12. Appeal of Willazd Hodge to a Suminary Abatement Order for properiy at 21 Elizabeth Street
East and 16 Street East. —--- ----- -
Willard Hodge, appellant, appeared and stated that 21 Elizabeth was his residence and 16 King was
a rental property that was a vacant building.
Ms. Moermond asked for a report from Inspector Essling. Mr. Essling stated orders were issued for
21 Elizabeth on Apri121, 2009 for excessive storage of trailers and contents as well as to remove
barrels and household items from the front yazd with a compliance date of May 11, 2009. He said
that he inspected the properiy that day and found nine trailers, a boat, and a semi-trailer in the front
yud. Some were on approved surfaces; however, most were not. He said that at least seven of the
trailers had been stored at 16 King which storage was not allowed as it was a category 1 vacant
building and had been vacant since October 1, 2007. He said that he also issued orders on Apri129
to repair all rotting wood on the south-rear plywood fence and to paint the fence with a compliance
date of May 20. Mr. Essling stated that the history at this property goes back to June 2007 when it
was transferred to a case managed property. The property had extreme excessive exterior storage
and a tag had been issued. He said Mr. Hodge had been working to clean up the property and at
least 80 percent of it had been removed. He said he issued the summary abatement orders to bring
the project to completion. He also said that he did not have pl�otos of the property as he was not
able to get them off of his computer.
Ms. Moermond asked Mr. Hodge why he had filed the appeal. Mr. Hodge responded that he needed
more time. He said that he had lived at 21 Elizabeth for 22 years and had purchased King as a
rental property as it was on the adjoining lot to his property. The properties were across from
Humboldt High School and there was a hiu,� amount of traffic and a lot of dumping on his property
as a result. He said he had been in Housing Court in 2007 and had paid a$1,000 fine and had since
done a significant ainount of clean up at the property. When he received the orders to remove the
trailers on King, he immediately stopped work on Elizabeth so he could address the orders he
received on King and moved those trailers to his property on Elizabeth. He said he worked with
wood, iron and antiques and needed the trailers for storage as well as a flat surface to work. He was
also restoring a wagon which he wanted to keep in his yazd; the semi was needed to haul the stuff
out of the yard. The only thing at the King property that now needed to be done was to paint the
fence. He said he needed additional time to get the work done and asked if he could have until the
end of June. He presented pictures that he had taken of his properties.
Mr. Essling told Mr. Hodge that he could not use trailers for storage and that he could not park two
of the trailers he had on the street. A trailer had to be licensed, operable and on an approved surface
or would need to be stored in a gazage. He also told Mr. Hodge that he needed to get the King
property off the vacant building list and if he did, he could submit a site plan review for surface
parking at King.
Ms. Moermond reviewed the record and the pictures presented by Mr. Hodge. She told Mr. Hodge
that from the pictures of the retaining wall at King, he needed to realize that the retaining wall
would need to be repaired and that would need to be his next project for him to undertake. Ms.
Moermond recommended denying the appeals for both propertaes and granted an extension to June
30 to come into compliance.
