An Ordinance to amend Chapter 192, Saint Paul Legislative Code, prohibiting the kindling of bonfires without permit and providing for the burning of rubbish on private premises within certain hours. THE COUNCIL OF THE. CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Section 192.04, Saint Paul Legislative Code is hereby amended by striking therefrom the entire section contained therein and substituting in lieu thereof the: following: "192.01. Bonfires, Etc. No person shall kindle or maintain any bonfire or shall normally furnish the material for any such fire or authorize any such fire to be kindled or maintained on or in any street, alley, road, land or public grounds or upon any private lot unless a written permit so to do shall first have been secured from the Bureau of Fire Prevention. This shall not prohibit the burning of pnconsiderable quantities of rubbish on private premises on any day between the 3:00 P.M.,hours of to $:00 p. m. when placed and con- tained in a noncombustible container of any tyre approved by the Chief of the Bureau of Fire Prevention." --7 0 Section 2. Scannell, Chief January 28, 1957 Commissioner Peterson Dear Commissioner: Because of many complaints that come into the Fire Prevention Office and also my office on account of present burning hours , and to make it more convenient for the public to dispose of their ordinary daily accumulation of paper and household rubbish, I recommend that the hours for burning rubbish in Section 2101 of the Fire Prevention Code be amended to read: 12:00 noon to 8 :00 P.M. daily instead of the present 6: 00 to 9:00 A.M. and 6 : 00 to 9 :00 P.M. The ordinance as I recomend it is as follows: Section 1: That ordinance No . 8286 approved Sept. 4, 1941 as amended B and the same is hereb-Tfurther amended by striking out Section 2101 of Part 21 thereof and by inserting in lieu of the following: 2101: No person shall kindle or maintain any bonfire or shall normally furnish the material for any such fire or authorize any such fire to be kindled or maintained on or in any street, alley, road, land or public grounds or upon any private lot unless a written permit so to do shall first have been secured from the Bureau of Fire Prevention. This shall not prohibit the burning of inconsiderable quantities of rubbish on private premises on any day between the hours of 1.2:00 noon to 8 :00 P.M. when placed and contained in a non- combustible container of any type approved by the Chief of the Bureau of Fire Prevention. We have had no law enforcement of the present ordinance nor of the ordinance that preceded it; viz. that rubbish could be burned only between the hours of 6 to 9 A.M. In any ordinance of this type the word rubbish should be clearly defined. Certainly the burning of hugh quantities of leaves does not come under the definition of rubbish. The word bonfire should not be considered either with or without a permit from the Fire Prevention Department. In this congested area where it is possible to shake hands with your neighbor through your windows there is no place for a fire in the open air. In hot summer days one has to wait until evening to go onto the porch or into the yard for a little cool fresh air. If on all four sides your neighbors and their neighbors are burning anything, all you can do is go back into your house and close doors and windows and turn on the electric fans and read the ads about the wonderful outdoor summer life in Minnesota. Why should our city be filled with smoke day after day and night after night from April to November? You no doubt know this smoke is dangerous both to traffic and health.
