lots 1 and 2, Block 78, Dayton and
Irvine 's Addition, situated at the
southwest corner of Dayton and Virginia
Avenues.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace , health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

This is in the matter of the petition of John P. Tracy to rezone from f1Cf1 Residence
to Commercial two lots adjacent to the southwest corner of Dayton & Virginia. This
property is described as Lots 1 and 2, Block 78, Dayton & Irvine's Addition. The
property is presently vacant and was formerly a portion of the site of the Aberdeen
Hotel. A parking lot permit for this site was granted in 1949. The property ex-
tends a distance of 141.5 ft. along Dayton Ave. and 116.5' along Virginia St. The
total area is 16,485 sq. ft. Eight out of twelve of the several descriptions within
100 ft. have signed this petition.
The adjacent land uses are as follows: to the south is a D-X Sunray filling station,
to the west are offices of a roofing contractor and a furniture and appliance store,
to the east across Virginia is vacant property recently rezoned to Commercial for
the Arrow Insurance Co., to the north across Dayton is an apartment building front-
ing on Virginia Street.
The applicant proposes to construct on Lot 2 a building 70.75' by 110' and to use
Lot 1 for off-street parking and as loading and unloading area. The Graybar Elec-
tric Co. is to lease this property and use it as an office and inside storage in
connection with their wholesale business. The applicant's plans call for setting
the building and parking lot back 6 feet from Dayton and to plant this area with
shrubs 3z to 4 feet in height. In addition, to improve the appearance of this
property the applicant is going to cover the north wall of the building with face
brick.
The proposed rezoning petition, if granted, will permit all of the block bounded
by Western, Dayton, Selby and Virginia to be used for commercial purposes. The
Board of Zoning feels that the site under consideration does not lend itself to
residential development. The Board further finds that adequate off-street parking
has been provided for the proposed development, that the proposed use is consis-
tant with the existing land uses in the area, and that the proposed operation
including loading and unloading will in no way conflict with public or private
interests.
In view of these consideration the Board of Zoning recommends this petition to
rezone the property under consideration from "Ct1 Res. to Commercial be granted in
accordance with the applicant's plans received January 9, 1958.

Gentlemen :
Enclosed is my petition for the rezoning of Lots 1 and 2, Block
78, Dayton 6 Irvine's Addition, with the legally required number
of signatures . Also enclosed is a certified list of property
owners within the legal distances of the property to be rezoned,
together with the preliminary plans of the building for your study.
The Arrow Insurance Company has purchased the property owned by
the Haynes Company but inasmuch as the transaction has not been
closed they are unable to sign in that space but have agreed that
they will sign if it is necessary when the hearing is held.
The building to be built is a 1-story concrete block buildin; to
be leased to Graybar Electric Company for use "in connection with
its business as a wholesaler in appliances , telephone and elec-
trical supplies , . . . ". The building will contain approximately
8, 000 feet and will be built on Lot 2. Lot 1 will be surfaced as
a parking area for the use of the customers and employees of Gray-
bar Electric Company.
It is my purpose to start construct:ion as soon as the rezoning
has been accomplished. I believe that this site which was former-
ly the site of the Aberdeen Hotel , is ideally suited for this
purpose.
Some years ago I attempted to interest the F. H.A. in insuring a
loan for the purpose of constructing an apartment building on the
site ; however, they rejected my application on the grounds that the
neighborhood was not suitable for an apartment building and there-
fore, my application was disqualified. Based on this it is my
opinion that the highest and best use of the property would be for
a Commercial type property corresponding to much of the area sur-
rounding this property.
