WHEREAS, on October 15th, 1957, the Northwestern Bell
Telephone Company did file an application for an increase in
telephone rates for services furnished by it within the
State of Minnesota, with the Railroad and Warehouse Commission
of the State of Minnesota, and
WHEREAS, thereafter, an order of the Railroad and Ware-
house Commission of the State of Minnesota was issued, reciting
that under the law the reasonableness of existing telephone
rate charges may be considered by the Commission upon its own
motion, and it appearing from the records that the Northwestern
Bell Telephone Company did file an application for an increase
in rates on the date above set out, and further reciting that
the Commission, on its own motion and upon the said application,
set the matter down for hearing and said hearing being set for
January 14th, 1958 before the Railroad and Warehouse Commission.
and
',VHEREAS, under the law (Lenihan vs. Tri -State Telephone &
Telegraph Company, 208 Minn. 168, 293 N. W. 612), it clearly
appears that the Railroad and Warehouse Commission and the
Attorney General's Office, in this type of litigation, represent
the public and the users of the Company's services, and that the
municipalities of the State are not necessary parties to that
Litigation, nevertheless be it
RESOLVED, by the Council of the City of Saint Paul that
it hereby instructs Marshall F. Hurley, Corporation Counsel, and
Edwin Jones, Public Utilities Engineer to represent the City of
Saint Paul and the users of telephone services in said City at
said hearing, to participate in said hearing in cooperation with
the Attorney General, to the extent and in the manner that said
City is permitted to intervene in said litigation by the Railroad
and Warehouse Commission, as intervenor, or in any other capacity,
for the purpose and to the end that the Saint Paul users of

hearing and that any rates imposed by the Commission after
hearing shall only be proper, reasonable and strictly
according to law, and that this Council, representing the
people of the City of Saint Paul may, at all times, be
advised of the proceedings pending before and to be carried
on by the Railroad and Warehouse Commission in the matters
hereinabove detailed.
