09-631Suspension 6/10/09 Council File # 09-631 Green Sheet # 3071456 LUTION OF Presented by NT PAUL, MINNESOTA 3 WHEREAS, Meafy Beat d/b/a Shamrock's Irish Nook, located at 995 W. 7th in Saint Paul, has 4 requested a waiver of the 45-day notice requirement for issuance of a liquor outdoor service azea 5 (sidewalk) license; and WHEREAS, the West 7�'/Fort Road Federation, has agreed to the waiver of the notice requirements; and 10 WHEREAS, 15 residential properties are within a 300 foot radius of licensee's proposed patio, and 11 licensee has obtained consent from 6 of those properties (40%); and 12 13 WHEREAS, licensee has sent out two mailings to neighbors and went door to door to obtain 14 signatures from the remaining residences but was unable to contact them and received no negative 15 responses to the request for consent; and 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 WHEREAS, the Council finds that these efforts constitute a good faith effort to fulfill all petition requirements, and that the results of the attempts to obtain signatures showed a generally favorable disposition from the surrounding community toward the proposed licensed activity; and WHEREAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; and WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license and that the failure to grant the waiver and the consequent delay in approving the license would cause exceptional and unusual hardship to the license applicant; and WHEREAS, the licensee agrees that in the event a complaint is received prior to the expiration of the 45-day period and the complaint provides a basis for adverse action against the license, that the Department of Safety and Inspections may direct the licensee to immediately discontinue all operations until a public hearing is scheduled, and that the licensee shall comply with said directive; now, therefore, be it, 09-631 36 RESOLVED, that the 45 day notice requirements of § 409.06 of the Saint Paul Legislative Code 37 aze hereby waived and a liquor outdoor service area (sidewalk) license is issued to Meafy Beat d/b/a 38 Shamrock's Irish Nook, located at 995 W. 7th in Saint Paul, subject to the agreement stated above. Over the last year or so, we have been attempting to receive signatures from neighbors and businesses regarding our sidewalk cafe. We have sent out two mailings to neighbors with self addressed, self posted envelopes and have received a fairly substantial number of these back. What we didn't get returned and signed, we went door to door trying to get the remainder of them. This, by which is very hard to time right. Although we received a few going door to door, we did miss some people due to them not being home from work, or maybe they were eating dinner and didn't get up or for a hundred other reasons. However, I feel we made a just try in receivang signatures and in doing so, have what I believe to be 16 signatures which own 20 properties in the area. A letter of Insurance was faxed over to the city's office and should be on record. We have insured this area with the City of St. Paul as an undersigned. If another one is needed for some chance I can provide that to you at a future time. We are intending to sell intoxicating liquor on the sidewalk cafe and have a few ideas for the control of beverages being consumed by our patrons. First we will be using rolling flower pots to section off the area used for dining and drinking from the general public. (See Diagram) These flower pots can then be pushed against the building at the end of the night . , 09-631 and the tables and chairs will be placed inside the restaurant until the following business day. Second, we will have wait staff taking responsibility of these tables during the day and into the evening hours. On long and busy nights, such as Thursday, Friday, and Saturday's, along with any big events we will have door men(bouncers) keeping an extra eye on this area. We also have a camera that has been placed out side so we can visually see this area at all hours of that business day. I know that these maters take some time in developing, and I would like to ask for a speedy application acceptance. If there are any future matter that we need to resolve.
