This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Ordinance No. 5840, approved July 7, 1922, as amended, be and the same is hereby further amended so as to rezone Lots 5, 6, 7 and 8, except the south 100 feet thereof, Block 79, Dayton and Irvine's Addition, being a 16V2 foot strip at the rear of property located on the north side of Selby Avenue between Farrington Street and Virginia Street, from "C1 Residence District to Commercial District. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. This 16.5 ft strip is located 100 ft. north of Selby Ave. The property is described as the north 16.5 ft of Lots 5,6,7 & 8, Block 79, Dayton & Irvine Addition. Sixty - six and two - thirds percent or six out of 9 owners of the several descriptions within 100 ft. of the property to be rezoned have signed this petition. The adjacent land use is as follows: applicant's office building is to the north, a mixture of residential and commercial land uses are to the east, south & west. When the Zoning Ordinance was adopted in 1922, the south 100 ft. of Lots 5,6,7 & 8 was classified Commercial with the remaining 16.5 ft. zoned as % " Residence. In November of 1956 the four lots adjoining this property on the north and fronting Dayton Ave. were rezoned to Commercial to permit the Arrow Insurance Co, to estab- lish their home office building. Therefore, if this petition is granted, all of the property in the block bounded by Dayton, Selby, Virginia and Farrington would be zoned Commercial. The Arrow Insurance Co. contemplate no change in their present operation and is filing this request for a zoning reclassification for the purpose of correcting the unintentional omission of including this area in the rezoning petition favorably acted upon by the City Council in November of 1956. In view of the commercial character of the adjacent area and because the 16.5 ft. strip amounts to a spot zone, the Zoning Board finds that the proposed zoning is in accordance with the present development of this area. Gentlemen: We are attorneys representing the Arrow Insurance Co. in connection with the above petition. This petition was filed for the purpose of correcting an omission in another recent petition for re- zoning which was filed and acted upon favorably by the City Council. Last fall the Arrow Insurance Co. filed a petition to re- zone the north half of Block 79, Dayton and Irvine's Addition to the City of Saint Paul; the north half consisting of Lots 1, 2, 3 & 4. At that time it was thought that the entire south half of this block was zoned "Commercial." However, the south half of Block 79 was zoned "Commercial" only to a depth of 100 feet north from Selby Avenue. The lots in the south half of Block 79 are actually 116V2 feet deep, therefore, there remained a strip extending easterly and westerly through the center of Block 79 16V2 feet wide which was Class IICII residence. The purpose of the above petition is to correct this omission so that the entire block 79 will be zoned "Commercial." As was indicated in the previous zoning proceeding regarding this property it is still the intention of the Arrow Insurance Co. to use this property as the site of its home office building.
