under Preliminary Order 18218 approved November 20) 1957
Intermediary Order approved
A public hearing having been had upon the above improvement upon due notice, and the Council
having heard all persons, objections and recommendations relative thereto, and having fully considered
the same; therefore, be it
RESOLVED, By the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be made by the said City is grade and surface with bituminous material the
alley in Block 3, Birminghams Park. Also construct a sewer in the alley from a point
66.36 ft. east of Flandrau St. to the center line of Flandrau St., thence north along
the center line of Flandrau St. to the existing sewer in York Ave.,
and the Council hereby orders said improvement to be made.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and submit same to the Council for
approval; that upon said approval, the proper city officials are hereby authorized and directed to pro-
ceed with the making of said improvement in accordance therewith.

The Commissioner of Public Works, having had under consideration the prelimin-
ary order of the Council, known as Council File No. 185218 approved
November 20, 19 579 relative to grading and surfacing with bituminous
material the alley in Block 3, BirminghamsPark. Also construct a sewer in the alley
from a point 68.36 ft. east of Flandrau Street to the center line of Flandrau Street
thence north along the center line of Flandrau Street to the existing sewer in York Ave.
and having investigated the matters and things referred to therein, hereby reports:
1. Said improvement is necessary and (or) desirable.
2. The estimated cost thereof is $ 6,276.83 , and the total cost thereof

is $ and the nature and extent of said improvement is as follows:
Cost per front foot $5.25 Frontage 1196.73 ft.
3. A plan, profile or sketch of said improvement is hereto attached and made

I have examined the attached petition of remonstrance in the
matter of grading and surfacing an alley in Block 3, Birminghams
Park, and wish to report as follows:
Frontage required on petition of remonstrance - 50%
738.7 feet signed for, of total frontage of
1,345.29 feet - 54%
Signatures of resident owners required - 60%
23 of resident owners signed, of total
number of 39 = 58%
As revealed by the above percentages, the petition of remonstrance
is insufficient.
