Page 6 3. Appeal of Brenda Hovander to a Certificate of Occupancy Deficiency List for property at 659 Dayton Avenue. Appellant Brenda Hovander (P.O. Box 207, Carver, MN 55315) appeazed. Ms. Shaff gave a staff report. She said that Inspector Neis had conducted an inspection for the Fire Certificate of Occupancy and reported that the openable dimensions of the egress window in the south bedroom of Unit 9 were 20.75 inches high by 27 inches wide and in the north bedroom were 17.25 inches high by 27 inches wide. Ms. Hovander stated that her caretaker had reported that the windows were the same size in both bedrooms but that the one in the north bedroom was sticking. Ms. Moermond asked whether that was reflected in the inspector's notes. Ms. Shaff said that it was not. Ms. Moermond recommended granting a 3.25 inch variance on the openable height of the egress window in the south bedroom. She asked the property owner to have the egress window in the north bedroom repaired so that it could be opened to the full height. The window will be re- measured during the reinspection; Ms. Moermond said that she will recommend a variance if it can be made to open to as high as the window in the south bedroom. If there is a difference in openable height, she would revisit the issue. On May 28, 2009, Inspector Neis informed our office that he found the window in the north bedroom to be 21 inches high; therefore, on June 2, 2009, Ms. Moermond recommended granting a variance far the egress window in the north bedroom.
