Hi rhway Al and southerly of the State WHEREAS, The City of St. Paul has in process plans for the construction of the Battle Creek trunk sewer and branches; and WHEREAS, In addition to the construction of said sewer it is necessary to preserve the existing natural drainage in the area westerly of Trunk Highway 61 and southerly of the State Fish Hatchery in Sections 3 and L , Township 28, Range 22; and WHEREAS, Certain tax-forfeited lands are required for the construction of said sewer and for the preservation of the existing natural drainage; NOW, THEREFORE, BE IT RESOLVED That application be made to the Commissioner of Taxation of the State of Minnesota for a con- veyance under MSA Section 282.01, sub. 1, of the following de- scribed unimproved parcels of tax-forfeited land for use for the construction of said sewer and for flowage and drainage: that part westerly of Highway 61 and northerly of the right-of-way of the Chicago, Burlington and Quincy Railroad of the Southeast n of Section 3, Township 28, Range 22, containing 22.61 acres, more or less, accord- ing to the government survey thereof; also, all of Blocks 24 and 25, Town of Lower St. Paul, according to the recorded plat thereof. PAVLICEK • • January 22, 1958 To the Honorable Mayor and Council of the City of St. Paul Gentlemen and Madam: Attached is the recommendation of George M. Shepard with reference to the city's require- ments in connection with the construction of the Battle Creek sewer and the preservation of existing natural drainage as related to certain tax-forfeited lands. In order to proceed with the neces- sary acquisitions I request that an application be made to the Commissioner of Taxation of the State of Minnesota for a conveyance under MSA Section 282.01, sub. 1, of the tax-forfeited lands involved. These parcels are unim- proved, are zoned for heavy industry, and the surrounding area is, at present, undeveloped. Also submitted is a plat of the area showing the tax-forfeited land, and I have been ad- vised by Mr. Seamer that additional copies are available in his office for use in connection with the application. Seamer Assistant Land Commissioner 286 City Hall Dear Mr. Seamer: The City ,of St. Paul requires an easement for sewer construction and maintenance purposes in connection with the construction of the Battle Creek Sewer across the tax-forfeited property hereinafter described: That part westerly of Highway #61 and northerly of the Chicago, Burlington and Quincy Railroad right of way, of the Southeast * of Section 3, Township 28, Range 22, being 22.61 acres. In addition to the requirement for sewer easement, the City is confronted with a continuous, drainage problem in the area bounded by Trunk Highway #61, the Minnesota Fish Hatchery property and the right of way of the Chicago, Burlington and Quincy Railroad Company. For the most part, this is swamp area which receives the natural drainage from the entire surrounding area. A drain- age outlet from the Fish Hatchery property extending southeasterly to Battle Creek at` the point of crossing the Burlington and Milwaukee tracks must be preserved. h. '-In view of this requirement on the part of the City, it is requested that you take the necessary steps to enable the City of St. Paul to acquire the fore- going property for a sewer construction and maintenance easement and as a natural drainage outlet. Blocks 24 and 25, Lower St. Paul, should be included at this time. I shall be very glad to,discuss this with you at your convenience. Yours very truly, GEORGE M.
