1 WHEREAS, The ' of t Paul, Department of Parks and Recreation d/b/a Harriet Island,
2 located at 200 Dr.-d��Ohage Blvd. in Saint Paul, has requested a waiver of the 45-day notice
3 requirement for issuance of a malt on sale (strong) license; and
4
WHEREAS, the West Side Citizens Organization/District 3 Community Council has agreed to the
waiver of the notice requirements; and
8 WHEREAS, the Council finds that the application is in order and there are no grounds for denial of
9 the license and that the failure to grant the waiver and the consequent delay in approving the license would
10 cause exceptional and unusual hardship to the license applicant; and
11
12 WHEREAS, the licensee agrees that in the event a complaint is received prior to the expiration of
13 the 45-day period and the complaint provides a basis for adverse action against the license, that the
14 Department of Safety and Inspections may direct the licensee to immediately discontinue all operations
15 until a public hearing is scheduled, and that the licensee shall comply with said directive; now, therefore,
16 be it,

18 RESOLVED, that the 45 day notice requirements of § 409.06 of the Saint Paul Legislative Code
19 are hereby waived a Malt on sale (strong) license is issued to The City of Saint Paul, Department of Parks
20 and Recreation d(b/a Harriet Island, located at 200 Dr. das�is� Ohage Blvd. in Saint Paul, subject to the
21 agreement stated above. Justus
